RESOLUTION AUTHORIZING THE WRITE-OFF OF COUNTY TAXES ON PROPERTIES WITHIN THE CITY OF AMSTERDAM (COUNTY TREASURER)

WHEREAS, County taxes on properties in the City of Amsterdam for the years 2000 through 2010 remain unpaid; and

WHEREAS, the amount of these outstanding taxes remain as a receivable from the City of Amsterdam on the County's financial statement; and

WHEREAS, the City of Amsterdam is unable to identify what tax parcels constitute outstanding amounts that are due to the County; and

WHEREAS, the City of Amsterdam has requested that these outstanding taxes receivable be written off the County's financial statements as uncollectible.

RESOLVED, the County Legislature authorizes and directs the County Treasurer to write-off the taxes receivable from the City of Amsterdam for the years 2000 through 2010 in the amount of $513,500.78; and

FURTHER RESOLVED, the breakdown of the outstanding taxes to be written off are as follows:

     2000          $40,390.70

     2001          $40,254.81

     2002          $39,185.20

     2003          $46,110.72

     2004          $38,528.71

     2005          $30,304.33

     2006          $41,415.42

     2007          $34,125.30

     2008          $61,262.97

FURTHER RESOLVED, that said Treasurer is directed to take all necessary steps, under proper accounting procedure, to adjust the books of his office, effective immediately.

Authorization to write off delinquent taxes as uncollectible


II. Justification:

City cannot identify delinquent taxes outstanding that are due to the County


III. Legislative Impact:

Pursuant to Article 2 of the Charter the Motngomery County Legislature

WHEREAS, Resolution 205 of 2020 awarded contracts for construction of the new Shared Services facility; and

WHEREAS, Resolution 205 of 2020 did not included contingencies; and

WHEREAS, to increase efficiency during construction it is recommended that contingencies be added so there are not unnecessary delays and increased costs. 

THEREFORE BE IT RESOLVED that Resolution 205 of 2020 is hereby amended as follows:

The Montgomery County Legislature hereby authorizes and awards contracts to:

MLB Construction Services, LLC. for the General Contract at a cost not to exceed $7,868,8220.

Postler & Jaeckle Corp. for the Mechanical Contract at a cost not to exceed $1,432,000.

Upstate Companies I, LLC for the Electrical Contract at a cost not to exceed 1,103,760.

BPI Piping for the Plumbing Contract at a cost not to exceed $1,765, 050.

RESOLUTION APPROVING ROAD USE AND CROSSING AGREEMENT BETWEEN COUNTY OF MONTGOMERY AND MOHAWK SOLAR, LLC (PUBLIC WORKS)

WHEREAS, Mohawk Solar, LLC (the "Applicant") has proposed to construct a 90.5 megawatt (MW) solar energy facility (the "Project") in the Towns of Canajoharie and Minden (the “Towns”), Montgomery County (the “County”), and has applied to the New York State Board on Electric Generation Siting and the Environment (the "Siting Board") for a Certificate of Environmental Compatibility and Public Need Pursuant to Article 10 of the Public Service Law to allow the Applicant to construct and operate the Project;

WHEREAS, the County is responsible for the maintenance of certain roads and highways within their respective jurisdictions;

WHEREAS, in connection with the development, construction, operation and maintenance of the Project, it may be necessary for the Applicant and its contractors and subcontractors or designees to transport materials across the county roads and highways; and

WHEREAS, the County of Montgomery and the Applicant wish to enter into an agreement for the use, repair, and improvement of county roads and highways.

NOW THEREFORE BE IT RESOLVED, upon review and approval of the County Attorney, the County Executive is hereby authorized and directed to sign the Road Use and Crossing Agreement with Mohawk Solar, LLC.

The County is responsible for the maintenance of certain roads and highways within their respective jurisdictions

Puruant to Article 2 of the Montgomery Charter the County Executive is authorized to sign contract

AMENDING 2021 OPERATING BUDGET 


II. Justification:

The additional funds will be used for anticipated expenses to be incurred in 2021 for trials and  expenses for necessary items that were not able to be requested during budget preparations time by the newly elected District Attorney.


III. Legislative Impact:

Pursuant to Section 2.04(b) the County Legislature has the power to make appropriations.


IV. Financial Impact:

One time deduction of $7,874.90 from the Contingent Account.

RESOLUTION AUTHORIZING THE COUNTY EXECUTIVE TO SIGN AND EXECUTE A CONTRACT AGREEMENT EXTENSION - RSTELECOM-MICROWAVE MAINTENANCE (EMERGENCY MANAGEMENT)

WHEREAS, the Emergency Management Office needs a contract to provide microwave maintenance for Montgomery County's 911 microwave system; and

WHEREAS, the microwave system is the backbone of the 911 communications sytem and assists in providing emergency communications to all of our first responders; and

WHEREAS, the current contract has expired.

RESOLVED, that the County Executive is hereby authorized to sign and execute a contract agreement extension with RSTelecom for a term of January 1, 2021 to December 31, 2023 for a cost not to exceed $48,000 a year, after review and approval by the County Attorney.

Statement of Legislative and Financial Impact:

I. Nature of Request:

RESOLUTION AUTHORIZING THE COUNTY EXECUTIVE TO SIGN AND EXECUTE A CONTRACT AGREEMENT EXTENSION - RSTELECOM-MICROWAVE MAINTENANCE (EMERGENCY MANAGEMENT)


II. Justification:

It is imperative that we have a maintenace agreement to keep our microwave system in good working orsder and to avoid interuptions in our 911 communications.  RSTelecom has been providing this service for 6 years and they have done a very good job.  The microwave system was a very expensive endeavor and is the backbone of our 911 communications system.  This contract expired and this extension is necessary to keep services flowing. 


III. Legislative Impact:

Pursuant to Article 3 of the Charter the Montgomery County Executive is authorized to sign contracts.


IV. Financial Impact:

There should be no budget impact as this money is already budgeted and a yearly occurrence.

Statement of Legislative and Financial Impact:

I. Nature of Request:

RESOLUTION AMENDING THE 2021 OPERATING BUDGET - EQUIPMENT (SHERIFF)


II. Justification:

The Sheriff's Office recieved a $2,000 donation to be used towards our body worn cameras.  It has been determined that continual upgrades of our body worn cameras is essential and pertinent.  This is a perfect place to use this money.  The cameras are written in policy, benefit the public and provide accountability.


III. Legislative Impact:

Pursuant to section 2.04 (b) of the charter the Montgomery County Legislature has the power to make appropriations.


IV. Financial Impact:

There is no financial impact as all of this money has been obtained through gifts and donations from the public!

WHEREAS, the Sheriff has recommended a change in providers for the CAD (Computer Aided Dispatch) Software for the Sheriff’s Office, Computer-Aided Dispatch, Law Enforcement Records Software and Public Safety Interface Software from Impact to Tyler Technologies, and

WHEREAS, Computer Aided Dispatch Software services were recently put out to bid by Fulton County, who awarded the contract to Tyler Technologies as the lowest, responsible, responsive bidder; and

WHEREAS,  the Montgomery County Sheriff recommends piggybacking off of this contract.

RESOLVED, that the County Executive after review and approval of the County Attorney, hereby is authorized and directed to sign the contract with Tyler Technologies for the Sheriff’s Office Computer-Aided Dispatch, Law Enforcement Records Software and Public Safety Interface Software at an amount not to exceed $1,698,902.00, and

FURTHER RESOLVED, said contract shall not exceed seven (7) years as worked out by the payment plan and stipulated in the contract.

Statement of Legislative and Financial Impact:

I. Nature of Request:

RESOLUTION AUTHORIZING CHAIRMAN TO SIGN AGREEMENT AND AMEND THE 2021 OPERATING BUDGET - CAD SOFTWARE- (SHERIFF)


II. Justification:

Our current CAD system was purchased in 2010 and is sundowning.  The company will no longer be supporting it and over the past two years the maintenance and issues we are having with the system have become very problematic.  We continue to experience major errors, things that can afffect paperwork, criminal cases, sending appropriate agencies to emergencies, losing information and wrong data being collected.  

We have for years been a completely identical backup to the Fulton County Sheriff's Office, the proposal for Tyler Technologies will continue to allow this to happen as they are also changing vendors because of the current Impact issues.  We will have the ability to operate as is should we experience a failure at our office requiriing us to move to Fulton County when thys new system is installed and operational.  Tyler will serve every law enforcement and fire agency within the county and allow Data sharing, something we can not do at this point. 

It is our hopes to use as much of grant money as possible to pay for these items, including the yearly stipend for the software.    


III. Legislative Impact:

Pursuant to Article 2 of the Charter the County Legislature has the authority to make appropriations. According to Article 3 of the Charter the County Executive has the authority to sign contracts.


IV. Financial Impact:

The financial impact may be significant.  Depending on when the grants fall and how this is ultimately paid for, for the next seven years, we are required to make yearly payments of $142,404.00 before our regular maintenance fees.

It is our goal to utilize grant funds for these payments and our hopes that we can complete this project with little to zero budget money, however the initial payment for hardware required must be paid with county funds, depending on how much of a PSAP grant we receive.

WHEREAS,  Governor Cuomo's Executive Order 203 directed that each local governemnt perform a comprehensive review of current police force deployments, strategies, policies procedures and practices; and

WHEREAS, the Montgomery County Sheriff and members of the Sheriff's Department have worked collaboratively with members of the public soliciting feedback and undergone a comprehensive review of current police force deployments, strategies, policies, procedures and practices; and

WHEREAS, Montgomery County Sheriff's Department developed a plan, attached hereto, to improve deployments, strategies, policies, procedures and practices in the Montgomery County Sheriff's Office (hereinafter the "Plan"); and

WHEREAS, members of the public have been offered the Plan in draft form for public comment to all citizens in the locality, and prior to adoption of the Plan, the County has considered all comments submitted; and

RESOLVED, the Montgomery County Legislature hereby approves and adopts the Plan  as meeting all requirements of Governor Cuomo's Executive Order 203; and

FURTHER RESOVED, the County Executive is hereby authorized and directed to sign the certification form for submission of the Montgomery County Sheriff's Office Police Reform and Reinvention Collaborative Report/Plan.

WHEREAS, Montgomery County currently has four large-scale projects which require code enforcement per requirements of Title 19- NYCCR Chapter XXXII Part 1203; and

WHEREAS, Montgomery County will realize a substantial savings by employing a Code Enforcement Officer PT versus contracting on a per-project basis; and

WHEREAS, the Emergency Management Director hereby requests the establishment of a Code Enforcement Officer (PT) position within the Emergency Management Office with a base salary of $38,000, Group U in the Non-Bargaining Policy.

RESOLVED, that the Montgomery County Legislature hereby establishes the position of Code Enforcement Officer (PT), Group U in the Non-Bargaining Policy; and

RESOLVED, this position is temporary and will terminate upon the conclusion of the Venner Road and Shared Services Building projects;

FURTHER RESOLVED, the County Treasurer is hereby authorized to amend the 2021 Budget as follows:

Statement of Legislative and Financial Impact:

I. Nature of Request:

Establish position of Code Enforcement Officer PT in the Emergency Management Department.


II. Justification:

New York State Codes, Rules and Regulations requires municipalities to provide code enforcement for review of site plans, construction plans and documents and to perform inspection services on behalf of the municipality.

 

 


III. Legislative Impact:

Pursuant to Article 2 and 3 of the Montgomery County Charter the Montgomery County Board of Legislature and County Executive have the authority to establish positions and make amendments to the operating budget.


IV. Financial Impact:

The position will need to be funded from the General Fund Balance.

Fund Balance will be reimbursed by Administration Cost portion of the Shared Service Project.

Position will need to be budgeted for in 2022.

WHEREAS, Montgomery County owns generators at the Montgomery County Public Safety Facility to provide emergency back-up power; and

WHEREAS, the Department of Public Works is responsible for the maintenance of generators to all county-owned properties; and

WHEREAS, the Commissioner of the Department of Public Works recommends contracting with Milton Cat to perform annual maintenance on two generators located at the Public Safety Facility for a three year contract at a cost not to exceed $10,673.79 for both generators over the course of three years.

RESOLVED, the Montgomery County Legislature, after review by the County Atorney, authorizes the County Executive to sign a three-year maintenance agreement with Milton Cat for generator maintenance at a cost not to exceed $10,673.79 for both generators over the course of three years.

To create a full-time Assistant District Attorney position to meet the demands of the office using contingency funds.


II. Justification:

This request is being made due to the demands of the office for increase in caseload as well as new changes in law pertaining to discovery rules and bail reform making it necessary to add another full-time attorney to the office.


III. Legislative Impact:

Pursuant to Article 2 of the Charter, the Montgomery County Legislature  has the authority to establish positions of employment.


IV. Financial Impact:

This position will be paid for by using contingency fund. Fringe is based on tier 6 with family plan with dental and vision. This final fringe amount will vary based on the candidate. Should grant money become available, funds will be reimbursed to contingency.

WHEREAS, it is necessary that a Part Time Micro Computer Technician position be established in the office of the Montgomery County District Attorney; and

WHEREAS, this position will be shared with the Montgomery County Sheriff's Department to meet the needs both offices with regard to all computer related requirements and data uploads, etc.; and

WHEREAS, it is necessary to appropriate funds from the contingency fund to cover the cost of said position; and

WHEREAS, in future budgets, funds will be allocated from each budget of the Sheriff and the District attorney to fund said position; and

WHEREAS, it is anticipated grant funding may become available to assist in the funding this position in the future; and

RESOLVED, that the Montgomery County Legislature hereby establishes the position of Micro Computer Technician (PT) with an hourly rate of $22.3920 equivalent to Grade H in the CSEA Bargaining Agreement in the District Attorney's Office who will share said position with the Montgomery County Sheriff's Office; and

FURTHER RESOLVED, if grant funding comes in and it is possible under the grant that the contingent fund will be reimbursed for the disbursements of this resolution; and
