RESOLUTION AUTHORIZING COUNTY EXECUTIVE TO ENTER INTO AGREEMENTS - GENERATOR PLACEMENT AT 1 VENNER ROAD (PUBLIC WORKS)

WHEREAS, Montgomery County has purchased and is in the process of renovating property at 1 Venner Rd in Amsterdam, NY; and
WHEREAS, the facility will require a standby generator for emergency situations; and
WHEREAS, the Commission of Public Works, by RFP #15-22, solicited bids for generator placement and the following bids were opened and read aloud on December 13, 2022:
1. Stilsing Electric - Rensselaer, NY $289,900.00
2. Harold R Clune Electric - Ballston Spa, NY $298,700.00
WHEREAS, upon review and certification of proposals by C.T. Male Associates, it is recommended that the project be awarded to Stilsing Electric - Rensselaer, NY as the lowest responsible responsive bidder for an amount not to exceed $289,900.00.
RESOLVED, upon review and approval of the County Attorney, the County Executive is hereby authorized to sign contract with Stilsing Electric - Rensselaer, NY for a standby generator for an amount not to exceed $289,900.00.

I. Nature of Request:
To award contract for generator placement at Health & Human Service Facility at 1 Venner Rd in Amsterdam, NY
II. Justification:
The facility will require a standby generator for emergency situations
Bids were received and reviewed by engineer on record and has recommended contract be awarded to Stilsing Electric
III. Legislative Impact:
Pursuant to Article 3 of the County Charter, the County Executive has the authority to sign contracts.
IV. Financial Impact:
Total cost for generator placement are:
-Cost for 400kw generator: $148,237.00
-Cost for placement: $289,900.00
-Total: $438,137.00
Funds to complete generator project are allocated for in the project budget H-18-4-1620-45-2202

RESOLUTION AMENDING THE 2023 BUDGET - ENGINEERING SERVICES FOR COMMONS ROAD BRIDGE REHABILITATION (PUBLIC WORKS)

WHEREAS, Resolution #243 of 2022, amending the 2023 Operating Budget, was to allocate funds for an agreement with AECOM USA, Inc., for a sum not to exceed $257,000 for engineering services for the Commons Road Bridge repairs; and
WHEREAS, it is now necessary to transfer the funds in order to pay the balance due of $242,000 for said agreement to AECOM, USA, Inc..
RESOLVED, that the Montgomery County Legislature hereby authorizes and directs the County Treasurer to amend the 2023 Operating Budget as follows:

I. Nature of Request:
Funds need to be transferred in the 2023 Operating Budget in order to pay AECOM USA, Inc. for Engineering Services for the Commons Road Bridge rehabilitation.
II. Justification:
Funding was approved per Resolution #243 of 2022 for Engineering Services, and now need to be transferred in the 2023 Budget so payment can be made for services to be rendered.
III. Legislative Impact:
Pursuant to Article 2 of the Charter, the Montgomery County Legislature has the authority to make transfers and appropriations.
IV. Financial Impact:
As per Resolution #243 of 2022, funding for the remaining design and engineering services for Commons Road Bridge Rehabilitation would be allocated for in the 2023 Operating Budget by transferring from the Fund Balance or Capital Project bonding to Professional Services in the Public Works budget. Decision was made upon passing Resolution 243 of 2022 to complete project utilizing fund balance.
Further financial impacts will be realized once the project is released for bid.

RESOLUTION APPOINTING MEMBER TO THE MONTGOMERY COUNTY SANITARY DISTRICT NO.1 BOARD OF DIRECTORS

WHEREAS, Resolution 281 of 2013 states the Montgomery County Sanitary District No.1 Board of Directors shall consist of seven(7) members comprised of the current legislators representing Legislative Districts No.1, No.2, and No.3, the Mayors of the Villages of Fort Plain, Neliiston, and Palatine Bridge and one (1) member at large to be approved by the County Legislative Board, for a one year term; and
WHEREAS, the Montgomery County Sanitary District No.1 Board of Directors recommends appointing George Capece Jr as Member at Large for 2023.
RESOLVED, that George Capece Jr. is hereby appointed as the "at-large" member of the Board of Directors of the Montgomery County Sanitary District No.1 for a one year term ending on December 31, 2023.

WHEREAS, the Montgomery County Sanitary District No.1's current property, general liabilty, automobile, excess catastrophe, inland marine, and crime policies are set to expire January 1, 2023; and
WHEREAS, the Montgomery County Saniarty Dsitrict No.1 Board of Directors recommends binding insurance coverage for property, general liabilty, automobile, excess catastrophe, inland marine, and crime policies with NYMIR at a cost not to exceed $25,348.26; and
WHEREAS, NBT Mang Insurance - William Vangorder is named broker of record; and
WHEREAS, a transfer of funds is need to cover the cost of the premiums.
RESOLVED, upon review and aprroval of the County Attorney, the County Executive is hereby authorized and directed to sign a contract for the renewal of insurance coverage for property, general liabilty, automobile, excess catastrophe, inland marine, and crime policies with NYMIR for a term of January 1, 2023 to December 31, 2023 at an amount not to exceed $25,348.26.

WHEREAS, Montgomery County Sanitary District No.1 operates a wastewater treatment plant that generates digested sludge that needs treatment/disposal; and
WHEREAS, the Gloversville-Johnstown Joint Wastewater Treatment Facility is the owner and operator of wastewater treatment plant facilities which can be used to treat/dispose of said sludge; and
WHEREAS, the sludge disposal agreement is expected to be a benefit of Montgomery County and the Gloversville-Johnstown Joint Wastewater Treatment Facility; and
WHEREAS, the Gloversville-Johnstown Joint Wastewater Treatment Facility has approved of the sludge disposal agreement and has already executed the agreement.
RESOLVED, the Gloversville-Johnstown Joint Wastewater Treatment Facility will charge Montgomery County at the rate of $.055 per gallon for sludge hauled to the Gloversville-Johnstown Joint Wastewater Treatment Facility by Montgomery County;
FURTHER RESOLVED, the Gloversville-Johnstown Joint Wastewater Treatment Facility will charge Montgomery County for analytical testing, at a cost not to exceed $600 annually; and
NOW THEREFORE BE IT RESOLVED, the Montgomery County Legislature hereby authorizes and directs the County Executive, following the review and approval of the County Attorney, to execute said agreement for sludge treatment/disposal with the Gloversville-Johnstown Joint Wastewater Treatment Facility at the rate of $.055 per gallon for sludge for a term of January 1, 2023- December 31, 2024.

RESOLUTION AUTHORIZING COUNTY EXECUTIVE TO SIGN AN AGREEMENT BETWEEN THE GLOVERSVILLE-JOHNSTOWN JOINT WASTEWATER TREATMENT FACILITY AND THE MONTGOMERY COUNTY SANITARY DISTRICT NO.1 FOR SLUDGE TREATMENT/DISPOSAL.
II. Justification:
The Montgomery County Sanitary District No.1 generates sludge that requires disposal. The Gloversville-Johnstown Joint Wastewater Treatment Facility is capable of treating such sludge.
III. Legislative Impact:
Pursuant to General Municipal Law 119-o municipal corporations have the power to enter into agreements for the performance among themselves or one for the other respective functions, powers, and duties on the cooperative and contract basis. These agreements must be entered into by a majority strength of its governing body.
Pursuant to Article 3 of the Montgomery County Charter the County Executive has the authority to enter into contracts.
