Chairman Joseph M. Isabel has called a meeting of the Public Safety Committee for 6:01 p.m. on Tuesday, July 20, 2021 in the Legislative Chambers, County Office Building, 64 Broadway, Fonda, New York 12068.

WHEREAS, Montgomery County has an agreement with New York State Office of Parks & Recreation to provide maintenance on the Empire State Canalway Trail; and

WHEREAS, Montgomery County DPW oversees the maintenance of said agreement; and

WHEREAS, Montgomery County DPW was requested to relocate a section of Empire State Canalway Trail and install approximately 320 Ft of box beam guide rail to allow for additional trail head parking.

RESOLVED, the County Treasurer is authorized and directed to amend the 2021 Operating Budget as follows:

Statement of Legislative and Financial Impact:

I. Nature of Request:

Authorization allowing the County Treasurer to transfer funds within the DPW operating budget to pay for materials used on the Empire State Canalway Trail (Bike Trail)


II. Justification:

Montgomery County DPW through the Montgomery County Executive received a request to relocate a portion of the trail to allow for expanded parking to access the trail. Funds are needed to cover expenses under special recreation and the Commissioner of DPW has allocated funds through his highway budget to cover expenses


III. Legislative Impact:

Pursuant to article 2 of the Montgomery County Charter, the legislature has the authority to authorize appropriations


IV. Financial Impact:

Cost of repairs are anticipated to be $15,000.00

Funds are being allocated within the 2021 DPW Operating budget to cover expenses.

WHEREAS, the District Attorney's office received grant funding pursuant to the Criminal Justice Discovery Reform Grant; and

WHEREAS, the terms of the grant allocates a portion of the grant to local law enforcement agencies; and

WHEREAS, said grant funding has been received and deposited into the Appropriated Fund Balance; and

WHEREAS, the following amounts were allocated to the specific agencies:

St. Johnsville Police Department  $2,000
Canajoharie Police Department  $2,000
Fort Plain Police Department  $2,000

Pursuant to the terms of the Criminal Justice Discovery Reform Grant.


III. Legislative Impact:

The Montgomery County Legislature has the authority to approve the acceptance and distribution of grants.


IV. Financial Impact:

None.  Transfer of funds deposited into Appropriated Fund Balance but earmarked for local law enforcement agencies.

I. Nature of Request:

To use forfeiture money from drug related prosecutions in Montgomery County ro purchase equipment and provide money for training to law enforcement agencies throughout Montomery County without any cost to Montgomery County.


II. Justification:

Law enforcement agencies benefit from purchses made with forfeiture monies for equipment and training.


III. Legislative Impact:

Pursuant to Article 2 of the Charter, the Montgomery County Legislature has the power to make appropriations.


IV. Financial Impact:

Forfeiture monies collected will offset expenditures.

WHEREAS, the Sheriff has been awarded a grant totaling $194,263.00 from the 2020-2021 Public Safety Answering Point (PSAP) Grant Program; and

WHEREAS, the funding has been approved by the State to use for any beneficial reason pertaining to the 911 Dispatch Center operated by the Sheriff's Office; Resolution # 53-2021 shows that $150,000 has already been addressed in order to support the new CAD system purchased from Tyler Technologies.  The remianing $44,263 that was awarded will now be added to complete some of the purchases; and 

WHEREAS, the items and software being purchased will be used to directly benefit the employees working withing the 911 Dispatch Center and our constituents living in, traveling through or visiting Montgmery County.

RESOLVED,  the Montgomery County Executive, upon review and approval of the County Attorney,  is authorized and directed to sign the 2020-2021 PSAP Grant in an amount totaling $194,263.00; and

FURTHER RESOLVED, the Montgomery County Treasurer is hereby authorized and directed to amend the 2021 Operating Budget as follows:

RESOLUTION AMENDING THE 2021 OPERATING BUDGET - 2020-2021 PUBLIC SAFETY ANSWERING POINT(PSAP) GRANT PROGRAM (SHERIFF)

This PSAP grant will allow us to upgrade all of our computer equipment and software to work with the new CAD system purchased from Tyler Technologies.  This is the first step towards utilizing the new software.   


III. Legislative Impact:

Pursuant to section 2.04 (b) of the charter the Montgomery County Legislature has the power to make appropriations.


IV. Financial Impact:

There is no financial impact for this resolution request, except it allows us to purchase important items for the 911 Dispatch Center without using county funds.

WHEREAS, Montgomery County Deputy Sheriff's have seen an increase in calls for service, an increase in partnering with our community and an increase in larger cases/details causing overtime; and

WHEREAS, a large  portion of overtime spent does come back to the county and goes into the general fund;

Statement of Legislative and Financial Impact:

I. Nature of Request:

RESOLUTION AMENDING THE 2021 OPERATING BUDGET (SHERIFF)


II. Justification:

The Montgomery County Sheriff's Office continues to see an increase in calls for service, calls for partnership and larger volume cases.  Some of this money spent approximately $20,000 is money that comes back to the county but goes into the general fund and is not returned to the OT budget line.  Although these expenses are up, we are providing a quality service to the public and it is imperative to do things correctly, which causes increased manpowwer.  We still have the Fonda Fair which is a tall task for our members, however we will continue to work hard and do our best.  This money is all within our current budget and will not require any additional funds.  Thank you! 


III. Legislative Impact:

Montgomery County Legislators have the authority to authorize budget transfers pursuant to Article 2 of the Montgomery County Charter.


IV. Financial Impact:

There should be no financial impact as this money is budgeted and just moved within current lines.

WHEREAS, the District Attorney has reviewed the structure of the Department and has determined that the establishment of a full time First Assistant District Attorney is necessary to meet the demands of the office, to assist with management and administrative responsibilities of the District Attorney office and to carry out decision making authority in the absence of the District Attorney; and

WHEREAS, said position is consistent with the Office of the District Attorney in other counties as well as within the Montgomery County Public Defender's office; and

WHEREAS, the District Attorney met with the Personnel Officer and it was determined that the duties within the title of First Assistant District Attorney are appropriate to meet the needs of the Department as such, the title is certified in accordance with Civil Service law Section 22.

WHEREAS, an amount sufficient to cover the fringe benefits was previously transferred under Resolution No. 58 2021; and 

RESOLVED, that the position of full-time First Assistant District Attorney is hereby established in the Office of the District Attorney at base pay rate of $98,000.00 with a pro-rated base pay amount for the remainder of 2021 of $45,058.00, Group L of the Non-Bargaining Personnel Policy; and

FURTHER RESOLVED, that the County Treasurer is hereby authorized and directed to amend the 2021 Operating Budget as follows:

Statement of Legislative and Financial Impact:

I. Nature of Request:

Establishing the Position of First Assistant District Attorney.


II. Justification:

This request is made to bring the office in compliance with County Law, to be consistent with other county District Attorney's offices statewide as well as the Montgomery County Public Defender's office; and to meet the escalating demands of the office of the District Attorney.  


III. Legislative Impact:

Pursuant to Article 2 of the Charter, Montgomery County Legislature has the power to make appropriations and establish positions.

Pursuant to New York County Law Section 702(4), the District Attorney shall designate in writing and file in the office of the county clerk and clerk of the board of supervisors the order in which such assistants shall exercise the powers and duties of the office in the event of a vacancy or the absence or inability of such district attorney to perform the duties of the office. 


IV. Financial Impact:

The funds will be transferred from the lines 1292 and 66  and will have to be budget for in future budget years.  Estimated total cost of the position with fringe moving forward will be $151,760 a year.
