RESOLUTION ADOPTING REVISED MONTGOMERY COUNTY VEHICLE USE AND MILEAGE REIMBURSEMENT POLICY (PERSONNEL)

WHEREAS, the current policy is outdated and revisions are required; and

WHEREAS, the revised policy will allow for uniform application of the rules contained within; and

WHEREAS, this policy provides clear and concise guidance to County employees for vehicle use and mileage reimbursement. 

RESOLVED, that the Montgomery County Legislature hereby adopts the Montgomery County Vehicle Use and Mileage Reimbursement Policy as attached hereto.

Statement of Legislative and Financial Impact:

I. Nature of Request:

This policy will provide guidance to Montgomery County employees relative to the procedures to follow in Montgomery County Vehicle Use and Mileage Reimbursement.


II. Justification:

The County needs update the previous policy for employees to follow in an effort to have a clear and consistent policy and procedure.


III. Legislative Impact:

Article 2, Section 2.04 of the Montgomery County Charter states that the Montgomery County Legislature shall be the legislative, appropriating and policy-determining body of the County.


IV. Financial Impact:

No immediate financial impact to  implement this policy

RESOLUTION ACCEPTING GRANT FOR NELLISTON-FORT PLAIN BROWNFIELD OPPORTUNITY AREA PLAN AMENDING 2024 OPERATING BUDGET – NEW YORK STATE DEPARTMENT OF STATE (DOS) (ECONOMIC DEVELOPMENT & PLANNING)

WHEREAS, New York State Department of State (DOS) awarded Montgomery County with a grant for a Brownfield Opportunity Area Plan; and

WHEREAS, the County was awarded a grant in the amount of $100,350 from DOS to inventory, characterize, assess, and complete a planning and community involvement process related to brownfield revitalization in the Villages of Fort Plain and Nelliston; and

RESOLVED, the County Executive is hereby authorized to sign any documents associated with said grant funds and project, upon review and approval of the County Attorney; and

FURTHER RESOLVED, that the Montgomery County Department of Economic Development & Planning are hereby authorized to administer said grant on behalf of Montgomery County; and

WHEREAS, the Montgomery County has developed a Local Solid Waste Management Plan to satisfy the requirements of the New York State Department of Environmental Conservation (NYSDEC); and

WHEREAS, the NYSDEC has directed the Montgomery County Legislature to hold a public hearing for comments on the draft final plan; and

RESOLVED, that the County Legislature hereby schedules a Public Hearing on the Local Solid Waste Management Plan grant to be held at 5:55 pm, on October 22, 2024, in the Chambers of the County Legislature, County Office Building, Fonda, New York.

II. Justification:

As communications cost are increasing we have depleted this line. We are also looking to upgrade the IT infrastructure and software. We are able to fund these items with our 2024 budget due to changing the direction we are taking to update the firewall.


III. Legislative Impact:

Pursuant to section 2.04(b) of the charter the Montgomery County Legislature has the power to make appropriations.


IV. Financial Impact:

Funds are being tranfered within the current Data Processing budget.

RESOLUTION AWARDING CONTRACTS FOR REHABILITATION OF 1 VENNER ROAD PROJECT FOR HEALTH AND HUMAN SERVICES OFFICE PHASE II (PUBLIC WORKS)

WHEREAS, the County has implemented a building plan at 1 Venner Road to occupy all Health & Human Services Employees; and

WHEREAS, Resolution No. 98 of 2024, authorized for funding of beginning stage of Phase II; and

WHEREAS, on Thursday, June 27, 2024, construction documents were released for prime bids and said bids were received and read aloud on Thursday July 25, 2024; and

WHEREAS, the Commissioner of Public Works recommends, along with the architect for the project, whose Recommendation Letter of Award is incorporated herein, prime contracts be awarded to lowest responsible responsive bidders.

RESOLVED, the Montgomery County Legislature hereby awards General Construction Contract to West Winds General Construction of Pattersonville, New York, in an amount not to exceed $2,366,300.00.

FURTHER RESOLVED, the Montgomery County Legislature hereby awards Plumbing Contract to Tri-Valley Plumbing and Heating, Inc., of Schenectady, New York, in the amount not to exceed $227,400.00.

FURTHER RESOLVED, the Montgomery County Legislature hereby awards Electrical Contracr to A. Treffeisen & Sons LLC of Oneonta, New York, in the amount not to exceed $448,300.00.

FURTHER RESOLVED, the Montgomery County Legislature hereby awards Mechanical Contract to RMB Mechanical of Schenectady, New York, in the amount not to exceed $559,500.00.

FURTHER RESOLVED, the Montgomery County Legislature hereby awards Fire Protection Contract to Condor Fire Sprinkler of Schenectady, New York, in the amount not to exceed $130,700.00.

FURTHER RESOLVED, that the County Executive, upon review and approval of the County Attorney, is authorized and directed to sign contracts.

I. Nature of Request:

Award bids and sign contracts for work associated with the rehabilitation of 1 Venner Road in Amsterdam.


II. Justification:

The County Legislature, by Resolution 98 of 2024, authorized the expansion of 1 Venner Road property in Amsterdam, New York, for the purpose of relocating Montgomery County's Health and Human Services Department to better serve the public.


III. Legislative Impact:

Pursuant to Article 2 of the Montgomery County Charter, the Legislature has the authority to approve bids and authorize the County Executive to sign contracts.


IV. Financial Impact:

* Project was partially funded by Resolution 98 of 2024 $1,750,000.00

* Project will require future funding in the amount of $1,982,200.00

* Total project not to exceed amount totals $3,732,200.00

Montgomery County DPW is responsible to maintain Road Striping on certain roads.

Transfer is needed to complete Road Striping operations for the 2024 season.


III. Legislative Impact:

Pursuant to Article 2 of the Montgomery County Charter, the Legislature has the authority to make appropriations.


IV. Financial Impact:

Fund Balances will be reduced by $75,000.00 for required work.

Additional funds are requested in 2025 Operating Budget.

I. Nature of Request:

To accept pass through funding as per NYS OMH.


II. Justification:

To accept and utilize funds through state aid letter funding end date of December 31, 2024.

Purusant to Article 2 of the Charter of the Montgomery County Legislature has the power to make appropriations.


IV. Financial Impact:

WHEREAS, by Resolution 153 of 2024, the Department of Public Works held the County's Annual Surplus Equipment Auction, raising $61,024.50 in revenues; and

WHEREAS, by Resolution 184 of 2024, it was established that $10,800.00 of that revenue was to be placed in revenue line A-18-3-2665 for the Department of Social Services after the sale of two vehicles; and

WHEREAS, the Department of Social Services would like to use this money to assist with the purchase of a new vehicle for transporting clients and staff, in addition to ARPA funding received; and be it

RESOLVED, the County Treasurer is hereby authorized and directed to amend the 2024 Operating Budget as follows:

Statement of Legislative and Financial Impact:

I. Nature of Request:

Amending the 2024 Operating Budget


II. Justification:

Two vehicles sold in the spring of 2024 were that of the Department of Social Services and funds were deferred to be deposited in the 2024 Operating Budget to assist with replacing one of those vehicles. 


III. Legislative Impact:

Pursuant to Article 2 of the Montgomery County Charter, the Legislature has the power to make appropriations.


IV. Financial Impact:

In Resolution 184 of 2024, the 2024 Operating Budget was amended to reflect an increase in revenue line A-18-3-2665, the department is now requesting to increase the Motor Vehicle Equipment appropriation line A-18-4-6010-00-2230 in order to assist with the purchase of another vehicle to replace one of the two sold in the spring auction.

RESOLUTION AUTHORIZING THE COUNTY EXECUTIVE TO SIGN AN AGREEMENT WITH THE CITY OF AMSTERDAM (SOCIAL SERVICES)

WHEREAS, Social Services districts may provide, and require applicants for and recipients of public assistance to participate in a variety of activities that include work experience in the public or non-profit sector; and

WHEREAS, a state or federal government institution, a municipality, a public agency, or a public or private non-profit entity desiring to provide work experience for recipients of public assistance under an agreement complying with provisions of law and regulations is defined as a "Sponsor"; and

WHEREAS, the City of Amsterdam is desirous of continuing their status as a Sponsor for Montgomery County DSS's Work Experience Program; and, be it

RESOLVED, that the County Executive, upon review and approval of the County Attorney, is hereby authorized and directed to sign a contract with the City of Amsterdam to provide work experience for recipients of public assistance for the period of October 1, 2024 through September 30, 2025.

I. Nature of Request:

Authorizing the County Executive to sign an agreement with the City of Amsterdam.


II. Justification:

This contract will help provide unpaid work experience at a municipality to enable participants who cannot find unsubsidized employment to improve their employability. 


III. Legislative Impact:

Pursuant to Article 3 of the Charter, the Montgomery County Executive has the authority to sign contracts.


IV. Financial Impact:

There is no financial impact, as the work experience provided in unpaid.

RESOLUTION ACCEPTING HEAP INFRASTRUCTURE ADMINISTRATIVE FUNDS AND AMENDING THE 2024 OPERATING BUDGET (SOCIAL SERVICES)

WHEREAS, each year Social Services Districts receive administrative funds to support Home Energy Assistance Program (HEAP) operations; and

WHEREAS, part of that funding includes Infrastructure Administrative funds that are available to States under the Infrastructure Investment and Jobs Act for LIHEAP (Low Income Home Energy Assistance Program) as supplemental funding; and

WHEREAS, acceptable uses of the Infrastructure administrative funds include but are not limited to equipment purchases to aid in the administration of HEAP; and

WHEREAS, the Department of Social Services has been allocated $3,992 for the above mentioned funds; and

WHEREAS, the funds allocated to the department must be obligated by September 30, 2024; and be it

RESOLVED, the County Treasurer is hereby authorized and directed to amend the 2024 Operating Budget as follows:

Accepting HEAP Infrastructure Administrative funds and amend the 2024 Operating Budget.


II. Justification:

Funds will be used in order to reimburse the purchase of computer and office equipment for our HEAP unit.

Pursuant to Article 2 of the Charter, the Montgomery County Legislature has the authority to make appropriations.


IV. Financial Impact:

There will be no cost to the County, as it is 100% award funded.

RESOLUTION AUTHORIZING THE COUNTY EXECUTIVE TO RENEW A CONTRACT WITH VENTEK, INC. (SOCIAL SERVICES)

WHEREAS, the Department of Social Services is required to sign authorizations for services on a daily basis; and

WHEREAS, the Department is requesting authorization to renew the contract with VenTek, Inc. for their electronic application that assists in the tracking of case reviews and electronic approval/signature program, which eliminates the printing and manual signing of the LDSS-3209 authorization; and

WHEREAS, the agreement is for the term of 3 years from November 1, 2024 through October 31, 2027; and

RESOLVED, this contract is for a support/maintenance fee of $2,665.00 annually, totaling $7,995.00 for the three-year term.

FURTHER RESOLVED, that the County Executive, upon review and approval of the County Attorney, is authorized to execute the agreement with VenTek, Inc. for the contract period of 3 years in the amount of $2,665.00 annually, $7,995.00 total.

Statement of Legislative and Financial Impact:

I. Nature of Request:

The Department of Social Services is requesting the County Executive to sign a contract with VenTek, Inc. for a three-year period.


II. Justification:

This contract eliminates the manual process of signing forms and provides important information to assist supervisors and workers in managing their workloads. 


III. Legislative Impact:

Pursuant to Article 3 of the Charter, the Montgomery County Executive has the authority to sign contracts.


IV. Financial Impact:

The fee for the contract is $2,665 annually, $7,995 total for the three-year period. This is a $90 increase annually from the previous contract period 11/1/21-10/31/24.

RESOLUTION ACCEPTING ADDITIONAL AMERICAN RESCUE PLAN ACT FUNDING (SOCIAL SERVICES)

WHEREAS, per resolution 21 of 2023, the Department of Social Services had received federal funds through the American Rescue Plan Act: Grants to Enhance Adult Protective Services administered by the Administration for Community Living (ACL); and

WHEREAS, per resolution 170 of 2024, the department had requested and been approved for additional funding administered by OCFS in the amount of $25,000, in one-time funding from the American Rescue Plan Act (ARPA) – Grant #2; and

WHEREAS, resolution 188 of 2024 authorized the amendment of the 2024 Operating Budget to place all ARPA funds received into DSS's Motor Vehicle Equipment line after determining from a list of allowable identified expenditures that our Adult Protective Unit is in need of an additional vehicle to transport clients and staff; and

WHEREAS, the department has made a further request to OCFS and has been granted an additional $20,000 through ARPA funding to cover the remaining cost of the vehicle; and 

WHEREAS, all funds allocated through the American Rescue Plan Act: Grants to Enhance Adult Protective Services must be used by September, 30, 2024; and.

NOW, THEREFORE BE IT RESOLVED, that the Montgomery County Legislature hereby authorizes the acceptance of the additional $20,000 American Rescue Plan Act funding.

FURTHER RESOLVED, the County Treasurer is hereby authorized and directed to amend the 2024 Operating Budget as follows:

WHEREAS, the Department of Social Services continues to see an increase in need for various services, such as the Child Care (Physically Handicapped Children) Program; and

WHEREAS, the department requires additional funding for the remainder of the year for the above mentioned program; and

WHEREAS, the programs that come out of the State Training School line have cost less than anticipated this year; and

WHEREAS, the department requests transferring funds from the State Training School line in the 2024 budget to cover the costs in the Physically Handicapped Children's Main Program.

RESOLVED, that the County Treasurer is hereby authorized and directed to amend the 2024 Operating Budget as follows:

Statement of Legislative and Financial Impact:

I. Nature of Request:

Amending the 2024 Operating Budget


II. Justification:

These expenses are necessary to stay within budget for 2024. Due to final chargeback rates being lower than estimated for Calendar Year 2022 (OCFS bills counties two years in arrears), the department is able to utilize money budgeted within the State Training School line to assist with the increase in fees and expenses associated with the PHC Program. The PHC Program requires a specific placement for youth where there was an unanticipated increase in the daily rate for said program. 


III. Legislative Impact:

Pursuant to Article 2 of the Charter, the Montgomery County Legislature has the power to make appropriations.


IV. Financial Impact:

There is no financial impact as this money is budgeted and just moved within current lines. The department saw final rates of the care provided to youths placed in facilities and programs operated by OCFS decrease which allows us to transfer the budgeted funds to the PHC program, where the department had a new admission with higher than anticipated rates per day from the previous school year.

RESOLUTION AMENDING RESOLUTION 264 OF 2022 - AMERICAN RESCUE PLAN FUNDING (LEGISLATURE)

WHEREAS, Montgomery County received American Rescue Plan funds; and

WHEREAS, Resolution 264 of 2022 granted $72,000 to the Fort Plain Senior Center for a new roof; and

WHEREAS, the Fort Plain Senior Center has identified a different project it would like to use the funding for that does not require as much money.

NOW THEREFORE BE IT RESOLVED, that the Montgomery County Legislature amends Resolution 264 of 2022 by replacing $72,000 with $45,000 throughout the resolution in its entirety and by replacing "kitchen renovations" with "flooring and roofing for the whole facility and an industrial kitchen sink" throughout the resolution in its entirety.

WHEREAS, the Montgomery County Department of Social Services is required to conduct at least one public hearing during the development of and prior to the submission of the 2024-2029 Children and Family Services Plan; and

WHEREAS, the goal of the public hearing is to inform the community of the services available in the county and how they can be accessed as well as to allow the public to raise issues and offer ways to improve the delivery and provision of services in the county; and

WHEREAS, the plan is due for submission to the Office of Children and Family Services on November 1, 2024; and

WHEREAS, the plan cannot be submitted until 15 days after the public hearing; and

WHEREAS, the law requires that the public hearing be held after a 15 day notice is provided in a newpaper of general circulation in the county; and

WHEREAS, the notice of the public hering must be provided by October 1,2024 so that the hearing can be conducted on October 16th, 2024.

RESOLVED, that the Montgomery County Legislature hereby schedules a Public Hearing on the Children and Family Services  Plan to be held at 4:00 p.m. on Wednesday, October 16, 2024 at the Department of Social Services building at 1 Venner Rd, Amsterdam, N.Y., and

FURTHER RESOLVED, the Clerk of the County Legislature hereby is directed to cause legal notice of said Public Hearing to be published according to law.

WHEREAS, in accordance with the Workforce Innovation and Opportunity Act of 2014 (WIOA) (P.L. 113-128) , the Counties of Fulton, Montgomery, and Schoharie entered into an agreement as described in WIOA to organize and implement activities pursuant to WIOA and in accordance with requirements established by the Governor of the State of New York (Governor) for purposes of implementing programs and services under WIOA; and

WHEREAS, the membership of the WDB shall be appointed by the Chief Local Elected Officials (CLEO); and

WHEREAS, each CLEO shall appoint an equal number of Workforce Development Board members; and

WHEREAS, there shall be four public sector and five private sector members appointed by each CLEO pursuant to the 2015 CLEO bylaws; and

WHEREAS,  all of the mandatory representatives listed under WIOA Section 107 will be represented; and

WHEREAS, those representatives include:

A majority who are owners, CEO's or COO's and respresent business with employment opportunities that include high quality work relevant training and development;

At least 20% of members represent labor organizations as set forth in WIO Section 107;
