Chairman Daniel P. Wilson has called a meeting of the Physical Services Committee for 6:02 p.m. on Tuesday, April 20, 2021 in the Legislative Chambers, County Office Building, 64 Broadway, Fonda, New York.  

In conjunction with Governor Cuomo’s Executive Order, this meeting will also be held electronically via teleconference on April 20, 2021 at 6:02 pm.  Members of the public may participate in the meeting by attending or by calling 1-312-757-3121, Access Code 456-944-325. RESOLUTION AUTHORIZING THE COUNTY EXECUTIVE TO SIGN AN AGREEMENT WITH THE MONTGOMERY COUNTY SANITARY DISTRICT NO.1 FOR THE DISPOSAL OF LEACHATE FROM THE LANDFILLS LOCATED IN MONTGOMERY COUNTY

WHEREAS, Montgomery County has entered into an Intermunicipal Agreement with Schoharie and Otsego Counties for the purpose of landfill management; and

WHEREAS, said agreement calls for Montgomery County to provide post closure services and bill the other counties; and

WHEREAS, the leachate generated by the landfills needs to be treated at a sewage plant, and the Montgomery County Sanitary District No.1 operates such plant; and

WHEREAS, the Montgomery County Sanitary District No.1 did an upgrade at their wastewater treatment plant in 2018 that allows for the acceptance, treatment and disposal of the leachate generated by the landfills; and

WHEREAS, the current contract with the Montgomery County Sanitary District No.1 which sets forth the terms and provisions for the acceptance of the leachate generated by the landfills for treatment (hereinafter referred to as the "leachate Agreement") needs to be renewed; and

WHEREAS, the Montgomery County Sanitary District No.1 is a department of Montgomery County; and

WHEREAS, Montgomery County and the Montgomery County Sanitary District No.1 will both benefit from the Leachate Agreement.

NOW THEREFORE BE IT RESOLVED, that the Montgomery County Legislature hereby authorizes and directs the County Executive, following review and approval of the County Attorney, to sign the Leachate Agreement, which is an agreement for leachate disposal, with the Montgomery County Sanitary District No.1 expiring on December 31, 2021 at a rate of .030 cents per gallon up to two million gallons, and .0225 cents per gallon after.

Leachate Agreement

Statement of Legislative and Financial Impact:

I. Nature of Request:

Authorizing the County Executive to sign the Leachate Agreement between Montgomery County and the Montgomery County Sanitary District No.1.


II. Justification:

Montgomery County has entered into an Intermunicipal Agreement with Schoharie and Otsego counties for the purpose of landfill management, which requires Montgomery County to provide post closure services and bill the other counties.  The contract currently in place to disposeof leachate for the landfills with the Montgomery County Sanitary Idsitrct needs to be renewed.


III. Legislative Impact:

Pursuant to General Municipal Law 119-o municipal corporations have the power to enter into agreements for the performance among themselves or one for the other of their respective functions, powers and duties on a cooperative contract basis.  Pursuant to Article 3 of the Montgomery County Charter, the Montgomery County Executive has the authority to enter into contracts.


IV. Financial Impact:

Increased revenue for the Montgomery County Sanitary District No.1. Cost savings for Montgomery County.

WHEREAS, the Montgomery County Department of Public Works held a surplus equipment auction from March 15, 2021- March 29, 2021; and

WHEREAS, a total sum of $44,525.00 was raised from the auction; and

WHEREAS, the Montgomery County Department of Public Works Commissioner is requesting said revenue from sale to be added to the DM Fund; and

WHEREAS, the Montgomery County Department of Public Works has a need to replace equipment;

RESOLVED, that the County Treasurer is authorized and directed to amend the 2021 Operating Budget as follows:

INCREASE REVENUES:

RESOLUTION AWARDING RFP# 05-21 FOR RECYCLING SERVICES AND AUTHORIZING THE COUNTY EXECUTIVE TO SIGN AGREEMENT - CONSOLIDATED WASTE SERVICES LLC. DBA TWIN BRIDGES WASTE & RECYCLING (COUNTY TREASURER)

WHEREAS, the Purchasing Agent issued a Request for Proposals for the provision of recycling services for Montgomery County; and

WHEREAS, proposals have been received and were opened on March 29, 2021; and

WHEREAS, after reviewing the proposals the Treasurer and County Attorney, recommend awarding the RFP to Consolidated Waste Services LLC. dba Twin Bridges Waste & Recycling.

RESOLVED, that the Montgomery County Legislature hereby authorizes and directs the County Executive after review and approval of the County Attorney to sign an agreement with Consolidated Waste Services LLC. dba Twin Bridges Waste & Recycling for the provision of recycling services in Montgomery County for a term of May 1, 2021 through April 30, 2024.  At the end of this initial bid period, the contract may be renewed for two (2) additional years, in consecutive one-year intervals, and at the sole discretion of the County of Montgomery.

FURTHER RESOLVED, the Montgomery County Legislature authorizes and directs the County Treasurer to amend 2021 Operating Budget as follows:

WHEREAS, Montgomery County DPW - per resolution 296 of 2019, contracted with GPI Engineering to provide Drainage & Roadway design improvements to a section of Lepper Rd in the Town of Amsterdam; and

WHEREAS, Engineering & Design has been completed and survey of landowners who will be effected has been determined and landowners have been notified.

WHEREAS, permanent easements are required for construction and future maintenance of culverts and per Highway Law 118, easements must be approved by the County Legislature, and

WHEREAS, the following permanent easements at the following properties are required for construction and future maintenance of culverts:

RESOLVED, the Montgomery County Executive, upon review and approval of the Montgomery County Attorney, is hereby authorized to accept and sign the aforementioned easement agreements and any and all other associated documents.

Statement of Legislative and Financial Impact:

I. Nature of Request:

To obtain permanent easements to replace and maintain culverts and catch basins on County Highway 20- Lepper Road


II. Justification:

Easements are needed to access private property;per Highway Law 118, easements must be approved by the local legislature


III. Legislative Impact:

Persuant to Article  2 of the County Charter, the Montgomery County Legislature has the authority to make any provisions for any matter in Montgomery County


IV. Financial Impact:

Project is being funded under CHIP's program which is 100% reimbursable to Montgomery County
