Chairman Roy S. Dimond  has called a meeting of the Public Safety Committee for 6:00 p.m. on Tuesday, June 17, 2022 in the Legislative Chambers, County Office Building, 64 Broadway, Fonda, New York 12068.

RECOMMENDATION:
     

RESOLUTION AMENDING THE 2022 OPERATING BUDGET FOR INCREASE IN COURT RELATED EXPENSES (DISTRICT ATTORNEY)

WHEREAS, the District Attorney has requested additional funds for court related expenses to secure temporary assistance for the processing of traffic ticket reductions and transcription of inmate calls pertinent to prosecution of criminal cases in Montgomery County; and

WHEREAS, said traffic ticket processing and transcription of inmate calls is unable to be accomplished using current employees due to other obligations with regard to new discovery laws taking precedence, and that an independent contractor will be used for such tasks, it is

RESOLVED, that the County Treasurer is hereby authorized and directed to amend the 2022 Operating Budget as follows:

 A-30-4-1990.00-.4400 Contractual Expenses - Contingency Account  $30,000.00 
     
TRANSFER TO:     
A-25-4-1165-00-.4433  Court Related Expenses   $30,000.00

Statement of Legislative and Financial Impact:

I. Nature of Request:

Pursuant to Article 2 of the Charter, the Montgomery County Legislature has the authority to amend the 2022 Operating Budget.


II. Justification:

This request is being made due to the large volume of backlog with regard to traffic reduction requests that need to be processed while current personnel are prioritizing their time to comply with the time constraints under the new discovery law demands.  In addition, this request is being made to have an independent contractor handle the backlog of traffic as well as be utilized to listen to telephone calls made by inmates and extract important information relative to pending criminal prosecutions.


III. Legislative Impact:

Pursuant to Article 2 of the Charter, the Montgomery County Legilsature has the authority to amend the 2022 Operating Budget.


IV. Financial Impact:

This increase in court related expenses will be paid for by using contingency fund.

WHEREAS, the District Attorney has requested that an additional full-time Assistant District Attorney position be established to meet the demands of the office; and

WHEREAS, that a position of full-time Assistant District Attorney is hereby established in the District Attorney's office at a base pay rate of $81,068.00, Group J of the Non-Bargaining Personnel Policy; and

RESOLVED, that the County Treasurer is hereby authorized and directed to amend the 2022 Operating Budget as follows:

Statement of Legislative and Financial Impact:

I. Nature of Request:

To create a full-time Assistant District Attorney position to meet the demands of the office using contingency funds.


II. Justification:

This request is being made due to the demands of the office for increase in caseload as well as new changes in law pertaining to discovery rules and bail reform making it necessary to add another full-time attorney to the office.


III. Legislative Impact:

Pursuant to Article 2 of the Charter, the Montgomery County Legislature has the authority to establish positions of employment.


IV. Financial Impact:

This position will be paid for by using contingency fund.  Fringe is based on tier 6 with family plan with dental and vision.  This final fringe amount will vary based on the candidate.
