RESOLUTION AUTHORIZING THE WRITE-OFF OF COUNTY TAXES ON PROPERTIES WITHIN THE CITY OF AMSTERDAM (COUNTY TREASURER)

WHEREAS, County taxes on properties in the City of Amsterdam for the years 2000 through 2010 remain unpaid; and

WHEREAS, the amount of these outstanding taxes remain as a receivable from the City of Amsterdam on the County's financial statement; and

WHEREAS, the City of Amsterdam is unable to identify what tax parcels constitute outstanding amounts that are due to the County; and

WHEREAS, the City of Amsterdam has requested that these outstanding taxes receivable be written off the County's financial statements as uncollectible.

RESOLVED, the County Legislature authorizes and directs the County Treasurer to write-off the taxes receivable from the City of Amsterdam for the years 2000 through 2010 in the amount of $513,500.78; and

FURTHER RESOLVED, the breakdown of the outstanding taxes to be written off are as follows:

     2000          $40,390.70

     2001          $40,254.81

     2002          $39,185.20

     2003          $46,110.72

     2004          $38,528.71

     2005          $30,304.33

     2006          $41,415.42

I. Nature of Request:

RESOLUTION AMENDING THE 2021 OPERATING BUDGET - EQUIPMENT (SHERIFF)


II. Justification:

The Sheriff's Office recieved donations to use however needed.  It has been determined that we are need of a dual antenna radar unit, some new Tasers with cartridges and holsters.  This is a perfect place to use this money.  These items are vital pieces of equipment that enable staff to perform law enforcement functions daily and efiiciently.To help fund this initiative 9 MM of surplus ammunition was sold.  This agency does not have any 9 MM weapons anymore and we had a surplus.  We hope to use this money for important equipment upgrades.  


III. Legislative Impact:

Pursuant to section 2.04 (b) of the charter the Montgomery County Legislature has the power to make appropriations.


IV. Financial Impact:

There is no financial impact as all of this money has been obtained through gifts and donations and equipment sales.

I. Nature of Request:

AMENDING 2021 OPERATING BUDGET - K9


II. Justification:

K-9 GAJ is fastly approaching retirement.  Donations have already been received to replace GAJ.  Sergeant Jason Nare has been in K-9 for years and has accepted a replacement dog.  This dog will train for a few months until it can certify and then be placed into service.  This resolution simply moves the donation money into the line to pay for the dog, vet bills, food and equipment.


III. Legislative Impact:

Pursuant to section 2.04 (b) of the charter the Montgomery County Legislature has the power to make appropriations.


IV. Financial Impact:

No financial impact, all of this money was donated to the K-9 program.

RESOLUTION AMENDING THE BASE SALARY FOR SECRETARY TO THE DISTRICT ATTORNEY AND CONFIDENTIAL SECRETARY TO THE PUBLIC DEFENDER (DISTRICT ATTORNEY)

WHEREAS, said positions are established within the Non-Bargaining Policy at a Grade R; and

WHEREAS, to equalize rates, it is recommended that the base salary for both positions be adjusted and established with a new base salary of $49,782; and

WHEREAS, current grant funding for said positions which previously added to the base salary will now be used to offset the newly established base; and

WHEREAS, the District Attorney and Public Defender will continue to seek grants to partially offset the county share of salaries within their departments.

RESOLVED, that the Montgomery County Legislature hereby establishes the base salary for the Secretary to the District Attorney and the Confidential Secretary to the Public Defender at $49,782 a grade R in the Non-Bargaining Policy.

I. Nature of Request:

Equalization of the salary for the Secretary to the District Attorney and the Confidential Secretary to the Public Defender.


II. Justification:

The responsibilities within in the positions contained within the resolution are similar in nature and compensation is not equal.


III. Legislative Impact:

Pursuant to Article 2 and 3 of the Montgomery County Charter the Montgomery County Board of Legislature and County Executive have the authority to establish positions and make amendments to the operating budget.


IV. Financial Impact:

Funding for changes are included in respected budgets.

Future salary increases will be based on base salary established.  

Grant funding that previously added to the base salary will be used to partially offset the new base salary. All grants moving forward will be sought to further offset the county share of salaries.

RESOLUTION AUTHORIZING THE COUNTY EXECUTIVE TO ENTER INTO AN AGREEMENT - GRASS AND BRUSH CONTROL ON COUNTY ROADS FOR 2021-2022 (PUBLIC WORKS)

WHEREAS, Montgomery County contracts for grass and brush control with the ten towns, the City of Amsterdam, and the Village of St. Johnsville on county roads; and

WHEREAS, the current contract is due to expire for such services and there is a need to renew the contract for Grass and Brush Control on County Roads;

RESOLVED, pursuant to Section 135 a of the Highway Law, Montgomery County Legislature hereby authorizes and directs the County Executive, upon review by the County Attorney, to enter into agreements with the ten towns located within Montgomery County; the City of Amsterdam and the Village of St. Johnsville for provision of grass and brush control on county roads; and

FURTHER RESOLVED, payment for work to be performed under the terms of said agreement for grass and brush control shall be at a rate of $400.00 per center line miles for the contract year June 1, 2021, through May 31, 2022, at a total cost of $157,912.00 to the County Road Fund.

Statement of Legislative and Financial Impact:

I. Nature of Request:

For authorization allowing the County Executive to enter into contracts with the ten towns, the City of Amsterdam and Village of St. Johnsville, for the purpose of grass and brush control on 398.4 miles of county roads for the period of one year- June 1, 2021, through May 31, 2022.


II. Justification:

The current contract with the ten towns, the City of Amsterdam and the Village of St. Johnsville is due to expire.

There is a need for grass and brush control on county roads for maintenance and safety reasons.


III. Legislative Impact:

Pursuant to Article 3 of the Montgomery County Charter, the County Executive has the authority to enter into contracts.


IV. Financial Impact:

Appropriations for the contract are included in the 2021 Operating Budget.  This is not an increase from previous contract.

RESOLUTION AUTHORIZING COUNTY EXECUTIVE TO SIGN INTERMUNICIPAL AGREEMENT FOR LEACHATE DISPOSAL WITH THE VILLAGE OF CANAJOHARIE (PUBLIC WORKS)

WHEREAS, Montgomery County has entered into an Intermunicipal Agreement with Schoharie and Otsego counties for the purpose of landfill management; and

WHEREAS, said agreement calls for Montgomery County to provide post closure services and bill the other counties; and

WHEREAS, the leachate generated by the landfills needs to be treated at a sewage plant, and the Village of Canajoharie operates such plant; and

WHEREAS, the Village of Canajoharie currently accepts the leachate generated by the landfills; and

WHEREAS, the current contract with the Village of Canajoharie which sets forth the terms and provisions for the acceptance of the leachate generated by the landfills for treatment (hereinafter referred to "Leachate Agreement") is about to expire; and

WHEREAS, Montgomery County and the Village of Canajoharie are municipal corporations; and

WHEREAS, Montgomery County and the Village of Canajoharie will both benefit from the Leachate Agreement.

NOW, THEREFORE, BE IT RESOLVED, that the Montgomery County Legislature hereby authorizes and directs the County Executive, following review and approval of the County Attorney, to sign the Leachate Agreement, which is an intermunicipal agreement for leachate disposal, with the Village of Canajoharie for a term of one year at a rate of .0325 cents per gallon up to two million gallons, and .0225 cents per gallon after.

Statement of Legislative and Financial Impact:

I. Nature of Request:

Authorizing the County Executive to sign the Leachate Agreement with the Village of Canajoharie.


II. Justification:

Montgomery County has entered into an Intermunicipal Agreement with Schoharie and Otsego counties for the purpose of landfill management, which requires Montgomery County to provide post closure services and bill the other counties.  The contract currently in place to dispose of leachate for the landfills with the Village of Canajoharie is about to expire and needs to be renewed or other arrangements made.


III. Legislative Impact:

Pursuant to General Municipal Law 119-o, municipal corporations have the power to enter into agreements for the performance among themselves or one for the other of their respective functions, powers and duties on a cooperative or contract basis.  Pursuant to Article 3 of the Montgomery County Charter, the Montgomery County Executive has the authority to enter into contracts.


IV. Financial Impact:

Costs are paid jointly by Otsego, Schoharie and Montgomery counties, and have been included in the 2021 Operating Budget.

WHEREAS, Montgomery County has entered into an Intermunicipal Agreement with Schoharie and Otsego Counties for the purpose of Landfill Management; and

WHEREAS, said agreement calls for Montgomery County to provide post closure services and vill the other counties; and

WHEREAS, per NYS DEC Law, monitoring of the closed landfills for underground gas, annual site goundwate, laboratory analysis and data review is a requirement; and

WHEREAS, the current contract for landfill monitoring and reporting with Barton & LoGuidice, 443 Electronics Parkway, Liverpool, NY 13088 is due to expire and the committee of post closure & three counties wish to renew said agreement for a period of 3 years, April 1, 2021 - March 31, 2024.

RESOLVED, upon review and approval of the County Attorney, the County Executive is hereby authorized and directed to sign agreement with Barton & LoGuidice for a 3 year period of tiem to perform encironmental montioring and reporting services for closed landfills per NYS DEC, at a cost not to exceed $16,000 per year or $48,0000 for for a period of 3 years, April 1, 2021 - March 31, 2024.

II. Justification:

Montgomery County has entered into an Intermunicipal Agreement with Otsego & Schoharie Counties for the purpose of landfill management which requires Montgomery County to provide post closure services & bill back the other counties.  The contract for environmental monitoring is about to expire and needs to be renewed as required by NYS DEC.


III. Legislative Impact:

Pursuant to Article 3 of the Montgomery County Charter.  The Montgomery County Executive has the authority to enter into contracts.


IV. Financial Impact:

Costs are paid jointly by Otsego, Schoharie & Montgomery Counties and have been included in the 2021 Operating Budget.

Costs for landfill monitoring will be budgeted for in Montgomery County 2022 & 2023 post closure fund.

WHEREAS, Berkshire Farm Center and Services for Youth provides a school, home, and community-based prevention program for elementary students (K-5) called the Home Run Program and middle school students called the Turnabout Program; and

WHEREAS, Berkshire Farm Center and Services for Youth places a Family Specialist in the school district and they become part of the school culture. The program provides family counseling and empowers families to get involved with school, community, and family; and

WHEREAS, since the program in collaboration with local districts has the ability to reduce foster care placements, the Department of Social Services would also like to enter into contracts with participating school districts (Canajoharie, Fort-Plain, Amsterdam, and Oppenheim-Ephratah-St. Johnsville) as well as Hamilton-Fulton-Montgomery BOCES to coordinate and bill them for the local share of this contract; and, be it

RESOLVED, that the County Executive, upon review and approval of the County Attorney, is hereby authorized and directed to sign a contract with Berkshire Farm Center in the amount of $546,641.00, for the period of January 1, 2021 through December 31, 2021; and 

FURTHER RESOLVED, that the County Executive, upon review and approval of the County Attorney, is hereby authorized and directed to sign contracts with Canajoharie, Fort-Plain, Amsterdam, Oppenheim-Ephratah-St. Johnsville, and Hamilton-Fulton-Montgomery BOCES for the period of January 1, 2021 through December 31, 2021. 

FURTHER RESOLVED, New York State reimburses Montgomery County 62% of the $546,641.00, which amounts to $338,917.42 for the period of January 1, 2021 through December 31, 2021 for all school districts.

Authorizing County Executive to sign contracts with Berkshire Farm Center and Services for Youth, Canajoharie Central School District, Fort-Plain Central School District, Greater Amsterdam School District, Oppenheim-Ephratah-St. Johnsville Central School District, and Hamilton-Fulton-Montgomery BOCES for Home Run and Turnabout Prevention Programs.


II. Justification:

These programs will reduce costly foster care placements by keeping children in their own homes.


III. Legislative Impact:

Pursuant to Article 3 of the Charter the Montgomery County Executive has the authority to sign contracts.


IV. Financial Impact:

The Berkshire Farm Center and Services for Youth contract will be funded 62% State dollars ($338,917.42) and 38% Local dollars ($207,723.58).

The contracts with the school districts and BOCES will reimburse the local dollar amount at a rate of $34,620.60 to the County by each participating school district and program.

Due to these reimbursements, there will be no financial impact to the county.

RESOLVED, the facilities that are used in Montgomery County are as follows:

 

FURTHER RESOLVED, that the Montgomery County Legislature, after review and approval by the County Attorney, hereby authorizes and directs the County Executive to sign, and execute prospective contract documents for a term of June 1, 2021 through May 31, 2022 entered into between the County and OCFS-approved agencies providing services to county children in need of foster care and/or behavioral services.

WHEREAS, Section 5311 of Title 49, United States Code, provides federal financial assistance for public transportation in rural and small urban areas by way of a formula grant program to be administered by the States; and 

WHEREAS, Montgomery County makes an application annually to the New York State Department of Transportation for such federal aid for operating assistance for the annual provision of public mass transportation (transit) services on a continuing basis in Montgomery County; and 

WHEREAS, New York State Public Law No. 116-136 (3/27/20) and the CARES Act authorized temporary additional funding for operating activities related to COVID-19 that occur on or after January 20, 2020; and

WHEREAS, Resolution #128 of 2020 authorized the county to enter into CONTRACT NO: C004175 with the New York State Department of Transportation for available funding through the CARES Act, related to mass transportation services; and

WHEREAS, Montgomery County submitted a payment request through the CARES Act process for CARES Act and was awarded funding; and  

WHEREAS, the Department of Economic Development & Planning is implementing and administering said grant on behalf of Montgomery County; and

RESOLVED, that the County Treasurer is hereby authorized and directed to amend the 2021 Operating Budget to receive and provide for funding to allow for continued mass transportation services.

WHEREAS, the New York State Office of Parks, Recreation and Historic Preservation has awarded Montgomery County $65,232 from the 2020-2021 Snowmobile Trails Grant-In-Aid Program, based upon an application submitted in cooperation with the Mohawk Valley Snowmobile Clubs; Inc.

RESOLVED, that the Montgomery County Legislature hereby authorizes the County Executive, following review and approval by the County Attorney, to execute all documents associated with this grant.

FURTHER RESOLVED, the County Treasurer is hereby authorized and directed to amend the 2021 Operating Budget as follows:

I. Nature of Request:

This resolution will amend the 2021 operating budget to reflect the grant award amount through the New York State Snowmobile Trails Grant-In-Aid Program.


II. Justification:

This will allow the County to receive and appropriate the grant awarded funds to the Mohawk Valley Snowmobile Clubs, Inc.


III. Legislative Impact:

Pursuant to Article 2 of the Charter the Montgomery County Legislature has the power to make appropriations .Pursuant to Article 3 of the Charter the Montgomery County Executive has the authority to sign contracts.


IV. Financial Impact:

Resolution is budget neutral as revenues from the grant will offset the appropriations.

WHEREAS, the Department of Economic Development and Planning desires to lease a photocopier for a four year term with a $1 buyout at the end of the term through Repeat Business Systems and Leaf Capital Funding, LLC. 

RESOLVED, that the County Executive, following review and approval by the County Attorney, hereby is authorized and directed to sign a lease agreement with Repeat Business Systems and Leaf Capital Funding, LLC at a cost not to exceed $151.00 per month for a four year term plus a one-time documentation fee of $95.00.

WHEREAS, Montgomery County is applying for funding for economic development purposes through the Office of Homes and Community Renewal’s Community Development Block Grant (CDBG) Microenterprise Program, and

WHEREAS, the Office of Community Renewal provides grants to communities that wish to sponsor economic development activities that create or retain jobs for low- and moderate-income persons. The goal of the program is to fund projects that result in high quality, full-time jobs that are well paying and provide benefits and training to low- and moderate-income persons, and

WHEREAS, Montgomery County has prioritized economic development and job creation provisions which will result in a direct and positive impact to low and moderate income persons, and

WHEREAS, Montgomery County has been very successful in helping existing and start-up through other microenterprise grants; and

WHEREAS, they want to continue on the success of the previous available funding; and

WHEREAS, Montgomery County is proposing to request funding for a Montgomery County Microenterprise program, under the terms set forth in the Office of Homes and Community Renewal’s Community Development Block Grant Program, and

WHEREAS, program requirements include the provision to hold a public hearing on the grant application,

RESOLVED, that the County Legislature hereby schedules a Public Hearing on the Montgomery County Microenterprise grant to be held at 6:55 p.m., April 27, 2021, in the Chambers of the County Legislature, County Office Building, Fonda, New York, and

RESOLVED, that the County Executive, following review and approval by the County Attorney, is hereby authorized and directed to sign and submit all required application and subsequent reporting materials for funding under the Office of Homes and Community Renewal’s Community Development Block Grant (CDBG) Microenterprise Program.

WHEREAS, the Director has investigated and filed a report, pursuant to said statute, confirming existance of said error,

RESOLVED, that the 2021 County Tax Roll hereby is corrected as follows:

WHEREAS, a Settlement Agreement has been offered by the counties in exchange for witness cooperation of Christopher Bahari; and

WHEREAS, it is anticipated that this Settlement Agreement will be beneficial to the counties involved in the civil litigation.

NOW THEREFORE BE IT RESOLVED, that the Montgomery County Executive is authorized to sign the settlement agreement with Christopher Bahari.
