WHEREAS, the Montgomery County Public Defender has been advised by NYS Indigent Legal Services that a grant has been awarded to the Public Defender's Office to improve the quality of services provided to indigents of Montgomery County; and

WHEREAS, the total of the grant is $111,384 with a three-year distribution of $37,128 per year; and

WHEREAS, the funds can be used only for the Public Defender's Office as set forth within contract; and

RESOLVED, that the Montgomery County Legislature hereby authorizes the County Executive, upon review and approval of the County Attorney to accept and sign said contract.

WHEREAS, the Executive Director of Youth, ATI & Veterans' Services has recommended that Montgomery County continue to transport Fulton County veterans to and from the VA Medical Center in Albany, N.Y.; and

WHEREAS, municipal corporations have the power to enter into agreements for the performance among themselves or one for the other of their respective functions, powers and duties on a cooperative or contract basis; and

WHEREAS, the proposed agreement would benefit both Montgomery County and Fulton County.

RESOLVED, that the County Executive, following review and approval by the County Attorney, hereby is authorized and directed to sign a renewal agreement for the transportation of Fulton County veterans to and from the VA Medical Center in Albany, N.Y. ; and

FURTHER RESOLVED, that said Agreement shall be for a one-year period beginning on January 1, 2018 and ending on December 31, 2018, and

FURTHER RESOLVED, that said Agreement shall provide for transportation of Fulton County veterans, depending upon availability of space, at a charge of $30.00 each way.

2018 Fulton Co. Veterans Transportation Contract

Statement of Legislative and Financial Impact:

I. Nature of Request:

RESOLUTION AUTHORIZING COUNTY EXECUTIVE TO SIGN RENEWAL AGREEMENT - TRANSPORTATION OF FULTON COUNTY VETERANS


II. Justification:

Fulton County's agreement to pay Montgomery County for transportation of Fulton County Veterans to and from the VA Hospital.


III. Legislative Impact:

Pursuant to Article 3 of the Charter the County Executive has the power to enter into contracts. Pursuant to General Municipal Law 119-o municipal corporations have the power to enter into agreements for the performance among themselves or one for the other of their respective functions, powers and duties on a coooperative or contract basis. Intermunicipal agreements must be authorized by a majority vote of the Montgomery County Legislature.

 


IV. Financial Impact:

Montgomery County will receive up to $9,000 for performance of the contract.

WHEREAS, as of 1/1/2018 the Community Service for Adults Program was moved from the Youth Bureau to the Probation Department

WHEREAS, the position of Community Service Program Coordinator as well as associated appropriations were not transferred into the Probation Department budget but remained in the Youth Bureau budget

WHEREAS, State Aid used to fund this program was also retained in the Youth Bureau budget

WHEREAS, it is necessary for the position of Community Service Program Coordinator and other appropriations  be removed from the Youth Bureau budget and added to the Probation budget so that the program can be assumed by the Probation Department

WHEREAS, it is also necessary that the State Aid revenue relative to this program be removed from the Youth Bureau budget and added to the revenue in the Probation Dept. budget

I. Nature of Request:

Amendment of the 2018 budget to move the Community Service Program for Adults from the Youth Bureau to the Probation Dept.


II. Justification:

The Community Service for Adults program is being moved from the Youth Bureau to the Probation Department and the financial adjustments need to be made in the 2018 budget.


III. Legislative Impact:

Pursuant to Article 2 of the Charter the Montgomery County Legislature has the authority to make apporpriations.

The budgets of two Departments are being altered but there is no financial impact.

WHEREAS, it is required by the New York State Commission of Corrections to provide an up to date Law library for inmates at the Montgomery County Jail.

RESOLVED, that the County Executive, following review and approval by the County Attorney, hereby is authorized and directed to sign a renewal agreement with Lexis Nexis, for the provision of electronic law library services to inmates at the Montgomery County Jail; and

FURTHER RESOLVED, that said agreement shall be for the period commening on February 1, 2018 and ending on January 31, 2021, with compensation at the rate of  $368 per month, not to exceed $4,416 annually or $13,248 for the entire three year contract.

WHEREAS, the Sheriff has been awarded a grant totaling $447,091 from the 2016 SICG Statewide Interoperable Communications Grant Program; and

WHEREAS, the funding has been approved by the State to upgrade Montgomery County's current Microwave system to provide for the ability to better connect to the radio consortium which, the Sheriff's Office E911 center is currently connected to; and 

WHEREAS, the radio equipment being purchased is on State Contract; and

WHEREAS, the remainder of the grant funding is to be used at a later date for radio shelters.

RESOLVED, the Montgomery County Treasurer is hereby authorized and directed to amend the 2018 Operating Budget as follows:

RESOLUTION ACCEPTING THE FY2017 STATE HOMELAND SECURITY PROGRAM (SHSP) GRANT FROM NYS HOMELAND SECURITY AND AMENDING THE 2018 OPERATING BUDGET (EMERGENCY MANAGEMENT)


II. Justification:

This 2017 SHSP Grant will assist all of our first responders by supplying updated imagery through Pictometry which is used in the 911 dispatch center.  Pictometry is a program allowing first respoinders to see updated images of property locations throuhout the county.  It will also purchase microsoft surfaces for the command staff in Emergency Management/Services allowing us to perform our duties from any location.  Finally the grant allows for purchases to assist with citizen preapredness information, a generator and a portable radio.


III. Legislative Impact:

Authorized pursuant to Article 2 and Article 3 of the Charter.


IV. Financial Impact:

There is no financial impact as this grant is 100% funded with no match funds required.

WHEREAS, the Emergency Management Office applied for and received the FY2017 State Emergency Performance Grant (EMPG) to assist with the purchase of a vehicle to be used throughout Montgomery County; and

WHEREAS, the Emergency Management Office has been notified by the New York State Division of Homeland Security and Emergency Services that Montgomery County has been awarded $23,688.00, to assist in emergency responce and performance throughout Montgomery County; and 

WHEREAS, the revenue for the Emergency Management EMPG grant was included in the 2018 adopted budget but the corresponding appropriation was excluded awaiting approval from NYS. 

RESOLVED, the Montgomery County Legislature hereby authorizes and directs the County Executive, following review and approval of the County Attorney to sign the agreement for FY2017 State Emergency Performance Grant (EMPG).

Statement of Legislative and Financial Impact:

I. Nature of Request:

RESOLUTION ACCEPTING THE FY2017 STATE EMERGENCY MANAGEMENT PERFORMANCE GRANT(EMPG) FROM NYS HOMELAND SECURITY AND AMENDING THE 2018 OPERATING BUDGET (EMERGENCY MANAGEMENT)


II. Justification:

This grant allows for $23,688.00 to be used towards the purchase of a new vehicle.  Emergency Management continues to receive equipment from the State that is required to tow to different types of scenes, the last item being a spill response trailer from DEC.  Undertsnading that it is difficult to purchase vehicles, the Director lobbied the state for approval and was able to obtain this money towards a purchase.  We then had communications with DPW Commissioner Eric Mead, through this communication an agreement was reached to share the use fo this vehicle, so that it will benefit two departments.  If approved the required match funds will be coming from the DPW budget, transfered over to our vehicle line so we can make the purchase.  Once the vehicle is obtained it will be used everyday by the DPW buildings and grounds supervisor and left for our use overnight and on weekends.  Should an emergency arise then we would take over the vehicle immediately regardless of the time.  It is our hopes that you see the benefit of this purchase, combined with the benefit of the grant money.  This will enable us to hall the appropriate equipment to a potential scene without problem.  Please contact me with any questions/concerns, thank you! 


III. Legislative Impact:

Pursuant to Article 2 of the Charter the Legislature has the authority to make appropriations and the Executive has the authority to sign contracts.


IV. Financial Impact:

The financial impact is the approval of a transfer from the DPW budget to our budget and the approval to spend $23, 688 towards a vehicle purchase.

This vehicle is a 3500HD Chevrolet Silverado with heavy duty tow package, bed liner, tool box, bed cover, lights, siren and radio.

II. Justification:

A previous resolution is on the agenda for approval to realize the revenue and place the money in the appropriation line for this purchase.  This contract will allow Pictometry to fly, take images and supply the updated images for an already existing program in the 911 dispatch center.

 

These images are for use by all first responders county wide and benefit everyone.


III. Legislative Impact:

There is no legislative impact.


IV. Financial Impact:

There is no financial impact, this is 100% grant money with no match funds and provides updates to an already existing program in the 911 center.

WHEREAS, responding to HAZMAT incidents and confined space rescue incidents requires specific manpower and training it is necessary to set a course of action for appropriately staffed and trained coverage for Montgomery County, and

WHEREAS, it has been determined that cooperative action with the City of Amsterdam Fire Department will stabalize response, improve overall safety and be an economic benefit to both municipalities; and

WHEREAS, it is expected that this intermunicipal agreement will be beneficial to both Montgomery County and the City of Amsterdam.

RESOLVED, the Montgomery County Legislature hereby endorses and authorizes after review by the County Attorney the County Executive to sign an Intermunicipal Agreement for services from the City of Amsterdam (Fire Department) for a term of January 1, 2018-December 31, 2020.

I. Nature of Request:

RESOLUTION AUTHORIZING THE COUNTY EXECUTIVE TO ENTER INTO AN INTERMUNICIPAL AGREEMENT FOR SERVICES FROM THE AMSTERDAM FIRE DEPARTMENT - CITY OF AMSTERDAM (EMERGENCY MANAGEMENT/SERVICES)


II. Justification:

Montgomery County has the longest stretch of NYS Thruway and CSX rail tracks in the entire State of New York.  We also have many State roads that encompass a large area of our jurisdiction.  All of these travel routes place us at risk for a Hazardous Material incident at any given time.  This combined with the natural hazards of some of our industry has proven to be the main requiring factor to make sure our Hazardous Material Response Team is staffed, trained and capable of protecting our citizens and infrastrcuture.  We are in a regional agreement with Fulton and Schoharie County to provide us assistance when needed.  The Amsterdam Fire Department has agreed to provide response for this team and has stabalized our ability to handle these types of incidents on a daily basis.

The Amsterdam Fire Department also has trained firefighters in confined space rescue.  They have agreed to suport our Department of Public Works for any confined space work detail, rescue or incident.  These two things are very imporant for the safety of our employees, constituents, guests and business owners.  The money set aside in the 2017 budget ($10,000) for a one time payment to them is to assist with training, equipment and to support this partnership that is absolutely necessary.       

 


III. Legislative Impact:

PURSUANT TO GENERAL MUNICIPAL LAW 119-o MUNICIPAL CORPORATIONS HAVE THE POWER TO ENTER INTO AGREEMENTS FOR THE PERFORMANCE AMONG THEMSELVES OR ONE FOR THE OTHER RESPECTIVE FUNCTIONS, POWERS, AND DUTIES ON A COOPERATIVE OR CONTRACT BASIS.  THESE AGREEMENTS MUST BE ENTERED INTO BY A MAJORITY VOTE OF THE VOTING STRENGTH OF ITS GOVERNING BODY.

PURSUANT TO ARTICLE 3 OF THE CHARTER MONTGOMERY COUNTY EXECUTIVE HAS THE AUTHORITY TO ENTER INTO CONTRACTS.


IV. Financial Impact:

The financial impact for this resolution is $10,000.00 a year.  This money was already approved in the 2018 budget and has been placed in the appropriate line.

RESOLUTION AMENDING THE 2018 OPERATING BUDGET ACCEPTING STOP-DWI CRACKDOWN ENFORCEMENT AWARD (STOP-DWI)

WHEREAS, the NYS STOP-DWI Foundation Board was successful in securing funding from the Governor's Traffic Safety Committee to continue crackdown enforcement during the grant cycle of October 1, 2017 through September 30. 2018; and

WHEREAS, the Montgomery County STOP-DWI program has been awarded a Crackdown Enforcement award in the amount of $10,000 for use in Montgomery County for sobriety checkpoints and/or roving patrols during the grant cycle.

NOW, THEREFORE BE IT RESOLVED, the County Treasurer is hereby authorized and directed to amend the 2018 Operating Budget as follows:

INCREASE REVENUES:
