RESOLUTION AUTHORIZING CANCELING FOURTH INSTALLMENT OF COUNTY TAXES ON 1 VENNER ROAD, AMSTERDAM NY (COUNTY LEGISLATURE)

WHEREAS, Resolution 90 of 2020 authorized the County Executive to enter into a contract to purchase 1 Venner Road in Amsterdam NY (hereinafter the "Property"); and

WHEREAS, the County is anticipated to close on the Property in September 2020; and

WHEREAS, the fourth installment of County taxes due on the Property is $2,226.52 and is due and owing on October 31, 2020; and

WHEREAS, as the County is obtaining title to the Property the County wishes to cancel the fourth installment of County taxes.

NOW THEREFORE BE IT RESOLVED, that the Montgomery County Legislature directs the cancellation of the fourth installment of County taxes due on the Property that totals $2,226.52 and is due and owing on October 31, 2020, as well as and taxes moving forward while the County is in possession of the property, as the lien of such tax cannot be enforced pursuant to Real Property Tax Law Section 558,

BE IT FURTHER RESOLVED, that the Montgomery County Treasurer is authorized and dircted to take whatever steps necessary to effectuate this resolution.

I. Nature of Request:

RESOLUTION AUTHORIZING CANCELING FOURTH INSTALLMENT OF COUNTY TAXES ON 1 VENNER ROAD, AMSTERDAM NY (COUNTY LEGISLATURE)


II. Justification:

The fourth installment of taxes is due after the County takes title.


III. Legislative Impact:

Authorized pursuant to Section 558 of the Real Property Tax Law.


IV. Financial Impact:

Will result in a reduction of the 2020 tax levy of $2,226.52.
