RESOLUTION ADOPTING INTRODUCTORY LOCAL LAW NO. 5 - A LOCAL LAW APPROVING THE EXECUTION AND DELIVERY OF A GROUND LEASE BY MONTGOMERY COUNTY RELATING TO A CAPITAL PROJECT FOR HFM BOCES

WHEREAS, on September 28, 2004 a proposed Local law for the County of Montgomery, entitled:  “A Local Law Approving the Execution and Delivery of a Ground Lease by Montgomery County Relating to a Capital Project for HFM BOCES” was presented to the Board of Supervisors for consideration, and

WHEREAS, on September 28, 2004 Resolution No. 222 of 2004 was adopted authorizing and directing that a Public Hearing be held by the Board of Supervisors on the 26th day of October, 2004, at the time and place appointed,

RESOLVED, that said Local Law, known as Introductory Local Law No.  5 of 2004, entitled: “A Local Law Approving the Execution and Delivery of a Ground Lease by Montgomery County Relating to a Capital Project for HFM BOCES” hereby is adopted and is incorporated and attached hereto, and

FURTHER RESOLVED, that the Clerk of the Board of Supervisors hereby is authorized and directed to file one certified copy thereof in the Office of the Secretary of State and to ensure that it is published in the County’s designated legal newspapers, as required by law.

FURTHER RESOLVED, that adoption of this Local Law is contingent upon the adoption of a similar Local Law by Fulton County Board of Supervisors.
