RESOLUTION APPROVING THE EXTENSION OF THE COLLECTIVE BARGAINING AGREEMENT BETWEEN FULTON-MONTGOMERY COMMUNITY COLLEGE AND THE FULMONT ASSOCIATION OF COLLEGE EDUCATORS

WHEREAS, Fulton-Montgomery Community College, Montgomery County, Fulton County and the Fulmont Association of College Educators (FACE) entered into a collective bargaining agreement in April of 2015 for an employment contract for academic years September 1, 2016 through August 31, 2017; and

WHEREAS, Fulton-Montgomery Community College, with representation from Montgomery County and Fulton County, have entered into contract negotiations in good faith; and

WHEREAS, the parties have been unable to reach an agreement before the end date of the current collective bargaining agreement; and

WHEREAS, all parties wish to have an agreement in place while negotiations continue into the 2018 – 2019 academic year; and,

WHEREAS, the FM Board of Trustees approved the requested extension; therefore be it

RESOLVED, that the Montgomery County Legislature approves a one-year extension of the Fulton-Montgomery Community College and Fulmont Association of College Educators collective bargaining agreement through August 31, 2019. This resolution is dependent upon Fulton County passing a similar resolution of approval.

APPROVING THE EXTENSION OF THE COLLECTIVE BARGAINING AGREEMENT BETWEEN FULTON-MONTGOMERY COMMUNITY COLLEGE AND THE FULMONT ASSOCIATION OF COLLEGE EDUCATORS


II. Justification:

By New York State Law, each county is considered a co-employer of FM employees who are covered by a collective bargaining agreement and therefore must approve any agreement between the College and the union. This resolution grants a one-year extension of the current contract while negotiations continue.


III. Legislative Impact:

The Montgomery County Legislature is authorized to pass this Resolution in support pursuant to Section 2.04 of the Montgomery County Charter.


IV. Financial Impact:

Included in yearly contract to FMCC

WHEREAS, Fulton and Montgomery Counties have approved a $2,200,000 FMCC PE Building Bathrooms and Locker Rooms Project, and 

WHEREAS, there are no Montgomery County funds involved with this project. Funding will be from:

SUNY: $1,100,000
FMCC FOUNDATION: $1,100,000

and

WHEREAS, Resolution #70 of 2018 authorized the County Executive to execute certain Agreements for the FMCC PE Building Bathrooms and Locker Rooms Project, and 

WHEREAS, one of these Agreements was with Bast Hatfield Construction, LLC to provide general construction services, and 

WHEREAS, the original contract agreement contained a $55,000 Contingency Allowance to be used for unexpected circumstances, and 

WHEREAS, to date, there have been two (2) authorized charges to the Contingency Allowance as follows: 

Additional Asbestos Abatement: $38,445.00
Additional Steel Dunnage: $2,730.00
Additional Asbestos Abatement: $2,507.94
Additional Asbestos Abatement: $10,613.58
TOTAL $54,196.52

and 

WHEREAS, there remains $803.48 within the Contingency Allowance, and 

WHEREAS, FMCC is recommending that Bast Hatfield Construction’s Contingency Allowance be increased by $10,000 utilizing a portion of the uncommitted funds that remain, 

NOW, THEREFORE BE IT RESOLVED, that the County Executive is hereby authorized and directed to execute Change Order No. 1 in the amount of $10,000.00 with Bast Hatfield Construction, LLC, and be it further 

RESOLVED, that Bast Hatfield Construction, LLC’s revised contract amount will now be:

NOW, THEREFORE BE IT RESOLVED, that the County Executive is hereby authorized and directed to execute Change Order No. 1 in the amount of $14,770.62 with Burniche Piping, Inc., and be it further 

RESOLVED, that Burniche Piping, Inc.’s revised contract amount will now be:

RESOLVED, the Montgomery County Legislature hereby approves the scheduling of a Public Hearing on the proposed 2018-19 Budget of Fulton-Montgomery Community College for July 24, 2018 at 6:55 pm in the Legislative Chambers, County Office Building, 64 Broadway, Fonda, NY 12068; and

FURTHER RESOLVED, the Clerk of the Montgomery County Legislature hereby is directed to cause legal notice of said public hearing to be published according to local law.

RESOLUTION AUTHORIZING COUNTY EXECUTIVE TO SIGN AGREEMENT - CONTINUATION OF CLEO AGREEMENT BETWEEN THE COUNTY OF MONTGOMERY AND THE COUNTIES OF FULTON AND SCHOHARIE

WHEREAS, in accordance with the Workforce Innovation and Opportunity Act (WIOA) of 2014, Fulton, Montgomery, and Schoharie Counties entered into an agreement prescribed by WIOA to oversee the management of WIOA funding and supported activities coordinated by the Grant Sub-recipient and Fiscal Agent the Fulton Montgomery and Schoharie Counties Workforce Development Board, Inc.; and

WHEREAS, the Chief Local Elected Officials (CLEO) Agreement authorizes the FMS Workforce Development Board to provide planning guidance, monitoring, support, oversight and regulation to ensure the highest quality workforce development system; and

WHEREAS, said CLEO Agreement should be renewed on a yearly basis on July 1 of each year; and

WHEREAS, the CLEO Agreement was recently revised to meet new regulations.

RESOLVED, the County Exeucitive, upon review and approval of the County Attorney, is hereby authorized and directed by the Montgomery County Legislature to sign the Chief Local Elected Officials (CLEO) Agreement between the Counties of Fulton, Montgomery, and Schoharie to meet the requirements of the Workforce Innovation and Opportunity Act; and

FURTHER RESOLVED, this Agreement is effective July 1, 2018 and continues through June 30, 2019.

WHEREAS, In accordance with The Workforce Innovation and Opportunity Act of 2014 (WIOA) (P.L. 113-128) , the Counties of Fulton, Montgomery, and Schoharie entered into an agreement as described in WIOA to organize and implement activities pursuant to WIOA and in accordance with requirements established by the Governor of the State of New York (Governor) for purposes of implementing programs and services under WIOA; and

WHEREAS, the membership of the WDB shall be appointed by the Chief Local Elected Officials (CLEO); and

WHEREAS, each CLEO shall appoint an equal number of Workforce Development Board members. There shall be four public sector and five private sector members appointed by each CLEO. The CLEOs shall among themselves agree so that all of the mandatory representatives listed under WIOA Section 107 will be represented; and

RESOLVED, the Montgomery County Legislature hereby confirms the following appointment and term of respresentative to the Fulton, Montgomery and Schoharie Workforce Development Board made by the County Executive; effective immediately:

WHEREAS, the Montgomery County Youth Bureau promotes the physical, emotional and social well-being of youth and families in our community and is committed to helping young people grow up healthy, caring and responsible through positive youth development, the Montgomery County Youth Bureau supports this initiative as a means to educate our youth on the importance of agriculture in our community; and

WHEREAS, this is the 177th year of the Montgomery County Fonda fair, one of the largest tourist attractions in Montgomery County; and

WHEREAS, the Montgomery County Agricultural Society runs the fair; and

WHEREAS, the fair is a showcase to the public of the bountiful harvest of Montgomery County farmers; and

WHEREAS, in 2017 1500 youth a day attended the fair at a rate of $15,000 a day; and

WHEREAS, the Montgomery County Ag Society has agreed to accept a flat rate of $7,500 a day to pay for all youth who may attend the fair on Wednesday, August 29th and Friday, August 31st; and 

WHEREAS, allowing the youth of Montgomery County to attend free-of-charge on Wednesday, August 29th and Friday, August 31st promotes a fun-family experience in the heart of Montgomery County.

RESOLVED, the Montgomery County Legislature hereby authorizes and directs the County Executive to enter into an agreement with the Montgomery County Agricultural Society to pay a flat rate in return for all youth being given free admission to the fair on Wednesday and Friday promoting Youth Days.

FURTHER RESOLVED, that the County Treasurer is hereby authorized and directed to disburse $15,000.00 to the Montgomery County Agricultural Society the Youth Bureau Outreach Program - Line#- A-21-4-7310-00-.4559.

AUTHORIZING THE COUNTY EXECUTIVE TO ENTER INTO AN AGREEMENT WITH THE MONTGOMERY COUNTY AGRICULTURAL SOCIETY PROMOTING YOUTH DAYS AT THE MONTGOMERY COUNTY FONDA FAIR


II. Justification:

It is the intent of Montgomery County to provide a free local experience to the youth of Montgomery County.


III. Legislative Impact:

Pursuant to Article 3 of the Charter the Montgomery County Executive has the authority to sign contracts.
