WHEREAS, the Montgomery County Youth Bureau promotes the physical, emotional and social well-being of youth and families in our community and is committed to helping young people grow up healthy, caring and responsible through positive youth development, the Montgomery County Youth Bureau supports this initiative as a means to educate our youth on the importance of agriculture in our community; and

WHEREAS, this is the 183rd year of the Montgomery County Fonda fair, one of the largest tourist attractions in Montgomery County; and

WHEREAS, the Montgomery County Agricultural Society runs the fair; and

WHEREAS, the fair is a showcase to the public of the bountiful harvest of Montgomery County farmers; and

WHEREAS, the Montgomery County Ag Society has agreed to accept a flat rate of $7,500 a day to pay for all youth who may attend the fair on Wednesday, August 28th and Friday, August 30, 2024; and 

WHEREAS, allowing the youth of Montgomery County to attend free-of-charge on  Wednesday, August 28 and Friday, August 30, 2024 promotes a fun-family experience in the heart of Montgomery County.

RESOLVED, the Montgomery County Legislature hereby authorizes and directs the County Executive to enter into an agreement with the Montgomery County Agricultural Society to pay a flat rate in return for all youth being given free admission to the fair on Wednesday, August 28th and Friday, August 30, 2024 promoting Youth Days.

WHEREAS, the Montgomery County Health Department has received Lead Rental Registry Grant funding which is new for 2024; and

WHEREAS, New State program Initiative coupled with receiving this funding has created the need to re-evaluate of positions within the department; and

WHEREAS, the Public Health Director has determined that there is a need to add two (2) Public Health Program Coordinator to accomplish the added responsibilities in regard to the Lead Rental Registry and other State initiatives; and

WHEREAS, The Personnel Officer recommends that the County Executive Enter into an agreement with Marist College who is offering reduced tuition for select graduate and adult undergraduate programs to all full-time and part-time employees and volunteers of Montgomery County; and

WHEREAS, Marist College is offering a fifty percent (50%) discount on tuition on the Master of Public Administration (MPA) degree for county employees.  In addition, a twenty-five percent (25%) discount will be granted to employees/volunteers pursuing full-time or part-time graduate or adult undergraduate studies online or on campus, and this same discount with the same terms and conditions will be extended to the employees/volunteers immediate adult family members; and

WHEREAS, The Personnel Officer and Marist College, believe a partnership will help improve and expand the reach of Montgomery Counties current education benefits plan and assist its workforce in reaching their higher education goals thus creating greater opportunities within the county for them; and

WHEREAS, Marist does not charge any fees for this service and would only help communicate the partnership opportunity to our employees and volunteers in return; and

WHEREAS,  the Montgomery County Legislature adopted the proposed 2024-2025 FMCC Operating Budget by Resolution 194 of 2024; and 

WHEREAS, Fulton County did not approve the proposed budget and it is necessary to pass a new resolution to pass the budget; and

WHEREAS, the Fulton-Montgomery Community College Board of Trustees has presented Fulton and Montgomery County, the sponsoring counties, with a 2024-2025 budget request, proposing a total FMCC budget of $15,385,889; and

WHEREAS, a public hearing related to the adoption of said FMCC Budget was held on July 23, 2024; and

WHEREAS, that the amount to be appropriated by the County of Montgomery, as its sponsor share of said Budget, shall be $ 1,645,821, which is 11% of the Operating Budget.

WHEREAS, an application (RP-554) has been filed for a correction to the 2024 Town and County Tax Roll for the Town of St. Johnsville, pursuant to Section 554 of the Real Property Tax Law, with the Director of Real Property, alleging an error in the 2024 Town and County Tax Roll:

Parcel 9.13-1-1.3, New Street, St. Johnsville, owned by 12 New Street Development was charged on inventory and an assessment that was not matching what the Assessor had intended (building was destroyed before Taxable Status Date); and

WHEREAS, the Montgomery County Legislature finds that there was an error, shown as a Clerical Error, that is applicable in the application for correction; and

WHEREAS, Resolution 6 of 2024 allows the Montgomery County Auditor to sign corrections that do not exceed $2,500, and any corrections in excess of that amount must be determined by the Montgomery County Legislature;

RESOLVED, that the tax levying body hereby is authorized to and directed to approve said application by making notations on the original application and the duplicate, and by entering the corrected extension of taxes; and

RESOLVED, that said Director of Real Property is also authorized to and directed to make an order setting forth the corrected taxes, and directing the officer having jurisdiction over the tax roll to correct the roll, and to affix the order and approved applications to the tax roll and the warrants, per Section 554 of the Real Property Tax Law, such annexed applications and warrants becoming part of such rolls; and

RESOLVED, that the Director of Real Property shall immediately submit to the officers having jurisdiction over the tax rolls, and above order, all applications; and

RESOLVED, that the Director of Real Property shall mail notices of approval of the applications to the applicants and the Auditor shall submit a monthly report, setting forth all corrections and/or refunds processed, to the Legislature; and

RESOLVED, that, provided the applications were filed pursuant to Paragraph 7A of 554 of the Real Property Tax Law, the applicants will have 8 days from the date of mailing to pay such corrected taxes due, if any, without interest; and

RESOLVED, that said officers having charge of the tax rolls are hereby ordered and directed to immediately collect the corrected tax; and

FURTHER RESOLVED, that the Montgomery County Treasurer is directed to charge any taxes deleted from the current roll, by this resolution, wherever appropriate, against the account of the respective property taxing jurisdiction in the next ensuing tax levy; and

FURTHER RESOLVED, that the Montgomery County Treasurer is directed to notify the appropriate districts, of any levy cancelled that will be charged back on the ensuing tax roll.

RESOLUTION NO. 218 of 2024 DATED: August 27, 2024 RECOMMENDATION:

WHEREAS, pursuant to the Audit Guidelines, Section 2.02 (2), requires after examination and review of the claims by the County Auditor, and there being no objection to any of the claims by any committee or Board member, shall move that the claims as audited are approved and presented to the Board for approval of payment; and

WHEREAS, the County Auditor has audited claims for the period of July 23, 2024, through August 20, 2024 and the County Auditor recommends the payment of the claims as attached hereto in the "Abstract of Audited Claims".

RESOLUTION NO. 219 of 2024 DATED: August 27, 2024 RECOMMENDATION:

WHEREAS, the Department of Public Works has solicited bids for the replacement of two roofs at the Montgomery County Annex Facility; and

WHEREAS, the Department of Public Works advertised for bids pursuant to Section 103, Article 5-a of General Municipal Law; and

WHEREAS, Bids were opened and read aloud on August 8, 2024 at 2pm per bid specifications; and

RESOLVED, the bid will be awarded to the lowest, responsible, responsive bidder.

FURTHER RESOLVED, that the Montgomery County Executive is authorized to enter into a contract, upon review and approval of the Montgomery County Attorney, with Midstate Industries of Schenectady, New York for a sum not to exceed $258,500.00 for replacement of roofing at the Montgomery County Annex Facility.

RESOLUTION NO. 220 of 2024 DATED: August 27, 2024 RECOMMENDATION:

WHEREAS, Montgomery County has been approached with a request for permission to hold a fireworks display at the former Beech-Nut facility; and

WHEREAS, E29, the holder of the Purchase and Sale Agreement has agreed to this display as well; and

WHEREAS, Montgomery County supports the Village's efforts to promote economic development.

NOW THEREFORE BE IT RESOLVED, that the Montgomery County Legislature, upon the receipt  of all necessary approvals and permits,  signing of proper waivers and proof of proper insurance coverage in favor of Montgomery County, authorizes the use of the former Beech-Nut facility for a fireworks display on September 14, 2024 in the Village of Canajoharie; and

BE IT FURTHER RESOLVED, that the use of the former Beech-Nut facility for the fireworks display shall be at no cost to Montgomery County.
