Chairman Joseph M. Isabel has called a meeting of the Public Safety Committee for 6:03 p.m. on Tuesday, April 20, 2021 in the Legislative Chambers, County Office Building, 64 Broadway, Fonda, New York 12068. 

In conjunction with Governor Cuomo’s Executive Order, this meeting will also be held electronically via teleconference on April 20, 2021 at 6:03 pm.  Members of the public may participate in the meeting by attending or by calling 1-312-757-3121, Access Code 456-944-325. Minutes of the hearing will be transcribed and later posted on the Montgomery County website at www.co.montgomery.ny.us.

RECOMMENDATION:
     

RESOLUTION AUTHORIZING COUNTY EXECUTIVE TO SIGN NYS ILS (INDIGENT LEGAL SERVICES) GRANT EXTENSION CONTRACTS (PUBLIC DEFENDER)

Seconded by: Headwell, Jr.

WHEREAS, the Public Defender's Office is currently utilizing multiple term grants through the New York State Indigent Legal Services; and

WHEREAS, Five NYS ILS grants have recently term expired as follows:

 1)  Distribution Four

 2)  Distribution Five

 3)  Distribution Six

 4)  Distribution Seven

 5)  Distribution CAFA (counsel at first arraignment) and;

WHEREAS, the NYS ILS requires grant contract extensions be signed by the County Executive.

RESOLVED, upon review and approval of the County Attorney, the County Executive is authorized to sign NYS ILS Extension Contracts as set forth above.

RESOLUTION VOTE, passed with Aye(8). Legislator Duchessi was absent. (4/27/2021)



Statement of Legislative and Financial Impact:

I. Nature of Request:

Authorizing the Montgomery County Executive to sign grant contract extensions.


II. Justification:

This resolution is requested in order to assure that the Public Defender's Office will continue receiving NYS ILS reimbursement grant funds.


III. Legislative Impact:

Pursuant to Article 3 of the Montgomery County Charter, the County Executive has the authority to enter into contracts.


IV. Financial Impact:

None.  No cost the the County.
