Chairman Daniel P. Wilson has called a meeting of the Physical Services Committee for 6:03 p.m. on Tuesday, April 19, 2022 in the Legislative Chambers, County Office Building, 64 Broadway, Fonda, New York.

RESOLUTION AUTHORIZING THE COUNTY EXECUTIVE TO SIGN EASEMENT AGREEMENTS, ROAD WIDENING PROJECT, COUNTY ROUTE 20, LEPPER ROAD, TOWN OF AMSTERDAM (PUBLIC WORKS)

WHEREAS, County Route 20, Lepper Road, in the Town of Amsterdam has been identified by the Commissioner of Public Works as a local highway in need of major repair; and

WHEREAS, per Resolution 296 of 2019, Montgomery County procured the services of GPI, Albany, New York, to complete roadway drainage and widening design, and said design is now completed and ready for the construction bid phase; and

WHEREAS, easements are required for construction and future maintenance of culverts and/or catch basins, and per Highway Law 118, easements must be approved by the County Legislature; and

WHEREAS, the following easements at the following properties are required for construction and future maintenance of culverts and highway drainage structures:

  1.  Donald A and Diane H Phillips, 377 Lepper Road, Town of Amsterdam: SBL# 24.-1-1

  2.  Joshua Belfance and Benjamin Misekis, 393 Lepper Road, Town of Amsterdam: SBL# 24.-1-72

  3.  William S Jr. and Yvonne M Grzyb, 415 Lepper Road, Town of Amsterdam: SBL# 24.-1-70.2

  4.  Michael J and Dana Opalka, 473 Lepper Road, Town of Amsterdam:  SBL# 24.-1-70.1

  5.  Michael J and Dana Opalka, 473 Lepper Road, Town of Amsterdam:  SBL# 23.-2-9.11

  6.  Suzanne M Paro, 460 Lepper Road, Town of Amsterdam:  SBL# 23.-2-9.2, and

WHEREAS, the aforementioned property owners owning property adjacent to the road widening project, have agreed to provide Montgomery County with easements for a one-time fee of One Dollar ($1.00).

RESOLVED, the Montgomery County Executive, upon review and approval of the Montgomery County Attorney, is hereby authorized to accept and sign the aforementioned easement agreements, and any and all other associated documents.

Statement of Legislative and Financial Impact:

I. Nature of Request:

To obtain easements on a section of Montgomery County Highway to improve drainage and county highway.


II. Justification:

Per Highway Law 118, easements must be approved by the legislature, which are necessary to enter upon private lands to complete construction.

County Route 20, Lepper Road, Town of Amsterdam, is in desperate need of drainage and highway improvements.


III. Legislative Impact:

Pursuant to Article 2 of the Montgomery County Charter, the Montgomery County Legislature has the authority to make any provisions for any matter in Montgomery County.


IV. Financial Impact:

Engineers estimate for construction is $700,000.00.

Project is being funded through CHIPS Program, which is 100% reimbursed to Montgomery County.

RESOLUTION AMENDING 2022 OPERATING BUDGET, SURPLUS EQUIPMENT AUCTION (PUBLIC WORKS)

WHEREAS, by Resolution 223 of 2021, the Department of Public Works held the county's annual Surplus Equipment Auction, raising $97,170.00 in revenues; and

WHEREAS, by Resolution 224 of 2021, the Department of Public Works sold surplus equipment to another municipality totaling $15,000.00 in revenue; and

WHEREAS, revenue received totaling $112,170.00 was deposited as deferred revenue with the County Treasurer; and

WHEREAS, the Commissioner of Public Works is requesting said deferred revenue be added to the DM Fund, as the county has a need for vehicle and equipment replacement.

RESOLVED, the County Treasurer is hereby authorized and directed to amend the 2022 Operating Budget as follows:

INCREASE REVENUES:

INCREASE APPROPRIATIONS:

Statement of Legislative and Financial Impact:

I. Nature of Request:

Amend the 2022 Operating Budget from Surplus Equipment Auction


II. Justification:

Equipment sold in the fall of 2021 auction was that of the Department of Public Works, and funds were deferred to be deposited in the 2022 Operating Budget year as there is a need to replace equipment.


III. Legislative Impact:

Pursuant to Article 2 of the Mongtomery County Charter, the Legislature has the power to make appropriations.


IV. Financial Impact:

Increase of revenue is from the sale of surplus equipment and will be used to replace said equipment.

RESOLUTION ADOPTING A NEW BASE SALARY FOR THE SUPERINTENDENT OF THE MONTGOMERY COUNTY SANITARY DISTRICT NO.1 AND AMENDING THE 2022 OPERATING BUDGET (SANITARY DISTRICT NO. 1)

WHEREAS, upon the request of the Superintendent the Montgomery County Sanitary District No.1 the Board of Directors reviewed the duties and salary of the position; and

WHEREAS, the District Board recommends to further increase the base salary for the Superintendent; and

WHEREAS, a transfer of funds from the Districts' contingent account is needed to effectuate the salary increase.

RESOLVED, the Montgomery County Sanitary District No.1 Board of Directors recommends increasing the 2022 base salary of the Superintendent of the Montgomery County Sanitary District No.1 by $10,000.00;

RESOLVED, the increase in salary goes into effect upon approval of said resolution and will not be retroactive; and

FURTHER RESOLVED, the County Treasurer is hereby authorized and directed to amend the 2022 Operating Budget as follows:

FURTHER RESOLVED, the new 2022 Base Salary for the Superintendent of the District shall be $76,403.00.

Resolution increasing the base salary of the Montgomery County Sanitary District No.1 Superintendent.


II. Justification:

Based on the duties and responsibilities of the District Superintendent an increase in salary is warranted.


III. Legislative Impact:

Pursuant to Article 3 of the Mongomery County Charter the Legislature has the authority to approve budget transfers.


IV. Financial Impact:

Transfer of funds included in resolution
