County of Montgomery Local law no. 4 of the year 1992
A local law Authorizing Montgomery County to Obtain reimbursement for the Cost of Medical, Hospital and Dental Care Provided to Inmates at the County Jail Having Third Party Coverage or Indemnification
Be it enacted by the Board of Supervisors of the County of Montgomery as follows:
Section 1. LEGISLATIVE INTENT.
Chapter 481 of the Laws of 1991 of the State of New York amended the New York State Correction Law adding Section 500-h to authorize counties 1 to enact a local law which would allow such counties to be reimbursed for costs paid for medical, hospital or dental services provided to inmates of such counties' correctional facility from any third party coverage or indemnification carried by such inmates. This Board of Supervisors does hereby find that it is appropriate for the County of Montgomery to seek whatever reimbursement is legally available for medical, hospital and dental care delivered to inmates of the County Jail. It is the intention of this Board of Supervisors in enacting this Local Law, to enact the provisions of Section 500-h(2) ot the Correction Law and thereby enable the County to be reimbursed for medical, hospital and dental care for those inmates of the Montgomery County Jail having third party coverage or indemnification.
Section 2.
The County of Montgomery, pursuant to Section 500-h(2) of the Correction law as the same may be amended from time to time, is hereby authorized to obtain reimbursement for costs paid for medical, hospital and dental services delivered to inmates of the Montgomery County Jail from any third party coverage or indemnification carried by an inmate.
Section 3. EFFECTIVE DATE.
This Local Law shall take effect immediately.
