WHEREAS, in 2022, the Department of Public Works initiated a drainage and road improvement study of County Route 110, Logtown Rd, in the Town of Root; and
WHEREAS, for improving County infrastructure and for the safety of the County residents, road improvements are necessary; and
WHEREAS, design was completed and project was relased for bid and bids were opened on February 23, 2023 with the following results:

WHEREAS, GPI Engineering has reviewed all bids and has recommended the project be awarded to Carver Contruction of Coeymans, New York, for an amount not to exceed $658,145.00; recommendation letter attached.
RESOLVED, the Montgomery County Legislature hereby authorizes the County Executive, upon review and approval of the County Attorney, to sign the contract with Carver Construction, Coeymans, New York, for an amount not to exceed $658,145.00.

I. Nature of Request:
Authorizing County Executive to sign contract agreement for drainage and improvements of Logtown Rd, County Route 110, in the Town of Root, with Carver Construction.
II. Justification:
Culvert pipes need to be replaced and the roadway needs to be raised to elevate travel lanes higher than NYS listed Wetlands and to make highway safer to residents
III. Legislative Impact:
Pursuant to Article 3 of the Montgomery County Charter, the County Executive has authorization to enter into contracts.
IV. Financial Impact:
Project is 100% reimbursable through CHIPS Program funds.

WHEREAS, by Resolution 94 of 2022, Montgomery County is responsible for maintaining approximately 40 miles of Canalway Trail owned by NYS Parks & Recreation; and
WHEREAS, one of the obligations for maintenance is mowing and weed eating the trail system; and
WHEREAS, the Commissioner of DPW has determined it to be a savings to Montgomery County to hire the grass and weed control as a result of RFP 05-23; and
WHEREAS, on March 14, 2023 proposals were received and opened and Miller Excavating & Landscape of Amsterdam was the lowest most responsible responsive bidder with the following bid results:

II. Justification:
Per Resolution 94 of 2022, Montgomery County is responsible for maintaining the Canalway Trail.
RFP's were solicited for and received on 3/14/23 - RFP 05-23
III. Legislative Impact:
Pursuant to Article 3 of the County Charter, the County Executive is authorized to enter into contracts.
IV. Financial Impact:
*Cost for Montgomery County to maintain the Canalway Trail are in excess of $70,000.00 per year for labor and equipment
*Montgomery County will realize a savings of over $20,000.00 by awarding contract to private maintenance company
*Funds are allocated for in the 2023 Operating Budget
*No impact to fund balance

WHEREAS, Montgomery County contracts for grass and brush control with the ten towns, the City of Amsterdam, and the Village of St. Johnsville on county roads; and
WHEREAS, the current contract is due to expire for such services and there is a need to renew the contract for Grass and Brush Control on County Roads;
RESOLVED, pursuant to Section 135A of the Highway Law, Montgomery County Legislature hereby authorizes and directs the County Executive, upon review by the County Attorney, to enter into agreements with the ten towns located within Montgomery County; the City of Amsterdam, and the Village of St. Johnsville for provision of grass and brush control on county roads; and
FURTHER RESOLVED, payment for work to be performed under the terms of said agreement for grass and brush control shall be at a rate of $400.00 per center line miles for the contract year June 1, 2023 through May 31, 2024 at a total cost of $157,912.00 to the County Road Fund.

I. Nature of Request:
For authorization allowing the County Executive to enter into contracts with the ten towns, the City of Amsterdam, and the Village of St. Johnsville, for the purpose of grass and brush control on 398.4 miles of county roads for the period of one year - June 1, 2023 through May 31, 2024.
II. Justification:
The current contract with the ten towns, the City of Amsterdam, and the Village of St. Johnsville is due to expire.
There is a need for grass and brush control on county roads for maintenance and safety reasons.
III. Legislative Impact:
Pursuant to Article 3 of the Montgomery County Charter, the County Executive has the authority to enter into contracts.
IV. Financial Impact:
Appropriations for the contract are included in the 2023 Operating Budget. This is not an increase from previous contract.

WHEREAS, currently there is a Wastewater Treatment Plant Operator vacancy in the Montgomery County Sanitary District No.1 ; and
WHEREAS, efforts to recruit for this position has proven difficult to produce a certified 2A Operator; and
WHEREAS, the Superintendent of the Montgomery County Sanitary District No. 1 has evaluated the needs of District with the support of the District Board and determined that a Wastewater Treatment Plant Operator Trainee would meet the needs of the District and would give a candidate the opportunity to train to become a certified operator while learning the position; and
RESOLVED, the Montgomery County Legislature hereby establishes the position of Wastewater Treatment Plant Operator Trainee, Group O in the Non-Bargaining Personnel Policy with a base salary of $43,725; and
FURTHER RESOLVED, the County Treasurer is hereby authorized and directed to amend the 2023 District operating budget as follows:

I. Nature of Request:
AMENDING 2023 OPERATING BUDGET - ESTABLISHING A WASTEWATER TREATMENT PLANT OPERATOR TRAINEE
II. Justification:
The Department had an employee resign in November 2022. Months of advertisements have not produced any viable candidates for the WW Treatment Plant Operator position. The Superintendent and District Board recommends advertising for an Operator Trainee to help meet the needs of the District.
III. Legislative Impact:
Pursuant to Articles 2 and 3 of the Montgomery County Charter the Legislature has to power to establish positions and make amendments.
IV. Financial Impact:
Cost savings to the District.
