DIVORCE RECORDS

Divorce records are sealed and ONLY available to the parties listed in the case or their Attorney on record.

In Office: You must provide a photo I.D. that also contains your signature (e.g. Driver’s License). The fee for a plain copy (not certified with a seal) is $1.00 per page of the document with a max fee of $40.00. The fee to obtain a CERTIFIED copy is $4.00 plus $1.00 per page of the document with a max fee of $40.00.

By Mail: You may send a letter of request listing your name at the time of your divorce and your previous spouses name along with a copy of your photo I.D. ( e.g. Driver’s License), a self-addressed stamped envelope for the return of your document and a check with your name and address on it payable to Montgomery County Clerk along with a fee of $5.00 (search fee) plus $1.00 per page of the document with a max fee of $40.00. If you would like a CERTIFIED copy please add an additional $4.00 to that total.

BIRTH/DEATH/MARRIAGE CERTIFICATES

Birth AND Death certificates are kept at the local Town or City Clerk’s Office where the event took place.

Marriage certificates are also kept the local Town or City Clerk’s Office where the certificate was initially obtained from.

If you are unaware of where these events took place, this information is also available at the NYS Department of Health, Bureau of Vital Statistics* in Albany NY.

Montgomery County Clerk’s Office DOES NOT retain these records.
