RESOLUTION ADOPTING LOCAL LAW NO. 2 OF 2011 - A LOCAL LAW AUTHORIZING THE PRIVATE SALE OF COUNTY-OWNED PROPERTY, NOT NEEDED FOR A COUNTY PURPOSE - TOWN OF PALATINE (TREASURER)

WHEREAS, on May 24, 2011 a proposed Local Law for the County of Montgomery, entitled:  “A Local Law Authorizing The Private Sale Of County-Owned Property, Not Needed For A County Purpose - Town Of Palatine” was presented to the Board of Supervisors for consideration, and

WHEREAS, on May 24, 2011 Resolution No. 16 of 2011 was adopted authorizing and directing that a Public Hearing be held by the Board of Supervisors on the 28th day of June 2011, at the time and place appointed, and

WHEREAS, said public hearing has been held,

RESOLVED, that Introductory Local Law No. 2 of 2011 hereby is submitted to the Montgomery County Board of Supervisors for consideration, following the holding of a public hearing, as follows:

Introductory Local Law No. 2 of 2011 - A Local Law Authorizing the Private Sale of County-Owned Property, Not Needed for a County Purpose - Town of Palatine

BE IT ENACTED by the Board of Supervisors of the County of Montgomery as follows:

SECTION 1.  The Board of Supervisors of the County of Montgomery has
           determined that County-owned real property parcel, known as SBL
           32.-2-17, located in the Town of Palatine is no longer necessary
           for public use.

SECTION 2.  The Board of Supervisors of the County of Montgomery hereby
           authorizes the conveyance of all the right, title and interest of
           the County in and to said real property to Emory and Elizabeth
           Luck for the sum of $200.00, and

SECTION 5: SAVING CLAUSE:

If any clause, sentence, paragraph, section or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid, such judgment, decree or order shall not affect, impair or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, section or part thereof directly involved in the controversy in which such judgment, decree or order shall have been rendered and the remainder of this Local Law shall not be affected thereby and shall remain in full force and effect.

SECTION 6.  EFFECTIVE DATE:

This Local Law shall take effect when all applicable statutory requirements for its passage and adoption have been fully complied with and it has been filed in the Office of the Secretary of State, and

FURTHER RESOLVED, that the Clerk of the Board of Supervisors hereby is authorized and directed to file one certified copy thereof in the Office of the Secretary of State and to ensure that it is published in the County’s designated legal newspapers, as required by law.

RESOLUTION ADOPTED with Aye(1322).  Supervisors Wheeler, Baia, Quackenbush and Sweet were absent. (6/28/2011)
