RESOLUTION AUTHORIZING THE COUNTY EXECUTIVE TO SIGN AN INTERMUNICIPAL AGREEMENT FOR POST-CLOSURE SERVICES WITH SCHOHARIE AND OTSEGO COUNTIES (COUNTY LEGISLATURE)

WHEREAS, the current Intermunicipal Agreement with Schoharie and Otsego Counties is due to expire on December 31, 2018, and
WHEREAS, the counites are collectively responsible for the Post-Closure care and maintenance of the Eastern, Central and C & D Landfills, previously used by the counties pursuant to the terms of the Post-Closure Agreement, and
WHEREAS, it has been determined that cooperative action with Schoharie and Otsego Counties will be of economic benefit to all municipalities, and
WHEREAS, the current Board of Post-Closure Advisors have recommended extending the Intermunicipal Agreement to two (2) consecutive ten (10) year agreements, as attached in Schedule "A", to commence on January 1, 2019, and be renewed on or before December 31, 2029.
RESOLVED, the Montgomery County Legislature hereby endorses an Imtermunicipal Agreement for Post-Closure with Schoharie and Otsego Counties, and upon review and approval of the County Attorney, authorizes the County Executive to sign the agreement.

I. Nature of Request:
To enter into an Intermunicipal Agreement with Schoharie and Otsego Counties for Post-Closure Management of landfills owned by the three counties.
II. Justification:
Upon dissolvement of MOSA in 2014, Resolution 62 of 2014 created an agreement for Post-Closure Services with the three counties. This agreement is due to expire and needs to be renewed.
III. Legislative Impact:
Pursuant to Article 2 of the Montgomery County Charter, the Legislature has the authority to enter into agreements. Intermunicipal agreements are further authorized by Generam Municipal Law 119-o.
IV. Financial Impact:
All three counties contribute to the expense of the management of the landfills, and are included in the Executive's Budget.
A copy of the proposed budget for the next six (6) years is attached as Schedule "B"

RESOLUTION AUTHORIZING THE COUNTY EXECUTIVE TO SIGN AN INTERMUNICIPAL AGREEMENT BETWEEN THE VILLAGE OF CANAJOHARIE WASTEWATER TREATMENT PLANT AND THE MONTGOMERY COUNTY SANITARY DISTRICT NO.1 FOR SLUDGE TREATMENT/DISPOSAL

WHEREAS, Montgomery County through the Montgomery County Sanitary District No.1 operates a wastewater treatment plant that generates digested sludge which requires treatment/disposal; and
WHEREAS, the Village of Canajoharie is the owner and operator of wastewater treatment facilities which can be used to treat/dispose of said sludge; and
WHEREAS, Montgomery County and the Village of Canajoharie are municipal corporations; and
WHEREAS, the Sludge Disposal Agreement is expected to the benefit of Montgomery County and the Village of Canajoharie; and
WHEREAS, the Village of Canajoharie has approved the Sludge Disposal Agreement Agreement.
NOW THEREFORE BE IT RESOLVED, the Montgomery County Legislature hereby authorizes and directs the County Executive, following the review and approval of the County Attorney, to sign the Sludge Disposal Agreement, which is an Intermunicipal Agreement for sludge treatment/disposal, with the Village of Canajoharie terminating May 31, 2019.

I. Nature of Request:
Resolution authorizing the County Executive to sign an intermunicipal agreement between the Village of Canajoharie Wastewater Treatment Plant and the Montgomery County Sanitary District No.1 for sludge treatment/disposal.
II. Justification:
The Montgomery County Sanitary District No.1 generates sludge that requires disposal. The Village of Canajoharie operates a wastewater treatment plant that is capable of treating said sludge at a small cost saving to the Montgomery County Sanitary District No.1
III. Legislative Impact:
Pursuant to General Municipal Law 119-o municipal corporations have the power to enter into agreements for the performance among themselves or one for the other respective functions, powers, and duties on a cooperative basis. These agreements must be entered into by a majority voting strength of its governing body.
Pursuant to Article 3 of the Charter the Montgomery County Executive has the authority to enter into contracts.
IV. Financial Impact:
A savings of about $5,500.00 has been realized over the past 2 years.

WHEREAS, the Montgomery County Legislature, by adoption of Resolution No. 280 of 2014, has approved the 2018 Bridge Program, including engineering services, and
WHEREAS, the funding for said program was approved, by adoption of Resolution No. 68 of 2018, and
WHEREAS, Montgomery County Department of Public Works advertised for Request for Qualifications and received four (4) responses:
1. Greenman Pedersen, Albany, NY
2. AECOM USA, Inc., Latham, NY
3. Foit Albert Associates, Albany, NY
4. Clough Harbor Consulting, Albany, NY
WHEREAS, the panel appointed by the Commissioner of Public Works have selected AECOM USA, Inc., of Latham, NY, as the most responsible responsive qualified firm for the 2018 Bridge Program.
RESOLVED, that the Montgomery County Legislature authorizes and directs the County Executive, following review and approval by the County Attorney, hereby is authorized and directed to sign an agreement with AECOM USA, Inc., of Latham, NY, for provision of engineering services for the 2018 Bridge Program, and
FURTHER RESOLVED, that said services shall be provided at a cost not to exceed $238,960.00.

I. Nature of Request:
Request for the County Executive to sign a contract for Engineering Services for the 2018 Bridge Program
II. Justification:
Professional engineering services are required to complete the Bridge Program.
III. Legislative Impact:
Pursuant to Section 3.02 (g) the County Executive can make, sign, and implement all contracts on behalf of the County within the authorized appropriations. Resolution No. 68 of 2018 sets the overall authorized appropriation for this project at $1,650,000.00. Accordingly, the Procurement Policy would need to be followed as well.
IV. Financial Impact:
Services are to be provided at a cost not to exceed $238,960.00 within the authorized appropriation.

WHEREAS, Montgomery County Department of Public Works is completing the Bike Path Paving Project in the 2018 construction season; and
WHEREAS, it is necessary to amend the budget to cover the cost of labor through the end of the year.

I. Nature of Request:
Budget transfer due to shortage in "A" Fund Labor, DPW
II. Justification:
Highway Fund labor is needed to cover expenses of highway crews performing work on the Bike Path.
III. Legislative Impact:
Legislators have the authority to amend the 2018 Budget pursuant to Article 2 of the Charter.
IV. Financial Impact:
Funds are being transferred within the DPW budget to cover this cost.
