WHEREAS, the Greater Mohawk Valley Land Bank has requested that interest, penalties, and other charges for nonpayment of taxes be cancelled in whole on the following properties:

THERFORE BE IT RESOLVED,that upon a public hearing being held the Montgomery County Legislature has determined that the cancellation in whole of any interest, penalties, and other charges on these Land Bank properties through May 31, 2021 is in the best interest of the tax district; and

BE IT FURTHER RESOLVED, that the Montgomery County Legislature authorizes and directs the enforcing officer to cancel in whole all interest, penalties, and other charges  assessed to the following properties through May 31, 2021:

BE IT FURTHER RESOLVED, that the cancellation of interest and charges as it pertains to each parcel is contingent upon the taxes for each corresponding parcel, as calculated by the Montgomery County Treasurer, being paid in full by close of business on May 20, 2021. If the taxes for a parcel is not paid then this resolution shall not take effect for that parcel.

MOTION TO AMEND by Legislator Purtell, seconded by Legislator Wilson,

to add a BE IT FURTHER RESOLVED clause to the end of the resolution as follows:

BE IT FURTHER RESOLVED, that 3 Ann St, 11 Ann St and 63 Center St shall exclusively be cancelled in whole of any interest, penalties, and other charges on these Land Bank properties through July 30, 2021 with this cancellation being contingent upon payment being received for the taxes for each corresponding parcel, as calculated by the Montgomery County Treasurer, being paid in full by close of business on July 30, 2021.

I. Nature of Request:

RESOLUTION CANCELLING IN WHOLE ALL INTEREST, PENALTIES, AND OTHER CHARGES ON CERTAIN GREATER MOHAWK VALLEY LAND BANK PROPERTIES (LEGISLATURE)


II. Justification:

The Land Bank has requested that interest, penalties and other charges for nonpayment of taxes be waived on the following properties


III. Legislative Impact:

Authorized by RPTL 1182


IV. Financial Impact:

A loss of $20K plus additional penalties to the County.
