Local Law No. 10 of 1988 - A local law Establishing the Office of Part Time Public Defender


SECTION 1. The Office of Part-time Public Defender is hereby established
in the County of Montgomery.

SECTION 2. The term of office of the Part-time Public Defender shall be
five years and the annual salary shall be $33,000.

SECTION 3. Subject to the approval of the Board of Supervisors, the
Part-time Public Defender may appoint as many assistant attorneys, clerks,
investigators, stenographers and other employees as he may deem necessary and
as shall be authorized by the Board. The Part-time Public Defender shall fix
the compensation of such aides and assistants within the amounts the Board may
appropriate for such purposes.

SECTION 4. The duties of the Part-time Public Defender shall be those
set forth and contained in Article 18(a) and Article 18(b) of the County Law
and such other or further duties as the Board may assign to the office by
resolution.

SECTION 5. If any clause, sentence, paragraph, section or part of this
Local Law shall be adjudged by any court of competent jurisdiction to be
invalid, such judgment, decree or order shall not affect, impair or
invalidate the remainder thereof, but shall be confined in its operation to
the clause, sentence, paragraph, subdivision, section or part thereof directly
involved in the controversy in which such judgment, decree or order shall
have been rendered and the remainder of the Local Law shall not be affected
thereby and sha11 remainder of the Local Law sha11 not be affected thereby and
shall remain in full force and effect.

SECTION 6. This law shall take effect on the 1st day of November, 1988.
