RESOLUTION AUTHORIZING COUNTY EXECUTIVE TO SIGN CONTRACT WITH T&B ENGINEERING AND LANDSCAPE ARCHITECTURE, P.C. TO UNDERTAKE PREPARATION OF A MONTGOMERY COUNTY MULTI-JURISDICTIONAL MULTI-HAZARD MITIGATION PLAN UPDATE (ECONOMIC DEVELOPMENT AND PLANNING)

WHEREAS, the Disaster Mitigation Act of 2000 requires that local governments have either a single-jurisdiction or a multi-jurisdiction all-hazard mitigation plan that has been approved by the Federal Emergency Management Agency (FEMA) to receive project funding from the Hazard Mitigation Grant Program; and
 
WHEREAS, the New York State Division of Homeland Security and Emergency Services has awarded a Planning Grant Application from Montgomery County and their jurisdictions to update the existing 2016 All-Hazard Mitigation Plan; and  

WHEREAS, Montgomery County has been awarded an amount up to $80,000 to prepare an update to the 2016 Montgomery County Multi-Jurisdictional All-hazard Mitigation Plan; and 

WHEREAS, Montgomery County per Resolution 199 of 2021 authorized the acceptance of said grant; and 

WHEREAS, Montgomery County solicited proposals for professional services through the issuance of RFP #02-22; and 

WHEREAS, after review of seven proposals, submitted in response to a Request For Proposals and interviews with two engineering firms, County staff recommends the firm of T&B Engineering and Landscape Architecture, P.C., a multidisciplinary engineering firm with offices in Rhinebeck, NY, to undertake the preparation of the Montgomery County Multi-Jurisdictional Multi-Hazard Mitigation Plan Update.  

RESOLVED, the County Executive, upon review and approval of the County Attorney, is hereby authorized and directed to sign a contract in the amount not to exceed $80,000 with T&B Engineering and Landscape Architecture, P.C. to undertake the preparation of the Montgomery County Multi-Jurisdictional Multi-Hazard Mitigation Plan Update; and 

FURTHER RESOLVED,  the County Treasurer is hereby authorized and directed to amend the 2022 Operating Budget to receive and provide for grant funding to allow for Multi-Jurisdictional Multi-Hazard Mitigation Plan Update to proceed.

Statement of Legislative and Financial Impact:

I. Nature of Request:

Resolution authorizes County Executive to sign contract to update the Multi Jurisdictional All Hazard Mitigation Plan


II. Justification:

Resolution is necessary to hire firm to prepare updated plan.


III. Legislative Impact:

Pursuant to Section 3.02(g) of the Montgomery County Charter, the County Executive can make, sign and implement all contracts on behalf of the County within the authorized appropriations. Also authorized pursuant to the Montgomery County Procurement Policy.


IV. Financial Impact:

Grant covers $60,000 of the $80,000 contract.  Resolution 199 of 2021 authorized cash/in kind match.  $20,000 would need to come from Contigency Account or Fund Balance.

RESOLUTION AMENDING THE 2022 OPERATING BUDGET FARMLAND PROTECTION (ECONOMIC DEVELOPMENT AND PLANNING)

WHEREAS, Agriculture has a significant role in the County’s economy, protection of the environment, open space and beauty; and

WHEREAS, Montgomery County Established Farmland Protection Reserve Fund Account; and

WHEREAS, said account had a balance of $182,653 as of December 31, 2021; and

WHEREAS, Montgomery County hired  Mohawk Hudson Land Conservancy in 2019 to assist the Montgomery County Soil and Water Conservation District with grant writing and administration associated with various farms that were interested in applying for Farmland Protection Grants; and

WHEREAS, said project is on-going through 2022;

FURTHER RESOLVED, that the County Executive is authorized to sign a contract amendment up to $13,000 with the Mohawk Land Conservancy,  upon review and approval by the County Attorney, in association with said program; and

FURTHER RESOLVED, that the County Treasurer is hereby authorized and directed to amend the 2022 Operating Budget as follows:

Statement of Legislative and Financial Impact:

I. Nature of Request:

Resolution amends 2022 operating budget for the on-going Farmland Protection Grant program.


II. Justification:

Farmland Protection grant process is on-going.


III. Legislative Impact:

Pursuant to Article 2 of the Charter, the Montgomery County Legislature has the power to make appropriations.


IV. Financial Impact:

Resolution is budget neutral in that it transfers funds from the already established Farmland Protection Fund which is a reserve account.

RESOLUTION SCHEDULING PUBLIC HEARING FOR INTENT TO APPLY FOR BROWNFIELD OPPORTUNITY AREA (BOA) NOMINATION PLANNING FUNDS FOR A FORT PLAIN / NELLISTON BOA (ECONOMIC DEVELOPMENT)

WHEREAS, the New York State Department of State may designate Brownfield Opportunity Areas (BOA)and

WHEREAS, Montgomery County intends to submit a consolidated funding application for Brownfield Opportunity Area nomination planning funds to study Fort Plain and Nelliston as potential brownfield opportunity areas; and

WHEREAS, Fort Plain and Nelliston are connected by The River St. Bridge and share economic development interests; and

WHEREAS, BOA nomination planning funds would identify economic development opportunities and brownfield sites through the Brownfield Opportunity Area Program which may greatly benefit the community by bolstering redevelopment of a brownfield sites that have been vacant for many years; and

WHEREAS, program requirements include the provision to hold a public hearing on the grant application.

RESOLVED, that the County Legislature hereby schedules a Public Hearing on the Montgomery County Microenterprise grant to be held at 6:55 p.m., May 24, 2022 in the Chambers of the County Legislature, County Office Building, Fonda, New York; and

FURTHER RESOLVED, the Clerk of the Legislature is hereby authorized and directed to advertise said public hearing.

To schedule a public hearing to submit a consolidated funding application for Brownfield Opportunity Area nomination planning funds to study Fort Plain and Nelliston as potential brownfield opportunity areas 


II. Justification:

Through the BOA Program, brownsfields are transformed from liabilities to community assets that have the potential to develop businesses, jobs and new revenues for local economies and provide new housing and public amenities.


III. Legislative Impact:

Authorized pursuant to Article 2 of the Montgomery County Charter.

RESOLUTION AUTHORIZING EXPENDITURE OF BED TAX FUNDS TO PROMOTE TOURISM IN MONTGOMERY COUNTY (COUNTY LEGISLATURE)

WHEREAS, Local Law C of 2014 established a hotel and motel occupancy tax in Montgomery County (hereinafter "Bed Tax"); and

WHEREAS, revenue from the Bed Tax is to be used to enhance and develop the general economy of Montgomery County through the promotion of tourism, conventions, trade shows and other directly related and supported activities; and

WHEREAS, the Amsterdam Waterfront Foundation promotes tourism in Montgomery County and is seeking $5,000 for the Riverlink Summer Concert Series to enhance tourism in Montgomery County; and

WHEREAS, the Riverlink Summer Concert Series is comproised of weekly musical performances during July and August which has become an established cultural focal point in engaging community members and regional visitiors of all ages and interests; and

WHEREAS, over 5,000 people come to Riverlink Park each year to attend the Riverlink Summer Concert Series; and

WHEREAS, these activities are anticipated to promote tourism and enhance and develop the general economy of Montgomery County. 

NOW THEREFORE BE IT RESOLVED that the Montgomery County Legislature authorizes and directs the Montgomery County Treasurer to disburse $5,000 to the Amsterdam Waterfront Foundation from the Bed Tax Contribution Tourism Line Item  No.: A-01-4-1011-00-.4577; and 

BE IT FURTHER RESOLVED, that the Amsterdam Waterfront Foundation's  receipt of the $5,000 in funds shall be contingent upon the Amsterdam Waterfront Foundation entering into an Agreement and any other required paperwork with Montgomery County indicating that they will only spend funds for the Riverlink Summer Concert Series to promote tourism in Montgomery County; and

BE IT FURTHER RESOLVED, that the Montgomery County Executive is authorized and directed, upon review and approval of the County Attorney, to enter into a contract with the Amsterdam Waterfront Foundation outlining the above terms as a condition of acceptance of the $5,000; and

BE IT FURTHER RESOLVED, that the County Treasurer is hereby authorized and directed to amend the 2022 Operating Budget as follows:

INCREASE:     
A-5-11  Appropriated Reserve - Bed Tax $5,000
     
INCREASE APPROPRIATIONS:    
A-01-4-1011-00-.4577  Bed Tax Contribution - Tourism $5,000

Local Law C of 2014 authorized the use of Bed Tax funds to promote tourism related activities in Montgomery County.

Use of $5,000 of bed tax money.
