RESOLUTION AMENDING 2022 OPERATING BUDGET - 2021-2022 SNOWMOBILE TRAILS GRANT-IN-AID PROGRAM (ECONOMIC DEVELOPMENT AND PLANNING)

WHEREAS, the New York State Office of Parks, Recreation and Historic Preservation has awarded Montgomery County $66,240 from the 2021-2022 Snowmobile Trails Grant-In-Aid Program, based upon an application submitted in cooperation with the Mohawk Valley Snowmobile Clubs; Inc.

RESOLVED, that the Montgomery County Legislature hereby authorizes the County Executive, following review and approval by the County Attorney, to enter into a contract with the Mohawk Valley Snowmobile Clubs, Inc. for the amound of $66,240 for the period of November 1, 2021 through October 31,2022 and to execute all documents associated with this grant.

FURTHER RESOLVED, the County Treasurer is hereby authorized and directed to amend the 2022 Operating Budget as follows:

Statement of Legislative and Financial Impact:

I. Nature of Request:

This resolution will amend the 2022 operating budget to reflect the grant award amount through the New York State Snowmobile Trails Grant-In-Aid Program.


II. Justification:

This will allow the County to receive and appropriate the grant awarded funds to the Mohawk Valley Snowmobile Clubs, Inc.


III. Legislative Impact:

Pursuant to Article 2 of the Charter the Montgomery County Legislature has the power to make appropriations .Pursuant to Article 3 of the Charter the Montgomery County Executive has the authority to sign contracts.


IV. Financial Impact:

Resolution is budget neutral as revenues from the grant will offset the appropriations.

RESOLUTION AUTHORIZING COUNTY EXECUTIVE TO SIGN AMENDED AGREEMENT WITH LIRO ENGINEERS, INC. FOR ENGINEERING SERVICES-EXIT 29 REDEVELOPMENT PROJECT (ECONOMIC DEVELOPMENT/PLANNING)

WHEREAS, the Village of Canajoharie and Montgomery County have an interest in revitalizing urban areas and stabilizing neighborhoods; and

WHEREAS, the Village of Canajoharie was awarded a total of $6,500,000 in Restore NY Communities grant funds for the purpose of revitalizing the Exit 29 site in which the County is owner to; and

WHEREAS, in order to carry out said tasks and goals associated with the awarded funds the County solicited RFQ 02-18 Engineering For Former Beech-Nut Plant Demolition/Rehabilitation and responses were received; and

WHEREAS, Resolution #153 of 2018 awarded the contract to LiRo Engineers, Inc. at a cost not to exceed $475,000 and Resolutions #200 of 2019,  #93 of 2020 and 197 of 2021 amended the contract at cost not to exceed $727,000; and

WHEREAS, demolition design, bid and construction oversight is necessary for continued abatement and demolition of the western side of the Exit 29 Redevelopment site; and

WHEREAS, Part VI (C) (j) of the Montgomery County Procurement Policy allows the continuation of professional services for existing projects that require the continuity of the professional services to ensure proper completion of the project.

RESOLVED, the Montgomery County Legislature hereby authorizes an amendment to the contract for a total cost not to exceed $750,000; and

FURTHER RESOLVED, that the County Executive, upon review and approval of the County Attorney, is hereby authorized and directed to sign the aforementioned contract.

I. Nature of Request:

AUTHORIZING COUNTY EXECUTIVE TO SIGN AMENDED AGREEMENT WITH LIRO ENGINEERS, INC. FOR ENGINEERING SERVICES-EXIT 29 REDEVELOPMENT PROJECT


II. Justification:

Professional engineering services for this project is necessary for continued abatement and demolition oversight services on the western side of Exit 29.


III. Legislative Impact:

Pursuant to Section 3.02(g) of the Montgomery County Charter, the County Executive can make, sign and implement all contracts on behalf of the County within the authorized appropriations. Also authorized pursuant to the Montgomery County Procurement Policy.


IV. Financial Impact:

Resolution #120 of 2018 and Resolution #264 of 2019 authorized issuance of $6,000,000 in serial bonds for this project.

RESOLUTION AUTHORIZING COUNTY EXECUTIVE TO SIGN CONTRACT WITH HOMETOWN HEALTH CENTERS- SEXUALLY TRANSMISSIBLE DISEASE SERVICES (PUBLIC HEALTH)

WHEREAS, Article 23 of Public Health Law Section 2304 mandates the County to provide adequate facilities for the free diagnosis and treatment of persons living within its jurisdiction who are suspected of being infected or are infected with a sexually transmissible disease; and

WHEREAS, Hometown Health Centers has agreed to provide said professional services to said population; and

WHEREAS, the Public Health Director has recommended a 3 year contract January 1, 2022 - December 31, 2025 for Sexual Transmissible Disease Services.

RESOLVED, that the Montgomery County Legislature hereby authorizes acceptance of the Hometown Health Centers Sexually Transmissible Disease Services contract; and

FURTHER RESOLVED, that the County Executive, following review and approval by the County Attorney, hereby is authorized to sign a 5 year contract, January 1, 2022 - December 31, 2025 for Sexually Transmissible Disease Services at an amount not to exceed $5k a year.

I. Nature of Request:

AUTHORIZING COUNTY EXECUTIVE TO SIGN CONTRACT WITH HOMETOWN HEALTH CENTERS = SEXUALLY TRANSMISSIBLE DISEASE SERVICES.


II. Justification:

Article 23 of Public Health Law Section 2304 mandates the County to pay for sexually transmissible disease services for persons living within its jurisdiction.


III. Legislative Impact:

Pursuant to Article 3 of the Charter it is the duty of the Legislators to review such contracts and agree to allow services in the County.


IV. Financial Impact:

Funds included in each years budget to cover sexually transmissible disease services and reimburseable under NYSDOH Article 6 State Aid.

RESOLUTION ACCEPTING CHILDHOOD LEAD POISONING PREVENTION PROGRAM+ GRANT FUNDING AND AMENDING THE 2022 OPERATING BUDGET (PUBLIC HEALTH)

WHEREAS, Montgomery County Public Health is awarded here forward the Childhood Lead Poisoning Prevention Program+ Grant funds not to exceed $283,300 annually for the period commencing October 1, 2021 and ending September 30, 2026, and

WHEREAS, the Childhood Lead Poisoning Prevention Program+ grant funds are appropriated in the current operating budget, and

WHEREAS, the New York State Department of Health has increased the funding for the 2021-26 grant period,

RESOLVED, that the Montgomery County Legislature hereby authorizes acceptance of the Childhood Lead Poisoning Prevention Program+ Grant funds annually, including this increase for the 2021-2022 budget period, and

FURTHER RESOLVED, the County Executive is authorized and directed, upon review and approval of the County Attorney, to sign any necessary documents connected to this increase; and

RESOLUTION AUTHORIZING THE COUNTY EXECUTIVE TO ENTER INTO AN AGREEMENT - GRASS AND BRUSH CONTROL ON COUNTY ROADS FOR 2022-2023 (PUBLIC WORKS)

WHEREAS, Montgomery County contracts for grass and brush control with the ten towns, the City of Amsterdam, and the Village of St. Johnsville on county roads; and

WHEREAS, the current contract is due to expire for such services and there is a need to renew the contract for Grass and Brush Control on County Roads;

RESOLVED, pursuant to Section 135 a of the Highway Law, Montgomery County Legislature hereby authorizes and directs the County Executive, upon review by the County Attorney, to enter into agreements with the ten towns located within Montgomery County; the City of Amsterdam and the Village of St. Johnsville for provision of grass and brush control on county roads; and

FURTHER RESOLVED, payment for work to be performed under the terms of said agreement for grass and brush control shall be at a rate of $400.00 per center line miles for the contract year June 1, 2022, through May 31, 2023, at a total cost of $157,912.00 to the County Road Fund.

Statement of Legislative and Financial Impact:

I. Nature of Request:

For authorization allowing the County Executive to enter into contracts with the ten towns, the City of Amsterdam and Village of St. Johnsville, for the purpose of grass and brush control on 398.4 miles of county roads for the period of one year- June 1, 2022, through May 31, 2023.


II. Justification:

The current contract with the ten towns, the City of Amsterdam and the Village of St. Johnsville is due to expire.

There is a need for grass and brush control on county roads for maintenance and safety reasons.


III. Legislative Impact:

Pursuant to Article 3 of the Montgomery County Charter, the County Executive has the authority to enter into contracts.


IV. Financial Impact:

Appropriations for the contract are included in the 2022 Operating Budget.  This is not an increase from previous contract.

WHEREAS, through Montgomery County's membership with the New York State Association of Counties (NYSAC) and the New York State Association of County Clerks (NYSACC) New York's Counties have come together to collectively support Organ and Tissue Donation Month in New York State; and

WHEREAS, currently, nearly 106,000 men, women, and children are awaiting organ transplants in the United States; and

WHEREAS, organ, tissue, marrow and blood donation are live-giving acts recognized worldwide as expressions of compassion to those in need; and

WHEREAS, in New York State there are approximately 10,000 people waiting for an organ transplant, the third-highest in the nation; and there is an estimated 500 New Yorkers that die every year waiting for an organ transplant; and

WHEREAS, New York State's county governments play a key role in raising awareness of the need of organ and tissue donation; and

WHEREAS, counties across the State of New York are proclaiming the month of April 2022 as "Organ and Tissue Donation Awareness Month", and are engaging in various activities designed to promote an increase in the number of registered organ donors; and

WHEREAS, the Montgomery County Legislature and the Montgomery County Clerk's Office, through its Department of Motor Vehicles, wish to designate the month of April 2022 as "Organ and Tissue Donation Awareness Month" in Montgomery County; and now, therefore be it

RESOLVED, that the Montgomery County Legislature hereby proclaims the month of April 2022 as "Organ and Tissue Donation Awareness Month" in Montgomery County; and be it further

WHEREAS, representatives from Fulton-Montgomery Community College and the Educational Support Personnel (ESP) have negotiated an employment agreement between the Fulton-Montgomery Community College, Fulton County, Montgomery County and the Educational Support Personnel which expires in August 31, 2022; and 

WHEREAS, representatives from the Fulton-Montgomery Community College and the Educational Support Personnel after discussion have agreed to extend the terms and conditions of the current Negotiated Agreement for a period of one year commencing from September 1, 2022 through August 31, 2023; and 

WHEREAS, all terms and conditions of the current Negotiated Agreement shall continue in full force and effect during the extension period; and

WHEREAS, Fulton-Montgomery Community College has recommended that Fulton County enter into a Memorandum of Agreement by and between the Fulton-Montgomery Community College, Fulton County, Montgomery County and the Educational Support Personnel extending the terms of the current Agreement until August 31, 2023; and

NOW, IT IS THEREEFORE RESOLVED, that the Fulton County Board of Supervisors authorizes and directs the President of Fulton-Montgomery Community College to sign a Memorandum of Agreement by and between the Fulton-Montgomery Community College, Fulton County, Montgomery County and the Educational Support Personnel extending the terms of the current Agreement effective September 1, 2022 through August 31, 2023; and, be it further 

RESOLVED, that said agreement is contingent upon adoption of a similar Resolution by the Montgomery County Legislature.

RECOMMENDATION:
     

RESOLUTION AUTHORIZING THE COUNTY EXECUTIVE TO EXECUTE AN AGREEMENT WITH JMZ ARCHITECTS & PLANNERS TO UPDATE EXISTING DESIGN PLANS AND BID SPECIFICATIONS FOR THE FMCC SCIENCE LABS AND CLASSROOMS PHASE 3 PROJECT

WHEREAS, the FMCC Campus Labs and Classrooms Building Renovation Project was intended to be a sequential three (3) phased project as identified within Fulton County’s 2018-2020 Capital Plan, and 

WHEREAS, the first two (2) phases were completed in 2018 and 2019 respectively, and 

WHEREAS, due to the onset of the COVID-19 Pandemic, Phase 3 of the sequential three-phased project abruptly stopped once FMCC was notified by the SUNY Office of Capital Facilities that New York State would no longer support the project due to reappropriating State dollars toward more immediate health and safety related projects, and 

WHEREAS, the initial Phase 3 project had been designed, successfully bid and all contracts had been executed, and 

WHEREAS, Fulton County’s 2022 Capital Plans includes a $1,000,000 appropriation for the FMCC Science Labs and Classrooms Phase 3 Project, and 

WHEREAS, funding for the project will be from:

 

SUNY                                 :           $   750,000

Fulton County                    :           $   250,000

Montgomery County         :           $   250,000

Total                                  :           $1,000,000

 

And 

WHEREAS, FMCC received a proposal from JMZ Architects & Planners, P.C. to perform an update to the previous bid specifications and to provide procurement and Construction Administration services as follows:

 

Phase 3:

Construction Documents Update Phase                :           $21,050.00

Procurement Phase                                             :           $ 4,500.00

Construction Administration Phase                      :           $38,550.00

Supplemental Services Fee                                   :           $ 3,150.00

Reimbursable Expenses                                        :           $ 2,000.00

Total Compensation                                            :           $69,250.00

WHEREAS, FMCC is recommending that the Chairman execute an agreement with JMZ Architects & Planners, P.C. for services identified in support of the FMCC Science Labs and Classrooms Phase 3 Project.

RESOLUTION GRANTING $250,000 OF AMERICAN RESCUE PLAN FUNDS TO THE MONTGOMERY COUNTY SPCA FOR HVAC IMPROVEMENTS (COUNTY LEGISLATURE)

WHEREAS, Montgomery County received American Rescue Plan funds; and

WHEREAS, one of the approved uses of American Rescue Plan funds by the federal governemnt was for grants for HVAC improvements; and

WHEREAS, the Montgomery County SPCA needs a COVID-19 compliant HVAC system as the facility’s current HVAC system is outdated and unreliable, causing ventilation to be extremely poor; and

WHEREAS, improving ventilation through an investment of a new HVAC system would be a preventative and pro-active measure that could help mitigate future outbreaks; and

WHEREAS, the Center  for Disease Control and Prevention recommends upgrading ventilation systems to reduce this risk.; and

WHEREAS, Montgomery County has been working with Venesky Group,a consultant, that has affirmed that a  grant to the Montgomery County SPCA for HVAC upgrades is an allowable use of American Rescue Plan Funds. 

NOW THEREFORE BE IT RESOLVED, that the Montgomery County Legislature authorizes and directs that a grant be awarded to the Montgomery County SPCA in the amount of $250,000 for HVAC improvements; and

BE IT FURTHER RESOLVED, that the Montgomery County Executive is authorized and directed to execute any necessary grant documents to implement this resolution.

WHEREAS, the County Auditor has audited claims for the period of February 23, 2022 through March 22, 2022 and the County Auditor recommends the payment of the claims as attached hereto in the "Abstract of Audited Claims".

RESOLVED, after examination and review of the claims by the County Auditor, the claims are audited and attached hereto, are hereby approved for payment by the Montgomery County Legislature.

RESOLUTION AUTHORIZING EXTENDING CYBER INSURANCE COVERAGE (COUNTY LEGISLATURE)

WHEREAS, it is necessary to extend cyber insurance coverage; and

WHEREAS, the County has shopped this policy and the most economical coverage is to enter into a reinstated limit endorsement with Travelers, the current provider. 

FURTHER RESOLVED, that the Montgomery County Executive is authorized and directed to enter into a contract with Travelers for cyber insurance coverage through January 1, 2023 at a cost not to exceed $19,000.

WHEREAS, one of the approved uses of American Rescue Plan funds by the federal government is under the standard allowance for government services; and

WHEREAS, Montgomery County has been working with Venesky Group,a consultant, that has affirmed that using 250k for FMCC projects is an allowable use of American Rescue Plan Funds. 

NOW THEREFORE BE IT RESOLVED, that the Montgomery County Legislature authorizes and directs that American Rescue Plan funds to FMCC in the amount of $250,000 for government projects ; and

BE IT FURTHER RESOLVED, that the Montgomery County Executive is authorized and directed to execute any necessary documents to implement this resolution; and

BE IT FURTHER RESOLVED, that the Montgomery County Treasurer is hereby authorized and directed to amend the 2022 Operating Budget as follows:
