Chairman Brian D. Sweet has called a meeting of the Education/Government Committee for 6:03 p.m. on Tuesday, July 20, 2021 in the Legislative Chambers, County Office Building, 64 Broadway, Fonda, New York 12068.

WHEREAS, New York State providing grant funding for Early Voting, Technology Innovation related expenses for Elections held in 2021; and
WHEREAS, it is nessary to amend the 2021 Operating Budget to provide funds for added expenses for Elections in 2021.
RESOLVED, the Montgomery County Treasurer is hereby directed to amend the 2021 Operating Budget as follows:

I. Nature of Request:
Elections Expenses for Early,Primary and General Elections held in 2021 to be covered by the three grants listed for additional expenses associated with running elections.
II. Justification:
Added voting locations and duties with all additional requirements from New Legislation by New York State for Elections.
III. Legislative Impact:
Pursuant to Article 2 of the County Charter, the Montgomery County Legislature has the power to make appropiations.

RESOLUTION NO. 163 of 2021 DATED: August 3, 2021 RECOMMENDATION: |
RESOLUTION CONFIRMING APPOINTMENT OF COMMISSIONER OF SOCIAL SERVICES MADE BY THE COUNTY EXECUTIVE (COUNTY LEGISLATURE)

WHEREAS, pursuant to §3.02 and §3.03 of the Montgomery County Charter, the County Executive has the power to make appointments; and
WHEREAS, pursuant to §10.01 of the Montgomery County Charter there shall be a Department of Social Services under the direction of a Commissioner who shall be appointed by the County Executive to a five year term subject to confirmation by the County Legislature; and
WHEREAS, pursuant to §10.01 of the Montgomery County Charter the Commisioner of Social Services shall be appointed on the basis of his or her administrative experience and qualifications for the duties of the office for the term provided by law; and
WHEREAS, pursuant to §10.02 of the Montgomery County Charter the Commissioner of Social Services shall perform the duties prescribed by law and such additional and related duties as are required by the County Executive.
WHEREAS, pursuant to §2.08 of the Montgomery County Charter the County Legislature shall confirm appointments no longer than sixty (60) days after the appointment has been filed with the Clerk of the Legislature; and
WHEREAS, pursuant to §2.08 of the Montgomery County Charter the County Legislature shall undergo a committee review of appointees; and
WHEREAS, the County Executive appointed Michael McMahon as the Commissioner of Social Serices on the basis of his training and experience in social services administration and other qualifications for the responsibilities of his office; and
WHEREAS, the Montgomery County Legislature has undergone a committee review of Michael McMahon; and
WHEREAS, it has been less than sixty (60) days after the appointment was filed with the Clerk of the Legislature; and
WHEREAS, Montgomery County conferred the benefits of defense and indemnification of its officers and employees pursuant to Section 18 of the Public Officers Law by the adoption of Local Law #2 of 1984.
RESOLVED, that the Montogmery County Legislature approves the appointment of Michael McMahon as Commissoner of Social Services at a base salary of $82,197, Group F in the Non-Bargaining Policy; and
FURTHER RESOLVED, that the Montgomery County Legislature hereby confirms the appointment of Michael McMahon as Commisioner of Social Services for a five year term commencing June 8, 2021 and ending on June 7, 2026; and
FURTHER RESOLVED, that it is understood and agreed that such benefits of defense and indemnification are conferred upon Michael McMahon as Commisioner of Social Sericces for any acts or omissions while acting within the scope of his duties as Commissioner of Social Services.

I. Nature of Request:
CONFIRMING APPOINTMENT OF COMMISSIONER OF SOCIAL SERVICES MADE BY THE COUNTY EXECUTIVE.
II. Justification:
Article 10 of the Montgomery County Charter dictates that there shall be a Department of Social Services under the direction of a Commissioner.
III. Legislative Impact:
Pursuant to pursuant to §10.01 of the Montgomery County Charter there shall be a Department of Social Services under the direction of a Commissioner of Social Services who shall be appointed by the County Executive, subject to confirmation by the County Legislature.
IV. Financial Impact:
This position was included in the 2021 Operating Budget.

RESOLUTION NO. 164 of 2021 DATED: August 3, 2021 RECOMMENDATION: |
RESOLUTION ADOPTING 2021-2022 FMCC OPERATING BUDGET (COUNTY LEGISLATURE)

WHEREAS, the Fulton-Montgomery Community College Board of Trustees has presented Fulton and Montgomery County, the sponsoring counties, with a 2021-2022 budget request, proposing a total FMCC budget of $16,635,402; and
WHEREAS, a public hearing related to the adoption of said FMCC Budget was held on July 27, 2021; and
WHEREAS, that the amount to be appropriated by the County of Montgomery, as its sponsor share of said Budget, shall be $1,545,821; which is 9% of the Operating Budget.
FURTHER RESOLVED, that said sponsor’s share shall be included in the Montgomery County Operating Budget for 2022, as provided for in Section 6304 of the Education Law of the State of New York; and
FURTHER RESOLVED, that this Resolution shall take effect upon adoption of a similar Resolution by the Fulton County Board of Supervisors.
