Chairman Roy S. Dimond has called a meeting of the Public Safety Committee for 6:03 p.m. on Tuesday, March 15, 2022 in the Legislative Chambers, County Office Building, 64 Broadway, Fonda, New York 12068.

RESOLUTION APPOINTING MEMBERS - MONTGOMERY COUNTY ARSON ADVISORY BOARD (EMERGENCY MANAGEMENT)

WHEREAS, Article 10, Section 204-C of General Municipal Law provides for each County to create a plan for arson investigation which will be submitted to the NYS Office of Fire prevention and Control; and
WHEREAS, the Montgomery County plan calls for the creation of an Montgomery County Arson Advisory Board; and
WHEREAS, it is necessary to update the members of the Montgomery County Arson Advisory Board.
RESOLVED, that the following are hereby appointed as members of the Montgomery County Arson Advisory Board:

I. Nature of Request:
Resolution appointing members to the Montgomery County Arson Advisory Board.
II. Justification:
Terms have expired and new appointments need to be made.
III. Legislative Impact:
Article 10, Section 204-C of General Municipal Law provides for each County to create a plan for arson investigation which will be submitted to the NYS Office of Fire prevention and Control. The Montgomery County plan created this board. Pursuant to Article 2 of the Montgomery County Charter the Montgomery County Legislature has the authority to confirm appointments.

RESOLUTION AMENDING 2022 OPERATING BUDGET - ESTABLISHING FULL TIME POSITION (PUBLIC DEFENDER)

WHEREAS, Resolution 252 of 2021 accepted the NYS Indigent Legal Services Grant (ILS): State Wide Hurrell-Harring; and
WHEREAS, the position approved by said grant is for an additional Assistant Public Defender (FT) in the Public Defender's Office; and
WHEREAS, the Public Defender requests that the position of Assistant Public Defender (FT) be created to fulfill the position of said grant; and
WHEREAS, the ILS grant is expected to last three years and is not expected to have any cost to the County; and
WHEREAS, the established base salary for Assistant Public Defender (FT) is $81,068 in Non Bargaining Group J.
RESOLVED, that the Montgomery County Legislature hereby establishes the additional position of Assistant Public Defender (FT) within the Public Defender's Office (Non Bargaining group J) to perform the needed duties in the Public Defender's Office required by the State Wide Hurrell-Harring grant.
FURTHER RESOLVED, that the Montgomery County Legislature hereby authorizes and directs the Montgomery County Treasurer to Amend the 2022 Operating Budget as follows:

I. Nature of Request:
Establish additional FT Assistant Public Defender Attorney and amend the 2022 operating budget
II. Justification:
To establish additional position in order to utilize grant funds needed, and therefore enhance the services provided to the Montgomery County Indigents by the Public Defender's Office.
III. Legislative Impact:
Pursuant to Article 2 of the Charter, the County Executive has the authority to create positions of employment.
IV. Financial Impact:
No financial impact to the County. Increased appropriations are completely offset by grant funding.

RESOLUTION AUTHORIZING COUNTY EXECUTIVE TO SIGN NYS INDIGENT LEGAL SERVICES CONTRACT: DISTRIBUTION 12 (PUBLIC DEFENDER)

WHEREAS, the Montgomery County Public Defender has been advised by NYS ILS that a grant has been awarded to the Public Defender's Office to improve the quality of service provided to indigents of Montgomery County; and
WHEREAS, the total amount of Grant: Distribution 12 is $111,384, with a three-year distribution of $37,128 per year; and
WHEREAS, the funds can only be used for the Public Defender's Office as set forth within contract.
RESOLVED, that the Montgomery County Legislature hereby authorizes the County Executive, upon review and approval of the County Attorney, to accept and sign said contract.

WHEREAS, the Montgomery County STOP-DWI program continues to work collaboratively with all police agencies in an effort to help keep Montgomery County's roadways safe; and
WHEREAS, the Montgomery County STOP-DWI program has been awarded additional High Visibility Engagment Campaign (Crackdown) funds in the amount of $5,500 for use in Montgomery County for sobriety checkpoints and/or additional roving patrols during the grant cycle October 1, 2021 through September 30, 2022.
NOW, THEREFORE BE IT RESOLVED, the County Treasurer is hereby authorized and directed to amend the 2022 Operating Budget as follows:
