DATED: 1974

WHEREAS, Chapter 346 of the Laws of New York State enacted in 1973 authorized the establishment of seven Regional Off-Track Betting Cor­porations, and

WHEREAS, Region No. "5" has been designated the Capital District Region comprised of Albany, Clinton, Columbia, Essex, Fulton, Green, Hamilton, Montgomery, Rensselaer, Saratoga, Schenectady (City or County), Schoharie, Warren and Washington Counties, and

WHEREAS, it is the intention of Montgomery County to become a participating member of said Regional Corporation, now, therefore:

BE IT ENACTED BY THE MONTGOMERY COUNTY BOARD OF SUPERVISORS, as follows:

SECTION 1. This Law shall be entitled "A Local Law authorizing Montgomery County to become a participating member of the Capital District Regional Off-Track Betting Corporation."

SECTION 2. Montgomery County, is hereby authorized to participate in the Capital District Regional Off-Track Betting Corporation, said
Corporation to implement an off-track betting system for the Capital District Region when its Plan of Operation has been approved by the State Racing and Wagering Board.

SECTION 3. Insofar as the provisions of this Local Law are in­-consistent with the provisions of the County Chapter or any other special or local laws the provisions of this Local Law shall be controlling.

SECTION 4. This Local Law shall take effect 45 ·days after its adoption, or upon approval of a majority of the electors voting, if a
protest petition is filed, pursuant to the provisions of Section 24 of the Municipal Home Rule Law .
