RESOLUTION AUTHORIZING THE COUNTY EXECUTIVE TO SIGN AN AGREEMENT WITH GPS-GOVPAY.NET TO ACCEPT CREDIT CARD PAYMENTS (COUNTY CLERK)

WHEREAS, GPS provides the GOVPAY.NET payment network consisting of governmental entities that have each contracted with GPS to accept payments on their behalf made by consumers through GPS with such related support services as GPS provides,
WHEREAS, the entities that establish the rules, regulations and guidelines for the credit card and debit card systems require that Merchant enter into a contractural relationship with an entity that is a member of the PTOs and agree to comply with PTO rules and regulations as they apply to credit and debit card transactions that are submitted to Vantiv by GPS on the Montgomery County Clerk's Office behalf; and
WHEREAS, by executing this Agreement, Vantiv is made a party to this Agreement and Montgomery County Clerk's Office understands that (i) Merchant has contracted with GPS to obtain certain processing services; (ii) GPS has agreed to be responsible for all or part of Merchant's obligations containerd herein; and (iii) Merchant is fulfilling the PTO Rules
RESOLVED, the Montgomery County Legislature hereby authorizes and directs the County Executive, following review and approval of the County Attorney, to sign any and all documents to effectuate said agreements with the Montgomery County Clerk's Office and GPS and shall continue for one year, automatically renewing for additional one year periods.

Statement of Legislative and Financial Impact:
I. Nature of Request:
This will allow the Montgomery County Clerk's Office to accept credit card payments
II. Justification:
Following the review and approval by the County Attorney it is hereby requested that the agreement to establish credit card payments in the Montgomery County Clerk's Office be signed by the County Executive. GOVPAY.NET is already a vendor in the Probation Department and Sheriff's Jail
III. Legislative Impact:
Pursuant to Article 3 of the County Charter the Montgomery County Executive has the authority to sign contracts
IV. Financial Impact:
There is no financial impact to Montgomery County
