RESOLUTION NO. 155 of 2011 DATED: August 9, 2011

WHEREAS, it is the desire of the Montgomery County Board of Supervisors to retain outside legal counsel, after recommendation from the Montgomery County Industrial Development Agency (MCIDA), to provide legal representation on the enforcement of defaulted loans upon the Chairman’s approval, and

WHEREAS, immediate authorization from the Chairman of the Board of Supervisors is needed to allow for timely enforcement, and

WHEREAS, said Attorney, shall be paid for said legal services, which will be paid upon submission of a payment voucher, from the Revolving Loan Fund, budget line item CD-24-4-8668-93.4431,

RESOLVED, authorization is given to the Chairman of the Board of Supervisors to immediately act upon the request of the MCIDA to hire outside legal representation for the enforcement of defaulted loans and to sign and execute a contract for said services upon review and approval of the County Attorney, and

FURTHER RESOLVED, that Resolution No. 186 of 2009 is hereby rescinded.

MOTION TO AMEND by Supervisor Thayer, seconded by Supervisor Wheeler, to insert in the "RESOLVED" clause the words "at an hourly rate not to exceed $200.00 per hour", passed with Aye(1649).  Supervisor DiMezza was absent. (8/9/2011)
