Chairman Roy S. Dimond has called a meeting of the Personnel Committee for 6:04 p.m. on Tuesday, June 15, 2021 in the Legislative Chambers, County Office Building, 64 Broadway, Fonda, New York 12068.
In conjunction with Governor Cuomo’s Executive Order, this meeting will also be held electronically via teleconference on June 15, 2021 at 6:04 pm. RESOLUTION AMENDING THE 2021 OPERATING BUDGET FOR THE DISTRICT ATTORNEY AND COUNTY SHERIFF ESTABLISHING A FULL-TIME NETWORK SYSTEMS ADMINISTRATOR AND ELIMINATING A MICROCOMPUTER TECHNICIAN (DISTRICT ATTORNEY)

WHEREAS, it is necessary that a Network Systems Administrator (FT) position be established in the office of the Montgomery County District Attorney; and
WHEREAS, this position will be shared with the Montgomery County Sheriff's Department to meet the needs of both offices with regard to all computer related administration, requirements and server and systems management; and
WHEREAS, this position will replace and eliminate the Micro Computer Technician (PT) position that was established under Resolution No. 59 of 2021; and
WHEREAS, the approximte funds remaining on the Micro Computer Technician line in the amount of $20,244.12 shall be transferred to the Network Systems Administrator line; and
WHEREAS, the remaining funds necessary for the base salary in the amount of $8,606.856 shall be transferred from the Criminal Justice Discovery Reform Grant already received by the County Treasurer; and
WHEREAS, in future budgets, funds will be allocated from each budget of the Sheriff and the District Attorney to fund said position; and
RESOLVED, that the Montgomery County Legislature hereby establishes the position of Network Systems Administrator with an annual salary of $62,130 which will contractually increase July 1, 2021 to $62,751.00 equivalent to Grade Q in the CSEA Bargaining Agreement in the District Attorney's office who will share said position with the Montgomery County Sheriff's Office; and
RESOLVED, that the Micro Computer Technician (PT) position is hereby eliminated; and
FURTHER RESOLVED, the Montgomery County Legislature hereby authorizes and directs the Montgomery County Treasurer to amend the 2021 Operating Budget as follows:

I. Nature of Request:
To create a full time Network Systems Administrator in the Office of the District Attorney to be shared with the Office of the Sheriff.
II. Justification:
This increase in the Part-Time position to a full time position at a higher skill level is necessary to meet the escalating demands of the offices due to bail reform and increasing crime rates that in turn have significantly increased the demands of these offices relating to all aspects of computer technology, management, administration and networking.
III. Legislative Impact:
Pursuant to Article 2 of the Montgomery County Charter, the Montgomery County Legislature has the authority to create positions of employment and appropriate funds.
IV. Financial Impact:
Funding will use fund balance and funds from the prior position.

RESOLUTION AMENDING THE 2021 OPERATING BUDGET AND ESTABLISHING THE POSITION OF FIRST ASSISTANT DISTRICT ATTORNEY (FT)(DISTRICT ATTORNEY)

WHEREAS, the District Attorney has reviewed the structure of the Department and has determined that the establishment of a full time First Assistant District Attorney is necessary to meet the demands of the office, to assist with management and administrative responsibilities of the District Attorney office and to carry out decision making authority in the absence of the District Attorney; and
WHEREAS, said position is consistent with the Office of the District Attorney in other counties as well as within the Montgomery County Public Defender's office; and
WHEREAS, the District Attorney met with the Personnel Officer and it was determined that the duties within the title of First Assistant District Attorney are appropriate to meet the needs of the Department as such, the title is certified in accordance with Civil Service law Section 22.
WHEREAS, an amount sufficient to cover the fringe benefits was previously transferred under Resolution No. 58 2021; and
RESOLVED, that the position of full-time First Assistant District Attorney is hereby established in the Office of the District Attorney at base pay rate of $98,000.00 with a pro-rated base pay amount for the remainder of 2021 of $45,058.00, Group L of the Non-Bargaining Personnel Policy; and
FURTHER RESOLVED, that the County Treasurer is hereby authorized and directed to amend the 2021 Operating Budget as follows:

I. Nature of Request:
Establishing the Position of First Assistant District Attorney.
II. Justification:
This request is made to bring the office in compliance with County Law, to be consistent with other county District Attorney's offices statewide as well as the Montgomery County Public Defender's office; and to meet the escalating demands of the office of the District Attorney.
III. Legislative Impact:
Pursuant to Article 2 of the Charter, Montgomery County Legislature has the power to make appropriations and establish positions.
Pursuant to New York County Law Section 702(4), the District Attorney shall designate in writing and file in the office of the county clerk and clerk of the board of supervisors the order in which such assistants shall exercise the powers and duties of the office in the event of a vacancy or the absence or inability of such district attorney to perform the duties of the office.
IV. Financial Impact:
The funds will be transferred from the lines 1292 and 66 and will have to be budget for in future budget years. Estimated total cost of the position with fringe moving forward will be $151,760 a year.

WHEREAS, the District Attorney has requested that a full-time Law Clerk position be established to meet the demands of the office; and
WHEREAS, the funding will be transferred from the Criminal Justice Discovery Reform Grant already received by the Treasurer; and
WHEREAS, the District Attorney met with the Personnel Officer and it was determined that the duties within the title of Law Clerk would meet the needs of the Department as such, the title is certified in accordance with Civil Service law Section 22.

I. Nature of Request:
To create a full-time Law Clerk position to meet the escalating demands of the office using funds received from existing grant funding.
II. Justification:
This request is being made due to the escalating demands of the office pursuant to an increase in caseload, increase in discovery rules and demands, bail reform and backlog; making it necessary to add a Law Clerk.
III. Legislative Impact:
Pursuant to Article 2 of the Charter, Montgomery County Legislature has the power to make appropriations.
IV. Financial Impact:
The position will be paid for by using existing grant funding received. Fringe is based on tier 6 with family plan with dental and vision. This fringe amount may vary based upon the candidate.
