RESOLUTION AUTHORIZING THE COUNTY EXECUTIVE TO EXECUTE AMENDMENT NO. 1 TO THE AGREEMENT BETWEEN THE COUNTIES OF FULTON AND MONTGOMERY AND JMZ ARCHITECTS AND PLANNERS, P.C. FOR THE FMCC THEATRE AND OTHER BUILDINGS RENOVATION PROJECT

WHEREAS, Resolution 157 of 2018 authorized a contract with JMZ Architects to provide Design and Bid Phase Services for the FMCC Theatre and Other Buildings Renovation Project, and

WHEREAS, funding will be from:

FM FOUNDATION:	$575,000
SUNY:	$575,000

WHEREAS, FMCC has identified that additional Construction Administration Services in the amount of $34,550 are needed for the project,

NOW, THEREFORE BE IT

RESOLVED, that Amendment No. 1 in the amount of $34,550 be added to JMZ’s Agreement for Construction Administration Services for the FMCC Theatre and Other Buildings Renovation Project, and be it further

RESOLVED, that the revised contract amount be as follows:

ORIGINAL CONTRACT:	$127,200
AMENDMENT NO. 1	$34,550
REVISED CONTRACT AMOUNT:	$161,750

FURTHER RESOLVED, that this Resolution is contingent upon a similar resolution being passed by the Fulton County Board of Supervisors; and

FURTHER RESOLVED, that this Resolution is contingent upon all funds being in place prior to the execution of any contracts and the project not exceeding the approved appropriations.

Statement of Legislative and Financial Impact:

I. Nature of Request:

AUTHORIZING THE COUNTY EXECUTIVE TO EXECUTE AMENDMENT NO. 1 TO THE AGREEMENT BETWEEN THE COUNTIES OF FULTON AND MONTGOMERY AND JMZ ARCHITECTS AND PLANNERS, P.C. FOR THE FMCC THEATRE AND OTHER BUILDINGS RENOVATION PROJECT

II. Justification:

FMCC has identified that additional Construction Administration Services in the amount of $34,550 are needed for the project

III. Legislative Impact:

The Montgomery County Legislature is authorized to pass this Resolution pursuant to Article 2 of the Montgomery County Charter.

IV. Financial Impact:

This will be included in the appropriated project budget as two Change Orders have been submitted to move a portion of the scope of work to the Classrooms and Labs Phase II.
