WHEREAS, Resolution # 176 of 2017 accepted the grant funding award for the County, on behalf of the Arkell Museum, for their American Art Above Ground Storage Collection Feasibility Study project in the amount of $60,000 from the New York State Empire State Development (ESD); and
WHERAS, there will be a County share of $12,500 which will be paid by Arkell Museum, equaling a $72,500 project budget; and
WHEREAS, the county solicited RFP #05-17 and responses were received; and
WHEREAS, the Montgomery County above ground storage collection steering committee has reviewed all bids and recommends that contracts be awarded to the lowest, responsible, responsive bidder being:

II. Justification:
This will allow the County Executive to sign a contract for selected firm in aforementioned resolution.

Pursuant to Article 2 of the Charter, the Montgomery County Legislature has the power to make appropriations.
IV. Financial Impact:
Resolution is budget neutral as revenues from the grant will offset the appropriations.

RESOLUTION SCHEDULING PUBLIC HEARING – MONTGOMERY COUNTY AGRICULTURE AND FARMLAND PROTECTION PLAN (ECONOMIC DEVELOPMENT AND PLANNING)

WHEREAS, agriculture in Montgomery County is a dominant driver of the local economy; and
WHEREAS, the success of local agricultural businesses is integral to the stability of Montgomery County’s employment base; and
WHEREAS, Montgomery County was awarded a New York State Department of Agriculture and Markets grant in order to update the over fifteen year old existing Agricultural and Farmland Protection Plan; and
WHEREAS, the formulation and update of the County Agricultural and Farmland Protection Plans is an important means of supporting agricultural businesses; and
WHEREAS, the duties of the Montgomery County Agriculture and Farmland Protection Board, established in accordance with Article 25-AA, Section 302, of the New York State Agriculture and Markets Law, include assessment and approval of County Agricultural and Farmland Protection Plans; and
WHEREAS, the Montgomery County Agriculture and Farmland Protection Board has reviewed the draft County Agricultural and Farmland Protection Plan and has referred the plan to the County Legislature.
RESOLVED, the County Legislature hereby schedules a public hearing on the updated Montgomery County Agricultural and Farmland Protection Plan for December 19, 2017 at 6:55 pm in the Legislature Chambers 64 Broadway, Fonda, NY 12068; and
FURTHER RESOLVED, the Clerk of the County Legislature hereby is directed to cause legal notice of said Public Hearing to be published according to law.

I. Nature of Request:
Resolution sets a public hearing date for the update of the Montgomery County Agricultural and Farmland Protection Plan.
II. Justification:
Public Hearing is required before the updated Agricultural and Farmland Protection Plan can be adopted by the County Legislature.
III. Legislative Impact:
Article 25-AA, Section 302 of NYS Ag and Markets Law details the process for adoption of the updated Montgomery County Ag and Farmland Protection Plan.
IV. Financial Impact:

RESOLVED, the Montgomery County Legislature hereby authorizes the Fulton Montgomery Regional Chamber of Commerce and Industry (the County’s Tourism Promotion Agency) to submit an “I Love New York” Tourism Matching Funds Application, in an amount of $51,100 (projected local match of $25,500) for the County’s 2018 tourism and promotion programs.
FURTHER RESOLVED, the Montgomery County Legislature hereby authorizes the County Executive, following review and approval by the County Attorney to sign the application and any associated grant documents related to carrying out this resolution.

RESOLUTION IN SUPPORT OF APPLICATIONS THROUGH THE 2017 RESTORE NY COMMUNITIES INITIATIVE MUNICIPAL GRANT PROGRAM-EXIT 29 REDEVELOPMENT PROJECT (ECONOMIC DEVELOPMENT AND PLANNING)

WHEREAS, the Village Canajoharie and Montgomery County has an interest in revitalizing urban areas and stabilizing neighborhoods; and
WHEREAS, Montgomery County recognizes that the renewal of the these downtown areas throughout the County will strengthen the local economy and increase quality of life for residents; and
WHEREAS, the Village of Canajoharie desires to apply to the New York State Empire State Development Corporation, Restore NY Communities Initiative Municipal Grant Program to redevelop the former Beech Nut Nutrition Plant (Exit 29 Redevelopment Project) in the Village; and
WHEREAS, Montgomery County is owner of said site; and
WHEREAS, the Village of Canajoharie intends to file an application for $1 million and a special application request for $5 million dollars for the project; and
WHEREAS, the funding is a 10% minimum equity match grant program; and
WHEREAS, the administration of any grant will be completed by the Department of Economic Development and Planning.
RESOLVED, that Montgomery County, acting as governing body and owner of aforementioned site hereby supports the efforts of the Village of Canajoharie’s two application submissions for the 2017 Restore NY Communities Initiative Municipal Grant Program; and
FURTHER RESOLVED, that Montgomery County will provide the 10% equity match for the grant(s) that is required per grant regulations, in addition to the $500 application fee that is required per each grant.

I. Nature of Request:
Resolution in support of the New York State Empire State Development Corporation, Restore NY Communities Initiative Municipal Grant Program.
II. Justification:
The Restore NY Grant will provide regional benefits to the County in relation to the Exit 29 Redevelopment Project in the Village of Canajoharie.
III. Legislative Impact:
Pursuant to Article 2 of the Montgomery County Charter the Montgomery County Legislature is the legislative body of Montgomery County. Further pursuant to Article 2 of the Montgomery County Charter the Montgomery County Legislature has the authority to make appropriations.
IV. Financial Impact:
Should grant funds be awarded a cash and in kind match of 10% of the project cost will need to be allocated.

RESOLUTION FOR PROPERTY OWNER REQUEST TO BE INCLUDED WITHIN MONTGOMERY COUNTY CERTIFIED AGRICULTURAL DISTRICT 2 AND AGRICULTURAL DISTRICT 3 (ECONOMIC DEVELOPMENT AND PLANNING)

WHEREAS, Section 303-b of the New York State Agriculture and Markets Law established a mechanism on an annual basis for parcels of land comprised of predominately viable agricultural land to be included within the state’s agricultural Districts, and
WHEREAS, Section 303-b of the New York State Agriculture and Markets Law sets forth the requirement that the Legislative Body in every county in New York State with existing Agricultural Districts must designate an annual 30-day period during which landowners may apply for inclusion of their agriculturally viable land in the Agricultural Districts; and
WHEREAS, Montgomery County Legislative Resolution No. 135 of 2004 established an annual thirty-day period extending from September 1 to September 30 during which landowners may submit such requests to the Legislature to include their properties in the Agricultural Districts; and
WHEREAS, during the one-month period extending from September 1, 2017 to September 30, 2017, the Montgomery County Farmland Protection Board received two such applications on behalf of the Montgomery County Legislature; and
WHEREAS, subsequently the Agricultural and Farmland Protection Board submitted its report with recommendation as to that request to the Legislature; and
WHEREAS, after proper Notice of Public Hearing, the Montgomery County Legislature held a public hearing on November 28, 2017, with respect to the above and heard all those wishing to address the matter at said public hearing; and
WHEREAS, New York State Agriculture and Markets Law Section 303-b requires the Montgomery County Legislature, following such public hearing to adopt or reject the proposed request for inclusion of land within an existing Agricultural District; and
WHEREAS, the report and recommendations of the Agricultural Farmland Protection Board are on file with the Clerk of the Montgomery County Legislature; and
WHEREAS, the Legislature has considered the matter including the report and recommendation of the Agricultural Farmland Protection Board at the public hearing, now, therefore, be it
RESOLVED, that the Montgomery County Legislature hereby adopts the recommendations of the Agricultural and Farmland Protection Board and adopts the request of the landowner to include their land within an existing certified Agricultural District as set forth below:

II. Justification:
There has been a request from a landowner to include their 27.1 acre parcel of land within the boundaries of Agricultural District No. 3, and a request from a landowner to include their 118 acre parcel of land within the boundaries of Agricultural District No. 2
III. Legislative Impact:
Section 303-b of the New York State Agriculture and Markets Law established a mechanism on an annual basis for parcels of land comprised of predominately viable agricultural land to be included within the state’s agricultural Districts and Montgomery County Legislative Resolution No. 135 of 2004 established an annual thirty-day period extending from September 1 to September 30 during which landowners may submit such requests to the Legislature to include their properties in the Agricultural Districts.
IV. Financial Impact:
Could result in an agricultural tax exemption for both properties if they if they produce over the threshold established by Ag & Markets which is $10k annually.
