RESOLUTION AUTHORIZING THE COUNTY EXECUTIVE TO EXECUTE CHANGE ORDER NO 1 WITH GALLO CONSTRUCTION CORPORATION FOR THE FMCC CAMPUS LABS AND CLASSROOMS PHASE III PROJECT (FMCC)

WHEREAS, the 2022 Capital Plan contains an appropriation of $1,000,000 for the FMCC Science Labs and Classrooms Phase 3 Project; and
WHEREAS, the FMCC Campus Labs and Classrooms Building Renovation Project was intended to be a sequential three (3) phased project as identified within Fulton County’s 2018-2020 Capital Plan; and
WHEREAS, the first two (2) phases were completed in 2018 and 2019 respectively; and
WHEREAS, due to the onset of the COVID-19 Pandemic, Phase 3 of the sequential three-phased project abruptly stopped once FMCC was notified by the SUNY Office of Capital Facilities that New York State would no longer support the project due to reappropriating State dollars toward more immediate health and safety related projects; and
WHEREAS, the initial Phase 3 project had been designed, successfully bid and all contracts had been executed; and
WHEREAS, Resolution #63 of 2022 authorized a contract with JMZ Architects and Planners, P.C. to update design plans and bid specifications for the FMCC Science Labs and Classrooms Phase 3 Project (2022 Capital Plan); and
WHEREAS, Resolution #42 of 2022 authorized advertisement for bids for the FMCC Science Labs and Classrooms Phase 3 Project (2022 Capital Plan); and
WHEREAS, funding for this project is as follows:

Fulton County | $250,000 |
Montgomery County | $250,000 |
TOTAL | $1,000,000 |
; and
WHEREAS, Resolution #105 of 2022 awarded four (4) prime contracts totaling $807,815.00; and
WHEREAS, Resolution #105 of 2022 awarded various supporting services related to the project totaling $35,950.00; and
WHEREAS, Resolutions #167 and #212 of 2022 authorized increases to the contract with SCI to total $58,634.96; and
WHEREAS, Resolution #213 of 2022 authorized an increase to the contract with Ray Audio Video to total $22,312.65.
; and
WHEREAS, the following is a summary of the project budget:

WHEREAS, Resolution #105 of 2022 awarded a contract to Gallo Construction Corporation in the amount of $589,955.00 for General Construction services to include a $36,000 Contingency Allowance; and
WHEREAS, all work under this contract is complete; and
WHEREAS, there is $17,076.40 remaining in the Contingency Allowance that will not be utilized under this contract; and
WHEREAS, FMCC is recommending that $14,269.40 of the remaining Contingency Allowance dollars be credited back to the project balance, leaving $2,807 remaining to deal with a problematic leak that recently transpired.
NOW, THEREFORE BE IT

I. Nature of Request:
AUTHORIZING THE COUNTY EXECUTIVE TO EXECUTE CHANGE ORDER NO 1 WITH GALLO CONSTRUCTION CORPORATION FOR THE FMCC CAMPUS LABS AND CLASSROOMS PHASE III PROJECT
II. Justification:

III. Legislative Impact:
