RESOLUTION ADOPTING THE REVISED MONTGOMERY COUNTY SEXUAL HARASSMENT PREVENTION POLICY

WHEREAS, New York State Law, states that the duty of public employers is to develop and implement programs to ensure that public employers maintain a work environment which is free from sexual harassment; and
WHEREAS, specific elements have been modified to meet updates in state law regarding sexual harassment; and
WHEREAS, the Personnel Officer, in conjunction with Roemer Wallens Gold & Mineaux LLP, has recommended the attached policy update; and
RESOLVED, that the Montgomery County Legislature hereby adopts the Montgomery County Sexual Harassment Prevention Policy attached hereto and made part of this resolution.

I. Nature of Request:
To implement a program to ensure that Montgomery County maintains a work environment which is free from sexual harassment.
II. Justification:
The goal of the Montgomery County Sexual Harassment Prevention Policy is to maintain a work environment which is free from sexual harassment. As such, revisions have been made to ensure that our Policy contains all the required statutory elements.
III. Legislative Impact:
Article 2, Section 2.04 of the Montgomery County Charter states that the Montgomery County Legislature shall be the legislative, appropriating and policy-determining body of the County.

RESOLUTION NO. 206 of 2024 DATED: August 27, 2024 RECOMMENDATION: |
RESOLUTION ALLOWING THE COUNTY EXECUTIVE TO ENTER INTO AN AGREEMENT WITH MARIST COLLEGE (PERSONNEL)

WHEREAS, The Personnel Officer recommends that the County Executive Enter into an agreement with Marist College who is offering reduced tuition for select graduate and adult undergraduate programs to all full-time and part-time employees and volunteers of Montgomery County; and
WHEREAS, Marist College is offering a fifty percent (50%) discount on tuition on the Master of Public Administration (MPA) degree for county employees. In addition, a twenty-five percent (25%) discount will be granted to employees/volunteers pursuing full-time or part-time graduate or adult undergraduate studies online or on campus, and this same discount with the same terms and conditions will be extended to the employees/volunteers immediate adult family members; and
WHEREAS, The Personnel Officer and Marist College, believe a partnership will help improve and expand the reach of Montgomery Counties current education benefits plan and assist its workforce in reaching their higher education goals thus creating greater opportunities within the county for them; and
WHEREAS, Marist does not charge any fees for this service and would only help communicate the partnership opportunity to our employees and volunteers in return; and
RESOLVED, the Montgomery County Legislature authorizes the County Executive to enter into said agreement upon review and approval of the County Attorney.

I. Nature of Request:
Marist College is offering a discount to Montgomery County Employees. This discount in higher education provides an opportunity for our employees to further their education and expand their employment opportunities within Montgomery County.
II. Justification:
Retention of employees has been a matter of concern for Montgomery County. Montgomery County values its workforce and would like to provide employees with educational opportunities that may provide increased opportunities for career growth.
III. Legislative Impact:
Authorized pursuant to Article 3 of the Montgomery County Charter.
IV. Financial Impact:
No Financial Impact. Cost savings to employees and their eligible dependents for higher education.

RESOLUTION NO. 207 of 2024 DATED: August 27, 2024 RECOMMENDATION: |
RESOLUTION ADOPTING REVISED MONTGOMERY COUNTY VEHICLE USE AND MILEAGE REIMBURSEMENT POLICY (PERSONNEL)

WHEREAS, the current policy is outdated and revisions are required; and
WHEREAS, the revised policy will allow for uniform application of the rules contained within; and
WHEREAS, this policy provides clear and concise guidance to County employees for vehicle use and mileage reimbursement.
RESOLVED, that the Montgomery County Legislature hereby adopts the Montgomery County Vehicle Use and Mileage Reimbursement Policy as attached hereto.

I. Nature of Request:
This policy will provide guidance to Montgomery County employees relative to the procedures to follow in Montgomery County Vehicle Use and Mileage Reimbursement.
II. Justification:
The County needs update the previous policy for employees to follow in an effort to have a clear and consistent policy and procedure.
III. Legislative Impact:
Article 2, Section 2.04 of the Montgomery County Charter states that the Montgomery County Legislature shall be the legislative, appropriating and policy-determining body of the County.

WHEREAS, the Personnel Officer, in conjunction with Roemer Wallens Gold & Mineaux LLP, has recommended changes to the policy; and
RESOLVED, that the Montgomery County Legislature hereby adopts the Revised Montgomery County Discriminatory Harassment Prevention Policy and Complaint Procedure attached hereto and made part of this resolution.

The goal of the Discriminatory Harassment Prevention Policy and Complaint Procedure is to maintain a work environment which is free from unlawful discrimination. As such, revisions have been made to ensure that our Discriminatory Harassment Prevention Policy and Complaint Procedure contains all the required statutory updates and elements.
II. Justification:
It is the County’s policy to provide and maintain a work environment which is free from unlawful discrimination, harassment and retaliation in accordance will all applicable New York State, Federal and local laws.
III. Legislative Impact:
Article 2, Section 2.04 of the Montgomery County Charter states that the Montgomery County Legislature shall be the legislative, appropriating and policy-determining body of the County.

RESOLUTION NO. 209 of 2024 DATED: August 27, 2024 RECOMMENDATION: |
RESOLUTION ESTABLISHING A POLICY FOR THE REIMBURSEMENT OF MEALS (PERSONNEL)

WHEREAS, the Montgomery County Audit Guidelines established a procedure for the reimbursement of meals for the County: and
WHEREAS, Section §5.03 MEALS, does not set a financial standard reimbursement; and
WHEREAS, for the purpose of clarity and transparency, it is necessary to set a financial standard for those employees who are not represented by a collective bargaining agreement and/or for those whose collective bargaining agreement is silent on this matter; and
WHEREAS, to establish a set financial standard the Personnel Officer along with various other County Officials met to determine a standard and determined that the use of the United States General Services Administration (GSA) rate was most appropriate; and
THEREFORE LET IT BE RESOLVED; the Montgomery County Legislature hereby adopts the MEALS REIMBURSEMENT policy AFTER REVIEW FROM THE county ATTORNEY AS ATTACHED
RESOVLVED, that to the extent this policy conflicts with the Montgomery county audit guidelines, this policy shall supersede.

I. Nature of Request:
Resolution establishing a policy for the reimbursement of meals.
II. Justification:
There is not a current financial standard for reimbursement of meals for employee who are not represented by a collective bargaining agreement or where the CBA or Non-bargaining agreement is silent. This policy is put in place to set a clear standard.
III. Legislative Impact:
Authorized pursuant to Article 2 of the Montgomery County Charter.
IV. Financial Impact:
Standards will be set and clear. The impact with be determined as authorized travel and reimbursements are sought. The rate of the GSA will increase as the Federal standard increases much the same as the Mileage rate.
