LOCAL LAW NO. 2 of 1985 - A LOCAL LAW ESTABLISHING A MONTGOMERY COUNTY INFIRMARY DEPARTMENT


Local Law NO. 2
SECTION 1. LEGISLATIVE - INTENT. It is intended to hereby establish
a Montgomery County Infirmary Department for the County of
Montgomery, New York which shall be under the direction of an
Administrator appointed by the Montgomery County Board of
Supervisors.

SECTION 2. MONTGOMERY COUNTY INFIRMARY DEPARTMENT. There is hereby
created for the County of Montgomery, a Montgomery County Infirmary
Department to be separate and distinct from any and all other
County departments.

SECTION 3. ADMINISTRATOR: AUTHORITY, APPOINTMENT, QUALIFICATIONS AND SALARY.
(a) The Department herein created shall be headed by an
Administrator who shall be vested with authority, direction and
control over the Department and shall have power and authority to
appoint and remove officers and employees there in.
(b) The Administrator shall be appointed by the Montgomery County
Board of Supervisor$. The Administrator shall be in the exempt
service of Civil Service Classification and shall serve a five year
term.
(c) The Administrator shall be licensed by the State of New York
and shall meet or exceed all applicable standards established
pursuant to law.
(d) The salary of the Administrator shall be established and
adjusted from time to time by the Board of Supervisors.

SECTION 4. POWERS AND DUTIES OF ADMINISTRATOR. The Administrator shall:
(a). Be the Chief Administrative Officer of the Montgomery County
Infirmary.
(b) Comply with all laws, rules and regulations pertaining to the
operations of the Montgomery County Infirmary and perform all of
the functions, powers and duties imposed by law upon the Administrator
of a Nursing Home.
(c) Equip the Infirmary with all necessary furniture, appliances,
fixtures and other needed facilities for the care of patients and
for the use of officers and employees thereof, and purchase all
necessary supplies, within the budgetary restrictions imposed by
the Montgomery County Board of Supervisors.
(d) Have general supervision and control of the records, accounts
and buildings of the Infirmary and all internal affairs, and
maintain discipline therein and enforce compliance with and
obedience to all bylaws, rules and regulations adopted by the Board
of Supervisors for the government, discipline and management of said
Infirmary and the employees and patients thereof; and shall make such
further rules, regulations and orders as he/she may deem necessary not
inconsistent with 1aw, applicable collective bargaining agreements,
or with the rules, regulations and directions of the Board of Supervisors.
(e) Appoint such resident officers and such employees as are authorized
by the Board of Supervisors for the efficient performance of the business
of the Infirmary and prescribe their duties.
(f) Cause proper accounts and records of the business and operation of
the Infirmary to be kept regularly from day to day, in books and
records provided for that purpose; and shall see that such accounts
and records are correctly made up for the annual report to the Board
of Supervisors.
(g) Receive into the Infirmary any person who is entitled to admission
thereto under the bylaws, rules and regulations governing said Infirmary;
and shall cause to be kept proper accounts and records of the admission
of all patients, their name, age, sex, race, marital status, medical
condition, residence, occupation and place of last employment.
(h) Collect and receive all monies due the Infirmary, keep an accurate
account of the same and transmit same to the Treasurer of the County
of Montgomery as the Board of Supervisors shall direct.

SECTION 5. DEPUTY
(a) The Infirmary Administrator shall have the power to appoint a
Deputy Infirmary Administrator.
(b) The term of office of the Deputy Infirmary Administrator appointed
hereunder shall coincide with that of the Infirmary Administrator,
provided that any such appointment may be revoked at any time by the
Infirmary Administrator by written revocation filed with the Board of
Supervisors and County Clerk. The position of Deputy Infirmary Administrator
shall be in the exempt class of civil service.
(c) The Deputy Infirmary Administrator shall be vested with the same powers
and duties as the Infirmary Administrator in the absence of said Administrator.
The Deputy shall, within 18 months of appointment, possess a
valid Nursing Home Administrator's license.

SECTION 6. SAVING CLAUSE. If any clause, sentence, paragraph, section
or part of this Local Law shall be adjudged by any court of competent
jurisdiction to be invalid, such judgment, decree or order shall not
affect, impair or invalidate the remainder thereof, but shall be
confined in its operation to the clause, sentence, paragraph, subdivision
section or part thereof directly involved in the controversy in which.
such judgment, decree or order shall have been rendered and the remainder
of this Local Law shall not be affected thereby and shall remain in full
force and effect.

SECTION. 7. EFFECTIVE DATE. This Local Law shall take effect immediately.
