RESOLUTION ADOPTING THE MONTGOMERY COUNTY COMPREHENSIVE EMERGENCY MANAGEMENT PLAN (CEMP) EMERGENCY MANAGEMENT

WHEREAS, the purpose of the CEMP is to develop a comprehensive emergency management program that will provide a system to mitigate the effects of an emergency or disaster, preserve life, respond during emergencies, provide necessary assistance, and establish a recovery system, in order to return the community to its normal state of affairs; and
WHEREAS, this plan attempts to clearly define the roles and responsibilities of each department and function within the Montgomery County organization by providing guidance in accomplishing the objectives of this plan with lists of guidelines, plans, assessments and resources; and
WHEREAS, certain State and Federal disaster reimbursements require local jurisdictions to adopt and train in a CEMP, NIMS and Incident Command Systems (ICS); and
WHEREAS, certain Federal grant programs now require an adopted CEMP; and WHEREAS, the County Executive and the Emergency Management Group (EMG) have reviewed the updated Comprehensive Emergency Management Plan with all of its attachments as periodically amended by the EMG, and recommends adoption by the County Legislature; and
WHEREAS, the Montgomery County Executive deems it in the best interest of Montgomery County to formally adopt this plan;
RESOLVED, the Montgomery County Legislature here by determines it is necessary and appropiate and in the best interest of County, Public safety and welfare to adopt the CEMP plan.

WHEREAS, there are unexpended SHSP2019 Grant funds available for carry-over; and
WHEREAS, funds from said grant monies are needed for computer equipment to provide staff with the most up to date technical equipment to do their jobs efficiently.
RESOLVED, that the Montgomery County Treasurer is hereby authorized and directed to amend the 2023 Operating Budget as follows:

RESOLUTION AUTHORIZING COUNTY EXECUTIVE TO SIGN NYS INDIGENT LEGAL SERVICES (ILS) CONTRACT: 4TH CAFA (PUBLIC DEFENDER)

WHEREAS, the Montgomery County Public Defender's Office has been advised by NYS ILS (Indigent Legal Services) that a grant has been awarded to the Public Defender's Office to improve the quality of services provided to indigents of Montgomery County; and
WHEREAS, the total amount of Grant:4th CAFA is $739,000, with a three-year distribution of $246,333 per year and;
WHEREAS, the funds can only be used for the Public Defender's Office as set forth within contract.
RESOLVED, that the Montgomery County Legislature hereby authorizes the County Executive, upon review and approval of the County Attorney, to accept and sign NYS ILS Grant: 4th CAFA, for $739,000 with a three-year distribution of $246,333 per year.

RESOLUTION AUTHORIZING THE COUNTY EXECUTIVE TO SIGN CONTRACT - DIVERSION MANAGEMENT, LLC (DISTRICT ATTORNEY)

WHEREAS, Local Law 5 of 2022 authorized the creation of a Traffic Diversion Program through the District Attorney's office to help with traffic tickets; and
WHEREAS, Diversion Management, LLC provides this specialized service for many counties in New York and is highly recommended; and
WHEREAS, the Montgomery County District Attorney requests that the County Executive be authorized, after review and approval by the County Attorney, to sign a contract with Diversion Management, LLC in order to ensure efficient, fair and uniform administrative processing of uniform traffic tickets and serve justice within Montgomery County through traffic diversion program for a term through March 31, 2028.
NOW THEREFOREFORE BE IT RESOLVED, that the County Executive is authorized and directed, after review and approval by the County Attorney, to sign a contract with Diversion Management, LLC in order to ensure efficient, fair and uniform administrative processing of uniform traffic tickets for a term through March 31, 2028.

Resolution authorizing County Executive to sign contract for traffic diversion management company.
II. Justification:
County adopted Introductory Law E (Local Law of 2022) by Resolution 260 of 2022 establishing traffic diversion program in Montgomery County to handle uniform traffic tickets.
III. Legislative Impact:
Pursuant to Article 3 of the Montgomery County Charger, the County Executive is authorized to sign contracts.
IV. Financial Impact:
There is no financial impact and no cost to the county.

RESOLUTION ESTABLISHING A MICROCOMPUTER TECHNICIAN AND ELIMINATING A NETWORK ENGINEER I IN THE DATA PROCESSING DEPARTMENT (DATA PROCESSING)

WHEREAS, there is an expected vacancy in the title of Network Engineer I due to an upcoming resignation; and
WHEREAS, after a review of the duties of the Network Engineer and further review of the needs of the County, the Director of Data Processing recommends eliminating Network Engineer I, Line 871 and re-establishing the title of Microcomputer line 17; and
WHEREAS, the title of Microcomputer Technician exists in the Data Processing budget however it has not been funded for the 2022 or 2023 budget years; and
WHEREAS, the title of Microcomputer Technician exists in the CSEA bargaining unit, established with a base salary of $43,947 (Grade H).
WHEREAS, the reclassification will be funded through existing funds. further, remaining funds in the Network Engineer I, Line 871 is to be used to fund a software update needed.
RESOLVED, the Montgomery County Legislature re-establishes the Microcomputer Technician position, with a base pay of $43,947 Grade H to perform the required technical duties in the County; and
RESOLVED, the position of Network Engineer I, Line 871 is hereby elminiated; and
FURTHER RESOLVED, the Montgomery County Treasurer is hereby authorized and directed to amend the 2023 Operating Budget as follows:

I. Nature of Request:
To re-establish the position of Microcomputer Technician (17) in Data Processing.
II. Justification:
Due to nature of Technician duties it has been determined this position is necessary to enhance the effective operation of the Data Processing Department.
III. Legislative Impact:
Pursuant to Article 2 of the Charter the Montgomery County Legislature has the authority to make appropriations and create positions of employment.
IV. Financial Impact:
No impact on current budget, a transfer of funds between established lines within the budget will accomplish this change.
