Chairman Robert Headwell, Jr. has called a meeting of the Budget & Finance Committee for 6:04 p.m. on Tuesday, May 18, 2021 in the Legislative Chambers, County Office Building, 64 Broadway, Fonda, New York 12068.
In conjunction with Governor Cuomo’s Executive Order, this meeting will also be held electronically via teleconference on May 18, 2021 at 6:04 pm. Members of the public may participate in the meeting by attending or by calling 1-224-501-3412, Access Code 844-727-301. RESOLUTION ADOPTING INTRODUCTORY LAW B (LOCAL LAW 2 OF 2021) - A LOCAL LAW ESTABLISHING A RECYCLING FEE (COUNTY LEGISLATURE)

WHEREAS, per Resolution No. 96 of 2021 the County authorized a contract for transporting and processing single stream recyclables from the County's transfer stations; and
WHEREAS, it is recommended that Montgomery County establish a tipping fee for the disposal of recyclables at the County's transfer stations; and
WHEREAS, a copy of this local law has been on the desks of the legislators for at least seven calendar days, exclusive of Sundays.
NOW THEREFORE BE IT RESOLVED, that Introductory Local Law B (Local Law 2 of 2021) entitled "A Local Law Establishing A Recycling Fee" hereby is adopted and is incorporated as follows:
Be it enacted by the Montgomery County Legislature as follows:
Section 1:
The purpose of this local law is to establish a tipping fee for the disposal of recyclables at the County's transfer stations
Section 2:
Montgomery County Legislature establishes the following tipping fees and effective dates for single stream recyclables at the County's transfer stations:
Recycling tip fee of $72.50/ton - effective June 1, 2021
Recycling tip fee of $75.00/ton - effective May 1, 2022
Recycling tip fee of $77.50/ton - effective May 1, 2023
Section 3:
The purpose for charging fees is to offset the County's charges for this service.
Section 4:
The invalidity or unenforceability of any section, subsection, paragraph, sentence, clause, provision, or phrase of the aforementioned sections, as declared by the valid judgment of any court of competent jurisdiction to be unconstitutional, shall not affect the validity or enforceability of any other section, subsection, paragraph, sentence, clause, provision, or phrase, which shall remain in full force and effect.
Section 5:
To the extent that this local law is inconsistent with any other laws or regulations it shall supersede those laws.
Section 6:
This law shall be effective upon filing with the Secretary of State.

I. Nature of Request:
ESTABLISHING A TIP FEE FOR SINGLE STREAM RECYCLABLES AT COUNTY TRANSFER STATIONS
II. Justification:
Fee charged to offset the County's cost for this service
III. Legislative Impact:
Authorized pursuant to Article 2 of the Montgomery County Charter.
IV. Financial Impact:
The expense for this service will cost the County the following for the transporting and processing recyclables from the County transfer stations. The average amount of recyclables per year has been between 5000-6000 tons.
Year 1 charge: $72.50/ton (5/1/21 - 4/30/22)
Year 2 charge: $75.00/ton (5/1/22 - 4/30/23)
Year 3 charge: $77.50/ton (5/1/23 - 4/30/24)

RESOLUTION AUTHORIZING AN INCREASE IN SOLID WASTE TIPPING FEES AT COUNTY TRANSFER STATIONS (COUNTY LEGISLATURE)

WHEREAS, the conracts for the operations, transportation and disposal of solid waste had an increase that took effect on January 1, 2021; and
WHEREAS, Montgomery County's tipping fees are lower than most surrounding municipalities; and
WHEREAS, it was recommended that Montgomery County increase tipping fees by $6.00 per ton to accommodate increased costs.
THEREFORE BE IT RESOLVED, that the Montgomery County Legislature authorizes and directs tipping fees at the Montgomery County transfer stations to be increased by $6.00 per ton.
FURTHER RESOLVED, the increase of $6.00 per ton shall take effect on July 1, 2021.

AUTHORIZING AN INCREASE IN SOLID WASTE TIPPING FEES AT COUNTY TRANSFER STATIONS
II. Justification:
Montgomery County is currently realizing a loss for transfer station operations and transportation due to contracted rate increases from our vendors that took effect January 2021. Rate increase would less or offet the losses occuring
III. Legislative Impact:
Authorized pursuant to Article 2 of the Montgomery County Charter.
IV. Financial Impact:
Increasing tipping fees would offset the increased costs in operating the transfer stations and transporting solid waste.

RESOLUTION APPROVING ABSTRACT OF AUDITED CLAIMS (COUNTY LEGISLATURE)

WHEREAS, pursuant to the Audit Guidelines, Section 2.02 (2), requires after examination and review of the claims by the County Auditor, and there being no objection to any of the claims by any committee or Board member, shall move that the claims as audited are approved and presented to the Board for approval of payment; and
WHEREAS, the County Auditor has audited claims for the period of April 28, 2021 through May 25, 2021; and the County Auditor recommends the payment of the claims as attached hereto in the "Abstract of Audited Claims".
RESOLVED, after examination and review of the claims by the County Auditor, the claims are audited and attached hereto, are hereby approved for payment by the Montgomery County Legislature.

RESOLUTION NO. 122 of 2021 DATED: May 25, 2021 RECOMMENDATION: |
RESOLUTION AUTHORIZING THE EXTENSION OF THE LAST DATE OF REDEMPTION FOR DELINQUENT TAXES (COUNTY LEGISLATURE)

WHEREAS, the last date of redemption for properties with outstanding 2018 taxes was February 21, 2020, extended to September 30, 2020 and extended again to April 30, 2021; and
WHEREAS, the last date of redemption for properties with outstanding 2019 taxes is February 19, 2021, extended to April 30, 2021; and
WHEREAS, as a result of State legislation the County’s foreclosure paperwork was not able to be filed; and
WHEREAS, on May 3, 2021 the Governor signed legislation that extended a moratorium on tax foreclosures until August 31, 2021.
RESOLVED, the Montgomery County Legislature authorizes and directs the Montgomery County Treasurer to extend the last date of redemption for outstanding 2018 and 2019 taxes to August 31, 2021; and
FURTHER RESOLVED, that delinquent taxpayers shall be allowed to pay their taxes to prevent properties from foreclosure and sale at auction.

RESOLUTION AUTHORIZING THE EXTENSION OF THE LAST DATE OF REDEMPTION FOR DELINQUENT TAXES
II. Justification:
To allow property owners to redeem properties through August 31, 2021 rather than having them proceed through foreclosure and auction.
III. Legislative Impact:
Authorized pursuant to Article 2 of the Montgomery County Charter.
IV. Financial Impact:
Result in additional tax revenue being collected by Montgomery County as opposed to not allowing payment while foreclosure in on hold.
