WHEREAS, the Sheriff has received donations recently from different locations; and

WHEREAS,   All said donations are supplied for use by the Sheriff's Office to benefit staff, the office and the community; and

WHEREAS, gifts and donations have been made to the Sheriff’s Office to supplement already budgeted money to completely cover the cost of listed appropriations.

RESOLVED, that the County Treasurer hereby is authorized and directed to amend the 2023 Operating Budget as follows:

Statement of Legislative and Financial Impact:

I. Nature of Request:

RESOLUTION AMENDING THE 2023 OPERATING BUDGET - GIFTS AND DONATIONS (SHERIFF)


II. Justification:

The Montgomery County Sheriff’s Office has received $25,100.00 in donations to be used to benefit the office and community.  The items that will be purchased are a new LPR (License Plate Reader), flotation coats and various uniform items for staff.  The LPR will replace one that recently stopped working, the coats and uniforms will assist our special operations unit.


III. Legislative Impact:

Pursuant to section 2.04 (b) of the charter the Montgomery County Legislature has the power to make appropriations.


IV. Financial Impact:

No financial impact, all of this money was donated to the Sheriff's Office

WHEREAS, the Sheriff has been awarded a grant totaling $740,231.000 from the 2021-2022 SICG Statewide Interoperable Communications Grant Program; and

WHEREAS, the funding has been approved by the State to make improvements pertaining to our Emergency Communications System.  This includes Fire, EMS, Law Enforecment, DPW and our Schools.

WHEREAS, the equipment being purchased is an upgrade and compatible with our current system.

RESOLVED, the Montgomery County Executive is authorized and directed to sign necessary paperwork to accept the grant totaling $740,231.00 from the 2021-2022 SICG Statewide Interoperable Communications Grant Program; and

RESOLVED, the Montgomery County Treasurer is hereby authorized and directed to amend the 2023 Operating Budget as follows:

Statement of Legislative and Financial Impact:

I. Nature of Request:

RESOLUTION AMENDING THE 2023 OPERATING BUDGET - 2021-2022 STATEWIDE INTEROPERABLE COMMUNICATIONS GRANT PROGRAM (SHERIFF)


II. Justification:

The 2021-2022 SICG Grant will support the purchase of a new building site at Sanders Road for our Radio System, it will upgrade our current tower at Oak Ridge, construct a new tower a Lattimer Hill Raod and purchase mobile and portable radios.

We continue to use grant money for items of necessity, however items that we can purchase without using county funds. 


III. Legislative Impact:

Pursuant to section 2.04 (b) of the charter the Montgomery County Legislature has the power to make appropriations.


IV. Financial Impact:

There is no financial impact for this resolution request as this grant is a zero match, however it does allow us to purchase necessary equipment at this time without the use of any county funds!

WHEREAS, the Sheriff's Office/Emergency Services has been notified by the New York State Division of Homeland Security and Emergency Services that Montgomery County has been awarded $102,428.00, with no County match, to assist in law enforcement/Emergency Services operations throughout Montgomery County; and

WHEREAS, the Montgomery County Legislature hereby authorizes the acceptance of the FY2022 State Homeland Security Program (SLETPP)(SHSP)Grant; and

RESOLVED, the Montgomery County Legislature hereby authorizes and directs the County Executive, following review and approval of the County Attorney to sign the agreement for FY2022 State Homeland Security Program (SLETPP)(SHSP) Grant.

II. Justification:

The Sheriff's office and Emergency Services has for years received grant monies from the State to enhance our ability to serve the residents of Montgomery County.  The purchases set forth in this years grant will support Fire, EMS and Law Enforcement across the entire county.  Some of it is geared towards response, other parts are for operations, safety and intelligents gathering.

All of these items have been determined as needs based from experiences from prior inicdents.


III. Legislative Impact:

Pursuant to Article 2 of the Charter the County Legislature has the authority to make appropriations. According to Article 3 of the Charter the County Executive has the authority to sign contracts.


IV. Financial Impact:

There is no financial impact for this resolution as it is a 100% no match grant provided to our agencies.

WHEREAS, $2,044.93 was unable to be used during the 2022 fiscal year; and

WHEREAS, it is necessary to add $2044.93 to the 2023 Operating Budget.

RESOLVED, that the Montgomery County Treasurer is hereby authorized and directed to amend the 2023 Operating Budget as follows:

I. Nature of Request:

Resolution to carryover 2022 forfeiture money to the 2023 budget for expenditure.


II. Justification:

The forfeiture money received in 2022 and was used to purchase equipment for law enforcement agencies in Montgomery County and the balance of $2044.93 was unable to be used prior to the end of 2022.  We request a resolution to be passed to carry over this money to the 2023 budget for expenditure.


III. Legislative Impact:

Pursuant to Section 2.04(b) the County Legislature has the power to make appropriations.


IV. Financial Impact:

Budget neutral.  Amount received would be the same amount appropriated.

Statement of Legislative and Financial Impact:

I. Nature of Request:

To use forfeiture money from drug related prosecutions in Montgomery County to purchase equipment and provide money for training to law enforcement agencies throughout Montgomery County without any cost to Montgomery County.  Forfeiture money deposits totalling $1,241.67 have been deposited into Revenue Line .2626 in 2022 but never placed in Expenditure Line .4522.


II. Justification:

Law enforcement agencies benefit from purchases made using forfeiture monies for equipment and training that they would otherwise not have available to them.  Said funds were placed in Revenue in 2022 but never placed in Expediture line.


III. Legislative Impact:

Pursuant to Article 2 of the Charter, the Montgomery County Legislature has the power to make appropriations.


IV. Financial Impact:

None.  Forfeiture monies deposited will offset expenditures.
