RESOLUTION AUTHORIZING THE COUNTY EXECUTIVE TO SIGN APPROVED CHILD CARE FACILITIES AGREEMENTS FOR 2025-2026 (SOCIAL SERVICES)

WHEREAS, the Commissioner of Health & Human Services is charged with the responsibility for the administration of all child welfare services in Montgomery County pursuant to Section 395 et seq. of Social Services Law; and
WHEREAS, New York State Office of Children and Family Services (OCFS) requires counties to enter into agreements with state approved child care facilities that provide services to our foster care and/or behavioral children in Montgomery County; and
WHEREAS, these facilities and their per diem rates are regulated by OCFS; and be it
RESOLVED, the facilities that Montgomery County utilizes are as follows:
FURTHER RESOLVED, that the Montgomery County Legislature, after review and approval by the County Attorney, hereby authorizes and directs the County Executive to sign, and execute prospective contract documents for a term of June 1, 2025 through May 31, 2026 entered into between the County and OCFS-approved agencies providing services to county children in need of foster care and/or behavioral service.

I. Nature of Request:
Authorization of the County Executive to sign state approved child care facilities agreements.
II. Justification:
The department is mandated to contract with state approved agencies to provide services to children in foster care.
III. Legislative Impact:
Pursuant to Article 3 of the Charter the Montgomery County Executive has the authority to sign contracts.
IV. Financial Impact:
There is no additional financial impact as these services are currently budgeted.

RESOLUTION AUTHORIZING THE COUNTY EXECUTIVE TO AMEND HOME RUN & TURNABOUT AGREEMENTS AND SIGN ADDITIONAL AGREEMENTS (SOCIAL SERVICES)

WHEREAS, Resolution 257 of 2024 authorized the County Executive to sign contracts with Together for Youth, as well as our five local school districts and HFM BOCES for the collaboration of the Home Run and Turnabout Prevention Programs; and
WHEREAS, OESJ Central School District has elected to end their partnership with Together for Youth at the end of the 2024-2025 school year, thus altering the term of the two agreements between our department and OESJ from January 1, 2025 – December 31, 2025 to January 1, 2025 – June 30, 2025; and
WHEREAS, other local school districts within Montgomery County have identified a further exigency within their districts and are desirous of adding the two additional programs for a term of July 1, 2025 – December 31, 2025; and
WHEREAS, the new prorated cost per program for a term of January 1, 2025 – June 30, 2025 and July 1, 2025 – December 31, 2025 is $21,180.68; and
NOW THEREFORE BE IT RESOLVED, the Montgomery County Legislature hereby authorizes the amendment of the agreement with OESJ Central School District to reflect a new term of January 1, 2025 – June 30, 2025 for a total of $21,180.68 per program, as well as the agreement with HFM BOCES to coordinate payment with OESJ with the abovementioned amendments.
BE IT FURTHER RESOLVED, the Montgomery County Legislature hereby authorizes two additional programs with another local school district at a total of $21,180.68 per program for the term of July 1, 2025 – December 31, 2025, as well as additional agreements with HFM BOCES to coordinate payment with this district and our department for the abovementioned term and cost per program.
BE IT FURTHER RESOLVED, that the County Executive, upon review and approval of the County Attorney, is hereby authorized and directed to sign the aforementioned addendums and contracts.

I. Nature of Request:
Authorizing the County Executive to sign amendments to the term and cost per program for the OESJ Central School District Home Run and Turnabout Prevention Program agreements and HFM BOCES agreement; and sign additional contracts with another district and HFM BOCES.
II. Justification:
OESJ is terminating their collaboration with Together for Youth at the end of the 2024-2025 school year. The two Family Specialists from OESJ’s programs will be reassigned to another district that is desirous of adding more supports and programs for students. These programs have the ability to reduce costly foster care placements by keeping children in their own homes.
III. Legislative Impact:
Pursuant to Article 3 of the Charter, the Montgomery County Executive has the authority to sign contracts.
IV. Financial Impact:
There is no financial impact as the department will be moving two programs from OESJ mid-year and placing them with another district for the remaining two quarters of 2025. Eleven Home Run and Turnabout programs were included in the department’s budget and despite these changes, that is what will remain for 2025.
