WHEREAS, due to severe increases in supplies and fuel prices and costs of communication and technology equipment of 2022 funds have been depleted and appropriations need to be increased to operate through the end of this budget year.

NOW, THEREFORE, BE IT RESOLVED, that the Montgomery County Treasurer is directed to amend the 2022 Budget as follows:

Purusant to Article 2 of the Charter, the Montgomery County Legislature has the power to make appropriations.

RESOLUTION AUTHORIZING THE COUNTY EXECUTIVE TO EXECUTE A CHANGE ORDER WITH MAZONE PLUMBING AND HEATING, INC., PLUMBING CONTRACTOR FOR VENNER ROAD PROJECT (PUBLIC WORKS)

WHEREAS, by Resolution 69 of 2022, Montgomery County entered into an agreement with Mazone Plumbing and Heating, Inc., Plumbing Contractor, for plumbing renovation services at 1 Venner Road, Amsterdam, New York, for relocation of Health and Human Services offices; and

WHEREAS, due to circumstances out of the control of the contractor and Montgomery County, new plumbing service lines were needed to be installed to service bathrooms in the facility, which were not part of the original contract; and

WHEREAS, Mazone Plumbing and Heating, Inc., Plumbing Contractor for the project's contract needs to be increased by $10,887.77 to cover unforseen plumbing issues within the facility.

RESOLVED, Change Order #1 with Mazone Plumbing and Heating, Inc., Plumbing Contractor- contract is approved as follows:

ORIGINAL CONTRACT $151,937.00
CHANGE ORDER #1 $10,882.77
REVISED CONTRACT $162,819.77

FURTHER RESOLVED, that the Montgomery County Executive is authorized to sign amendment to contract upon review and approval of the County Attorney.

I. Nature of Request:

Authorizing the County Executive to execute Change Order #1 with Mazone Plumbing and Heating, Inc., Plumbing Contractor for the renovations at 1 Venner Road, Amsterdam, New York.


II. Justification:

Montgomery County is renovating a facility to relocate Health and Human Services Offices.  Underground plumbing mains are deteriorated and need replacement.


III. Legislative Impact:

Authorized pursuant to Article 2 of the Montgomery County Charter.


IV. Financial Impact:

Funds are already allocated for within the project budget..

No future change orders are foreseen with this contract.

RESOLUTION AUTHORIZING COUNTY EXECUTIVE TO SIGN INTERMUNICIPAL AGREEMENT FOR LEACHATE DISPOSAL WITH THE CITY OF AMSTERDAM (PUBLIC WORKS)

WHEREAS, Montgomery County has entered into an Intermunicipal Agreement with Schoharie and Otsego Counties for the purpose of landfill management; andWHEREAS, said agreement calls for Montgomery County to provide post closure services and bill the other counties; and

WHEREAS, the leachate generated by the landfills needs to be treated at a sewage plant, and the City of Amsterdam operates such plant; and

WHEREAS, the City of Amsterdam currently accepts the leachate generated by the landfills; and

WHEREAS, the current contract with the City of Amsterdam which sets forth the terms and provisions for the acceptance of the leachate generated by the landfills for treatement (hereinafter referred to as the "Leachate Agreement") has expired; and

WHEREAS, Montgomery County and the City of Amsterdam are municipal corporations; and

WHEREAS, Montgomery County and the City of Amsterdam will both benefit from the Leachate Agreement.

NOW, THEREFORE, BE IT RESOLVED, that the Montgomery County Legislature hereby authorizes and directs the County Executive, following review and approval of the County Attorney, to sign the Leachate Agreement, which is an intermunicipal agreement for leachate disposal, with the City of Amsterdam for a term of three years at the rate of .04 cents per gallon.

Statement of Legislative and Financial Impact:

I. Nature of Request:

Authorizing the County Executive to sign the Leachate Agreement with the City of Amsterdam.


II. Justification:

Montgomery County  has entered into an Intermunicipal Agreement with Schoharie and Otsego Counties for the purpose of landfill management, which requires Mongtomery County to provide post closure services and bill the other counties.  The contract currently in place to dispose of leachate for the landfills with the City of Amsterdam is expired and needs to be renewed or other arrangements made.


III. Legislative Impact:

Pursuant to General Municipal Law 119-o, municipal corporations have the power to enter into agreements for the performance among themselves or one for the other of their respective functions, powers and duties on a cooperative or contract basis.  Pursuant to Article 3 of the Charter, the Montgomery County Executive has the authority to enter into contracts.


IV. Financial Impact:

Costs are paid jointly by Otsego, Schoharie and Montgomery Counties, and have been included in the 2022 Operating Budget.

Annual total cost for 2021 was $111,905.50

WHEREAS, by Resolution 69 of 2022, Montgomery County entered into an agreement with West Winds General Construction, for renovation services at 1 Venner Road, Amsterdam, New York, for relocation of the Health and Human Services offices; and

WHEREAS, due to circumstances out of the control of the contractor and Montgomery County, new plumbing service lines are needed to be installed in the facility, and excavation is required, which was not part of the original contract; and

WHEREAS, West Winds General Construction, Contractor for the project's general constuction contract needs to be increased by $53,725.00 to cover unforseen plumbing issues within the facility.

RESOLVED, Change Order #1 with West Winds General Construction, Contractor- contract is approved as follows:
