RE: A LOCAL LAW PROVIDING FOR A PERMANENT PLAN OF APPORTIONMENT FOR THE MONTGOMERY COUNTY BOARD OF SUPERVISORS ON A WEIGHTED VOTE BASIS

BE IT ENACTED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF MONTGOMERY AS FOLLOWS:

SECTION 1, LEGISLATIVE INTENT. It is the Intention of the Board of Super­visors of Montgomery County by this local law to comply with the constitutional re­quirements established by the Supreme Court of the United States and the Court of Appeals of the State of New York.
SECTION 2. THE BOARD OF SUPERVISORS. On and after January first. nineteen hundred seventy-four, the legislative body or the County of Montgomery shall continue to be known and designated as the board of supervisors, but their respective votes as such members thereof shall, on and after the first day of January, nineteen hundred seventy-four be and fixed In accordance with the provisions of this local law to accomplish the permanent reapportionment of the board of supervisors or the County of Montgomery.
SECTION 3. VOTING STRENGTH. The apportionment or the voting strength of the members of the board or supervisors shall be determined by the nineteen hundred seventy federal census In the County of Montgomery, until the next deccnnlnl federal census, In which event the voting shall be changed, If necessary, to con­form to such decennial federal census. On and alter the first day of January, nineteen hundred seventy-four, and continuing until the decennial federal census unless an official county census shall be made sooner, each of the eighteen members of the board of supervisors of Montgomery County shall be entitled to the following number of votes an any resolution, local law, motion or proposal to be voted on by the board of supervisors, to wit:

A total of five hundred two (502) affirmative votes shall be required for the adoption of any resolution, local law, motion or proposal requiring a simple majority vote. and a total of six hundred sixty-seven (667) affirmative votes shall be required for the adoption of any resolution, local law, motion or proposal requiring a two-thirds \'Ole.
SECTION 4. EFFECT OF OTHER OR ACI'S. Any law, resolution or other act to the extent inconsistent herewith shall be superseded by the within law.
SECTION 5. SEPARABILITY. It any clause, sentence, paragraph or section or this local law shall be adjudged by any court of competent jurisdiction to be Invalid, such adjudication shall not effect, impair or invalidate the r<.'malnder thereof, but shall be confined in its operation to the clause, sentence, paragraph or section thereof SECTION 6. This local law shall become effective only if approved by an order or the New York State Supreme Court and shall otherwise comply fully with lhp re­quirements of the applicable provisions of the Municipal Home Rule Law o( the Stale or New York .
