Local Law No. 18 of 1989 - A local law Prohibiting the Disposal of Radioactive or Nuclear Waste Within the Boundaries of the County of Montgomery Which is Generated Outside of Said County


Section 1. LEGISLATIVE INTENT: The Montgomery• County Board of
Supervisors believes that one of its most basic goals is to provide
the best possible living environment for County residents. In
keeping with this profound principle, it is of utmost importance
that actions be taken to ensure that the public is protected from
potential hazards as may be introduced into the environment ar1sing
from the disposal of radioactive and/or nuclear waste material.

Section 2. LEGISLATIVE ACTION: Said Board of Supervisors, thus,
prohibits the disposal of radioactive and/or nuclear waste materials
and similar such hazardous materials within the geographic
boundaries of the County of Montgomery, State of New York as may be
generated by sources from outside of such geographic boundaries.

Section 3. SAVING CLAUSE: If any clause, sentence, paragraph,
section or part of this Local Law shall be adjudged by any court of
competent jurisdiction to be invalid, such judgment, decree or
order shall not affect, impair or invalidate the remainder thereof,
but shall be confined in its operation to the clause, sentence,
paragraph, subdivision, section or part thereof directly involved in
the controversy in which the remainder of this Local Law shall not
be affected thereby and shall remain in full force and effect.

Section 4. EFFECTIVE DATE: This local law shall take effect within
20 days or upon its being filed with the Secretary of State of the
State of New York.
