Notice to Bidders

PLEASE TAKE NOTICE: That Montgomery County on the 1st day of July, 2016 at 10:00 AM at the Montgomery County Purchasing Buyer, County Annex Building Room 104, 20 Park Street, Fonda, New York, 12068, will publicly open and read all sealed bids and proposals received pursuant to this notice for the furnishing of culvert pipe materials in connection with the Montgomery County Miami Avenue Culvert Replacement Project.

Work for Contract No. 1 – Culvert Materials will consist of fabrication of approximately 170 feet of 120-inch diameter smooth interior, High Density Polyethylene (HDPE) stormwater culvert pipe and delivery within six (6) weeks to the proposed site at Miami Avenue in the Town of Amsterdam, Montgomery County, NY, all as defined in greater detail in the contract documents.

CDBG-DR Funded Project

This project is being financed with U.S. Department of Housing and Urban Development (“HUD”) Community Development Block Grant-Disaster Recovery (“CDBG-DR”) funds administered by the NYS Governor's Office of Storm Recovery (“GOSR”). Attention of bidders is particularly called to Section 3 requirements,[1] M/WBE goals, Federal labor standards, insurance requirements, online reporting requirements using Elation System, Inc. and other requirements included in the GOSR Supplementary Conditions for Contracts.  See Instructions to Bidders for additional information.

Each bid must be submitted on the official forms included in the Project Manual. The bid forms are NOT TO BE REMOVED FROM THE PROJECT MANUAL. The entire Project Manual will be sealed within an opaque envelope. The name of the bidder and “Montgomery County Miami Avenue Culvert Replacement Contract No. 1 Bid Enclosed” shall be clearly marked on such envelope. If a Bid is sent by mail or other delivery system, both the outside packaging and sealed envelope containing the bid within shall be clearly marked “Montgomery County Miami Avenue Culvert Replacement Contract No. 1 Bid Enclosed”.

Starting on June 15, 2016, plans and specifications may be obtained at the office of the following, Monday – Friday, between the hours of 9:00 AM and 2:30 PM:

The Bidding documents may be obtained through bidder’s own express carrier service accountNo information will be mailed using U.S. Postal Service.  All bidders’ information, deposits, fees, and account information must be received by Montgomery County prior to sending.

Accompanying each bid must be a bid bond, certified check or bank check made payable to the order of Montgomery County in the amount of five (5%) percent of the bidder’s maximum bid amount as a guarantee that if the contract is awarded to a bidder, said successful bidder will comply with the Notice to Bidders and the specification for the contract in accordance therewith.  Said bid bond, certified check or bank check will be retained by Montgomery County, and upon execution of the contract, in accordance with said specifications, the said bid bond, certified check or bank check will be returned to the bidder.

On failure to comply with the Notice to Bidders and the specifications for said contract, the successful bidder shall forfeit the deposit as liquidated damages to Montgomery County.

Every bid or proposal must contain a non-collusion affidavit executed by the bidder or his authorized representative. Payment Bond equal to one hundred (100%) percent of the contract sum, will be required of the successful bidder.

The bidder to whom the contract will be awarded shall execute the contract and furnish required sureties within three (3) days after the date of Notice of Award.  Failure to do so will result in Bidder's forfeit of contract work and bid security. No bidder may withdraw his bid within forty-five (45) days after the date set for the opening thereof. Any bid may be withdrawn prior to the above scheduled time for the opening of bids, or any authorized postponement thereof.

Montgomery County reserves the right to waive any informalities in or to reject any or all bids submitted or to award the contract to the lowest responsible bidder who in the County’s judgment makes the most advantageous proposal to Montgomery County”.

All sealed bids or proposals must be received by the Commissioner of Public Works of Montgomery County prior to 10 AM on July 1, 2016, the date on which all sealed bids or proposals will be publicly opened and read aloud.
