RESOLUTION AUTHORIZING THE COUNTY EXECUTIVE TO EXECUTE AN AGREEMENT WITH JMZ ARCHITECTS & PLANNERS TO PREPARE A CAMPUS CRITICAL MAINTENANCE COST STUDY

WHEREAS, the 2022 Capital Plan includes a $170,300.00 appropriation to hire an Architect/Engineer firm to perform a cost study evaluation of projects within FMCC’s 2019-2023 Master Plan in order to provide reliable budgets for financial planning; and 

WHEREAS, JMZ Architects & Planners, P.C. has submitted a proposal to evaluate each project within the 2019-2023 Master Plan that will include the following tasks: 

  1. O’Connell Hall (Classroom Building:
  2. Program meeting for basement classrooms, office spaces, and lecture spaces, high school on campus, and HVAC/R program.
  3. Submit project approach for review.
  4. Evaluate water infiltration (see campus wide water infiltration).
  5. Evaluate hazmat scope associated with proposed projects.
  6. Project definition, phasing, and detailed cost estimate for two (2) projects with a construction cost goal of under $600k each.

 

  1. Evans Library Building:
  2. Evaluate existing mechanical/building systems and propose renovation approach for review.
  3. Program meeting for library needs, student success center (one stop services), advisement services, tutoring services, group/individual study, and evaluate ingress/egress/controlled access.
  4. Meeting to review project approach.
  5. Evaluate hazmat scope associated with proposed projects.
  6. Project definition, phasing, and detailed cost estimate for three (3) projects with a construction cost goal of under $600k each.

 

  1. Student Union Building:
  2. Evaluate water infiltration (see campus wide water infiltration).
  3. Evaluate hazmat scope associated with proposed projects.
  4. Project definition and detailed cost estimate for patio removal and water infiltration, one (1) project with a construction cost goal of under $600k.

  6. Project definition, phasing, and detailed cost estimate for two (2) projects with a construction cost goal of under $600k each.

  8. Evaluate existing drainage/stormwater/underground electrical/parking areas/sidewalks and propose renovation approach for review

WHEREAS, the total fee for these services includes:

 

-        Planning and Cost Estimating :           $170,275.00

WHEREAS, FMCC has agreed to cover the overage of $1,475.00; and 

WHEREAS, funding for the project will be as follows:

RESOLUTION PROCLAIMING APRIL 2022 AS "ORGAN AND TISSUE DONATION AWARENESS MONTH" IN MONTGOMERY COUNTY (COUNTY LEGISLATURE)

WHEREAS, through Montgomery County's membership with the New York State Association of Counties (NYSAC) and the New York State Association of County Clerks (NYSACC) New York's Counties have come together to collectively support Organ and Tissue Donation Month in New York State; and

WHEREAS, currently, nearly 106,000 men, women, and children are awaiting organ transplants in the United States; and

WHEREAS, organ, tissue, marrow and blood donation are live-giving acts recognized worldwide as expressions of compassion to those in need; and

WHEREAS, in New York State there are approximately 10,000 people waiting for an organ transplant, the third-highest in the nation; and there is an estimated 500 New Yorkers that die every year waiting for an organ transplant; and

WHEREAS, New York State's county governments play a key role in raising awareness of the need of organ and tissue donation; and

WHEREAS, counties across the State of New York are proclaiming the month of April 2022 as "Organ and Tissue Donation Awareness Month", and are engaging in various activities designed to promote an increase in the number of registered organ donors; and

WHEREAS, the Montgomery County Legislature and the Montgomery County Clerk's Office, through its Department of Motor Vehicles, wish to designate the month of April 2022 as "Organ and Tissue Donation Awareness Month" in Montgomery County; and now, therefore be it

RESOLVED, that the Montgomery County Legislature hereby proclaims the month of April 2022 as "Organ and Tissue Donation Awareness Month" in Montgomery County; and be it further

RESOLVED, that the Montgomery County Department of Public Works is directed to raise the "Donate Life" flag at the Montgomery County Office Building located at 64 Broadway, Fonda NY for the month of April 2022 as a means to raise awareness of the need for organ and tissue donors in Montgomery County.

WHEREAS, the Montgomery County Legislature has adopted resolution 47 of 2022 to provide premium pay for Montgomery County essential employees which includes various appointed officials; and

RESOLVED, that Local Law 1 of 2022 hereby is adopted and is incorporated as follows: “A LOCAL LAW ESTABLISHING SALARY OF VARIOUS COUNTY OFFICIALS ”

Be it enacted by the Legislature of the County of Montgomery as follows:

RESOLUTION APPROVING ONE-YEAR CONTRACT EXTENSION BETWEEN THE EDUCATIONAL SUPPORT PERSONNEL (ESP) AND FULTON-MONTGOMERY COMMUNITY COLLEGE

WHEREAS, representatives from Fulton-Montgomery Community College and the Educational Support Personnel (ESP) have negotiated an employment agreement between the Fulton-Montgomery Community College, Fulton County, Montgomery County and the Educational Support Personnel which expires in August 31, 2022; and 

WHEREAS, representatives from the Fulton-Montgomery Community College and the Educational Support Personnel after discussion have agreed to extend the terms and conditions of the current Negotiated Agreement for a period of one year commencing from September 1, 2022 through August 31, 2023; and 

WHEREAS, all terms and conditions of the current Negotiated Agreement shall continue in full force and effect during the extension period; and

WHEREAS, Fulton-Montgomery Community College has recommended that Fulton County enter into a Memorandum of Agreement by and between the Fulton-Montgomery Community College, Fulton County, Montgomery County and the Educational Support Personnel extending the terms of the current Agreement until August 31, 2023; and

NOW, IT IS THEREEFORE RESOLVED, that the Fulton County Board of Supervisors authorizes and directs the President of Fulton-Montgomery Community College to sign a Memorandum of Agreement by and between the Fulton-Montgomery Community College, Fulton County, Montgomery County and the Educational Support Personnel extending the terms of the current Agreement effective September 1, 2022 through August 31, 2023; and, be it further 

RESOLVED, that said agreement is contingent upon adoption of a similar Resolution by the Montgomery County Legislature.

WHEREAS, the FMCC Campus Labs and Classrooms Building Renovation Project was intended to be a sequential three (3) phased project as identified within Fulton County’s 2018-2020 Capital Plan, and 

WHEREAS, the first two (2) phases were completed in 2018 and 2019 respectively, and 

WHEREAS, due to the onset of the COVID-19 Pandemic, Phase 3 of the sequential three-phased project abruptly stopped once FMCC was notified by the SUNY Office of Capital Facilities that New York State would no longer support the project due to reappropriating State dollars toward more immediate health and safety related projects, and 

WHEREAS, the initial Phase 3 project had been designed, successfully bid and all contracts had been executed, and 

WHEREAS, Fulton County’s 2022 Capital Plans includes a $1,000,000 appropriation for the FMCC Science Labs and Classrooms Phase 3 Project, and 

WHEREAS, funding for the project will be from:

 

SUNY                                 :           $   750,000

Fulton County                    :           $   250,000

Montgomery County         :           $   250,000

Total                                  :           $1,000,000

 

And 

WHEREAS, FMCC received a proposal from JMZ Architects & Planners, P.C. to perform an update to the previous bid specifications and to provide procurement and Construction Administration services as follows:

 

Phase 3:

Construction Documents Update Phase                :           $21,050.00

Procurement Phase                                             :           $ 4,500.00

Construction Administration Phase                      :           $38,550.00

Supplemental Services Fee                                   :           $ 3,150.00
