WHEREAS, the Disaster Mitigation Act of 2000 requires that local governments have either a single-jurisdiction or a multi-jurisdiction all-hazard mitigation plan that has been approved by the Federal Emergency Management Agency (FEMA) to receive project funding from the Hazard Mitigation Grant Program; and
WHEREAS, the New York State Division of Homeland Security and Emergency Services has awarded a Planning Grant Application from Montgomery County and their jurisdictions to update the existing 2016 All-Hazard Mitigation Plan; and
WHEREAS, Montgomery County has been awarded an amount up to $80,000 to prepare an update to the 2016 Montgomery County Multi-Jurisdictional All-hazard Mitigation Plan; and
WHEREAS, Montgomery County per Resolution 199 of 2021 authorized the acceptance of said grant; and
WHEREAS, Montgomery County solicited proposals for professional services through the issuance of RFP #02-22; and
WHEREAS, after review of seven proposals, submitted in response to a Request For Proposals and interviews with two engineering firms, County staff recommends the firm of T&B Engineering and Landscape Architecture, P.C., a multidisciplinary engineering firm with offices in Rhinebeck, NY, to undertake the preparation of the Montgomery County Multi-Jurisdictional Multi-Hazard Mitigation Plan Update.
RESOLVED, the County Executive, upon review and approval of the County Attorney, is hereby authorized and directed to sign a contract in the amount not to exceed $80,000 with T&B Engineering and Landscape Architecture, P.C. to undertake the preparation of the Montgomery County Multi-Jurisdictional Multi-Hazard Mitigation Plan Update; and
FURTHER RESOLVED, the County Treasurer is hereby authorized and directed to amend the 2022 Operating Budget to receive and provide for grant funding to allow for Multi-Jurisdictional Multi-Hazard Mitigation Plan Update to proceed.

WHEREAS, Agriculture has a significant role in the County’s economy, protection of the environment, open space and beauty; and
WHEREAS, Montgomery County Established Farmland Protection Reserve Fund Account; and
WHEREAS, said account had a balance of $182,653 as of December 31, 2021; and
WHEREAS, Montgomery County hired Mohawk Hudson Land Conservancy in 2019 to assist the Montgomery County Soil and Water Conservation District with grant writing and administration associated with various farms that were interested in applying for Farmland Protection Grants; and
WHEREAS, said project is on-going through 2022;

WHEREAS, the New York State Department of State may designate Brownfield Opportunity Areas (BOA); and
WHEREAS, Montgomery County intends to submit a consolidated funding application for Brownfield Opportunity Area nomination planning funds to study Fort Plain and Nelliston as potential brownfield opportunity areas; and
WHEREAS, Fort Plain and Nelliston are connected by The River St. Bridge and share economic development interests; and
WHEREAS, BOA nomination planning funds would identify economic development opportunities and brownfield sites through the Brownfield Opportunity Area Program which may greatly benefit the community by bolstering redevelopment of a brownfield sites that have been vacant for many years; and
WHEREAS, program requirements include the provision to hold a public hearing on the grant application.
RESOLVED, that the County Legislature hereby schedules a Public Hearing on the Montgomery County Microenterprise grant to be held at 6:55 p.m., May 24, 2022 in the Chambers of the County Legislature, County Office Building, Fonda, New York; and
FURTHER RESOLVED, the Clerk of the Legislature is hereby authorized and directed to advertise said public hearing.

RESOLUTION AUTHORIZING EXPENDITURE OF BED TAX FUNDS TO PROMOTE TOURISM IN MONTGOMERY COUNTY (COUNTY LEGISLATURE)

WHEREAS, Local Law C of 2014 established a hotel and motel occupancy tax in Montgomery County (hereinafter "Bed Tax"); and
WHEREAS, revenue from the Bed Tax is to be used to enhance and develop the general economy of Montgomery County through the promotion of tourism, conventions, trade shows and other directly related and supported activities; and
WHEREAS, the Amsterdam Waterfront Foundation promotes tourism in Montgomery County and is seeking $5,000 for the Riverlink Summer Concert Series to enhance tourism in Montgomery County; and
WHEREAS, the Riverlink Summer Concert Series is comproised of weekly musical performances during July and August which has become an established cultural focal point in engaging community members and regional visitiors of all ages and interests; and
WHEREAS, over 5,000 people come to Riverlink Park each year to attend the Riverlink Summer Concert Series; and
WHEREAS, these activities are anticipated to promote tourism and enhance and develop the general economy of Montgomery County.
NOW THEREFORE BE IT RESOLVED that the Montgomery County Legislature authorizes and directs the Montgomery County Treasurer to disburse $5,000 to the Amsterdam Waterfront Foundation from the Bed Tax Contribution Tourism Line Item No.: A-01-4-1011-00-.4577; and
BE IT FURTHER RESOLVED, that the Amsterdam Waterfront Foundation's receipt of the $5,000 in funds shall be contingent upon the Amsterdam Waterfront Foundation entering into an Agreement and any other required paperwork with Montgomery County indicating that they will only spend funds for the Riverlink Summer Concert Series to promote tourism in Montgomery County; and
BE IT FURTHER RESOLVED, that the Montgomery County Executive is authorized and directed, upon review and approval of the County Attorney, to enter into a contract with the Amsterdam Waterfront Foundation outlining the above terms as a condition of acceptance of the $5,000; and

WHEREAS, County Route 20, Lepper Road, in the Town of Amsterdam has been identified by the Commissioner of Public Works as a local highway in need of major repair; and
WHEREAS, per Resolution 296 of 2019, Montgomery County procured the services of GPI, Albany, New York, to complete roadway drainage and widening design, and said design is now completed and ready for the construction bid phase; and
WHEREAS, easements are required for construction and future maintenance of culverts and/or catch basins, and per Highway Law 118, easements must be approved by the County Legislature; and

II. Justification:
Per Highway Law 118, easements must be approved by the legislature, which are necessary to enter upon private lands to complete construction.
County Route 20, Lepper Road, Town of Amsterdam, is in desperate need of drainage and highway improvements.
III. Legislative Impact:
Pursuant to Article 2 of the Montgomery County Charter, the Montgomery County Legislature has the authority to make any provisions for any matter in Montgomery County.
IV. Financial Impact:
Engineers estimate for construction is $700,000.00.
Project is being funded through CHIPS Program, which is 100% reimbursed to Montgomery County.

WHEREAS, by Resolution 224 of 2021, the Department of Public Works sold surplus equipment to another municipality totaling $15,000.00 in revenue; and
WHEREAS, revenue received totaling $112,170.00 was deposited as deferred revenue with the County Treasurer; and
WHEREAS, the Commissioner of Public Works is requesting said deferred revenue be added to the DM Fund, as the county has a need for vehicle and equipment replacement.

WHEREAS, upon the request of the Superintendent the Montgomery County Sanitary District No.1 the Board of Directors reviewed the duties and salary of the position; and
WHEREAS, the District Board recommends to further increase the base salary for the Superintendent; and
WHEREAS, a transfer of funds from the Districts' contingent account is needed to effectuate the salary increase.
RESOLVED, the Montgomery County Sanitary District No.1 Board of Directors recommends increasing the 2022 base salary of the Superintendent of the Montgomery County Sanitary District No.1 by $10,000.00;
RESOLVED, the increase in salary goes into effect upon approval of said resolution and will not be retroactive; and

WHEREAS, the County Historian has evaluated the responsibilities in the Department and has determined after conferring with the Personnel Officer that the duties being performed currently are substantially similar to that of a Records Management Clerk-PT and therefore warrant a reclassification; and

WHEREAS, Montgomery County has been working with Venesky Group,a consultant, that has affirmed that using $61,633.00 for purchasing a Side Access Testing Trailer with (3) 5 Gallon Provers, and (1) 100 Gallon Prover with Pump Off is an allowable use of American Rescue Plan Funds.
WHEREAS, the Director of Weights and Measures received notice that the current prover trailer will not be recalibrated by the New York State Lab and it is recommended that it be replaced; and
WHEREAS, the Director of Weights and Measures is recommending purchasing a Side Access Testing Trailer with (3) 5 Gallon Provers, and (1) 100 Gallon Prover with Pump Off at a price of $61,633.00; and
WHEREAS, the Director of Weights and Measures has 6 truck stops in Montgomery County which is 126 meters to test for all grades of gasoline , diesel , & DEF, 4 of the 6 truck stops have above ground tanks in which the product needs to be pumped back in; and
WHEREAS, the purchase of this equipment will be more efficient for the department and the store owner because with this new style trailer the Director can pull in and do all my testing at once then pull away and pump all product back into tanks and not have to shut dispensers down more than once; and
WHEREAS, the Legislature is advised that Seraphin, A Division of Pemberton Fabrications, Inc.; is the only manufacturer of this equipment.
NOW THEREFORE BE IT RESOLVED, that the Montgomery County Legislatiure authorizes the purchase is a Side Access Testing Teailer with (3) 5 Gallon Provers and (1) 100 gallon prover with pump off at a cost not to exceed $61,633.00 from Seraphin, A Division of Pemberton Fabrications, Inc.; and

WHEREAS, Montgomery County received American Rescue Plan funds; and
WHEREAS, some of the approved uses of American Rescue Plan funds by the federal government is under the standard allowance for government services; and
WHEREAS, Montgomery County has been working with Venesky Group, a consultant, that has affirmed that using $19,985 for a mobile app for the County Clerk's office is an allowable use of the American Rescue Plan funds.
RESOLVED, that the Montgomery County Legislature authorizes and directs that American Rescue Plan funds to the Montgomery County Clerk's office in the amount of $19,985 for a mobile app; and be it further
RESOLVED, that the County Executive is authorized and directed to execute a contract not to exceed $19,985 with an annual service fee of $6,995 for a term of five years with Info Quick Solutions, Inc.(IQS); and
BE IT FURTHER RESOLVED, that the Montgomery County Treasurer is hereby authorized and directed to amend the 2022 Operating Budget as follows:

WHEREAS, Montgomery County received American Rescue Plan funds; and
WHEREAS, one of the the approved uses of American Rescue Plan funds by the federal government is under the standard allowance for government services; and
WHEREAS, the County Clerk seeks to digitize records to allow for better access by the public of County records and increase productivity if there is another pandemic; and
WHEREAS, IQS is the county's current vendor and due to the nature of propietary software would need to be the one awarded the scanning contract to ensure the documents are accessible by their system; and
WHEREAS, Montgomery County has been working with Venesky Group, a consultant, that has affirmed that using $202,160 for the digitization of records in the County Clerk's office is an allowable use of the American Rescue Plan funds; and now, therefore be it
RESOLVED, that the Montgomery County Legislature authorizes and directs that American Rescue Plan funds be used by the Montgomery County Clerk's Office in the amount of $202,160 for the digitization of records; and be it further
RESOLVED, that the Montgomery County Executive is authorized and directed, upon review and approval of the County Attorney, to enter into a contract for a term of eighteen months with IQS at an amount not to exceed $202,160 for the digitization of records; and
BE IT FURTHER RESOLVED, that the Montgomery County Treasurer is hereby authorized and directed to amend the 2022 Operating Budget as follows:

RESOLUTION AUTHORIZING USE OF $1,152,000 OF AMERICAN RESCUE PLAN FUNDS TO REPLACE HVAC EQUIPMENT AT PUBLIC SAFETY FACILITY (COUNTY LEGISLATURE)

WHEREAS, Montgomery County received American Rescue Plan funds; and
WHEREAS, one of the the approved uses of American Rescue Plan funds by the federal government is under the standard allowance for government services; and
WHEREAS, the Montgomery County Public Safety Facility is a 24-hour, 365 day a year facility, which was built in 1995; and
WHEREAS, the HVAC units, which provide coverage to the correctional pods, are original to the facility; and
WHEREAS, replacement parts are becoming harder to obtain; and
WHEREAS, the Commissioner of Public Works has deemed the HVAC equipment, which maintains the correctional pods, in need of replacement; and
WHEREAS, the Commissioner of Public Works has obtained pricing for replacement of said units with Johnson Controls under Sourcewell Contract #070121-JHN; and
WHEREAS, Montgomery County has been working with Venesky Group, a consultant, that has affirmed that using $1,152,000.00 for the HVAC Equipment Replacement at the Montgomery County Public Safety Facility is an allowable use of the American Rescue Plan funds;
RESOLVED, the Montgomery County Legislature hereby awards the HVAC Equipment Replacement at the Montgomery County Public Safety Facility to Johnson Controls of Clifton Park, New York, for a total of three (3) roof-top units, to be a turn-key replacement to install said units for a cost not to exceed $1,152,000.00; and
FURTHER RESOLVED, the County Executive is hereby authorized, upon review and approval of the County Attorney, to sign Sourcewell Contract #070121-JHN with Johnson Controls for HVAC equipment replacement; and
BE IT FURTHER RESOLVED, that the Montgomery County Treasurer is hereby authorized and directed to amend the 2022 Operating Budget as follows:

Pursuant to Article 2 of the Montgomery County Charter, the Legislature has the authority to approve contracts.

It is anticipated that funds will be used from the COVID Relief Fund.

WHEREAS, Montgomery County received American Rescue Plan funds; and
WHEREAS, the Ayres Memorial Animal Shelter needs funding to update their facilities; and
WHEREAS, the Ayres Memorial Animal Shelter has contracts with towns in the Western portion of Montgomery County to house stray animals, providing a valuable service; and
WHEREAS, Montgomery County has been working with Venesky Group,a consultant, that has affirmed that a grant to the Ayres Memorial Animal Shelter to update their facilities is an allowable use of American Rescue Plan Funds.
NOW THEREFORE BE IT RESOLVED, that the Montgomery County Legislature authorizes and directs that a grant of $190,000 be awarded to the Ayres Memorial Animal Shelter to update their facilities; and
BE IT FURTHER RESOLVED, that the Montgomery County Executive is authorized and directed to execute any necessary grant documents to implement this resolution; and
BE IT FURTHER RESOLVED, that the Montgomery County Treasurer is hereby authorized and directed to amend the 2022 Operating Budget as follows:
