RESOLUTION REJECTING AUCTION BID ON PARCEL #43 - 2014 TAX FORECLOSURE AUCTION (OFFICE OF THE LEGISLATURE)

WHEREAS, Montgomery County has foreclosed upon and taken title to certain parcels of real property situated in the Town of Glen, identified as tax parcels 36.-3-4, 36.-3-5 and 36.-3-6; and
WHEREAS, said parcels are located on Riverside Drive, Fultonville, and are commonly referred to as the former Poplars Inn and Restaurant; and
WHEREAS, said parcels were placed for sale through the county tax auction held May 13, 2014, with the three parcels listed above identified as auction parcels 41, 42 and 43, respectively; and
WHEREAS, that said auction the parcels were presented for sale as the high bidder having choice selection among the parcels at the high bid amount, which resulted in parcel 43 receiving a high bid of $135,000 from Buanno Holdings, LLC.
RESOLVED, that the Montgomery County Legislature, in the interest of preserving the development value of said real property, hereby rejects the high bid received on auction parcel 43.
MOTION TO AMEND by Legislator Kelly, seconded by Legislator Duchessi, to change the title of the resolution to RESOLUTION ACCEPTING AUCTION BID ON PARCEL #43 - 2014 TAX FORECLOSURE AUCTION (OFFICE OF THE LEGISLATURE) and to change the resolved clause as follows: RESOLVED, that the Montgomery County Legislature, in the interest of preserving the development value of said real property, hereby accepts the high bid received on auction parcel 43; and to add the following clauses:
FURTHER RESOLVED, acceptance of the bid on parcel 43 is contingent upon the simultaneous sale of parcels 41 & 42 to Buanno Holdings, LLC. for the combined sum of $50,000; and
FURTHER RESOLVED, that authorization of such sale is conditioned upon real property taxes for any and all other parcels within Montgomery County owned by Buanno Holdings, LLC being current as of the date of closing on the above referenced transaction; and
FURTHER RESOLVED, that the county will initiate the combining of the three subject tax parcels into one tax parcel prior to closing, and Buanno Holdings, LLC shall agree to cooperate in any steps necessary to effectuate the combining of the three tax parcels into one; and
FURTHER RESOLVED, that the Montgomery County Legislature hereby authorizes the county treasurer to execute the deed and related documents in furtherance of the above referenced sale; and
passed with Aye(8). Legislator Kuchis was absent.
