WHEREAS, Resolution # 176 of 2017 accepted the grant funding award for the County, on behalf of the Arkell Museum, for their American Art Above Ground Storage Collection Feasibility Study project in the amount of $60,000 from the New York State Empire State Development (ESD); and

WHERAS, there will be a County share of $12,500 which will be paid by Arkell Museum, equaling a $72,500 project budget; and

WHEREAS, the county solicited RFP #05-17 and responses were received; and

WHEREAS, the Montgomery County above ground storage collection steering committee has reviewed all bids and recommends that contracts be awarded to the lowest, responsible, responsive bidder being:

Statement of Legislative and Financial Impact:

I. Nature of Request:

This resolution will authorize the County Executive to sign a contract for the firm hired on the Arkell Museum grant and amend the budget to reflect such.


II. Justification:

This will allow the County Executive to sign a contract for selected firm in aforementioned resolution.


III. Legislative Impact:

Pursuant to Article 2 of the Charter, the Montgomery County Legislature has the power to make appropriations.


IV. Financial Impact:

Resolution is budget neutral as revenues from the grant will offset the appropriations.

RESOLUTION SCHEDULING PUBLIC HEARING – MONTGOMERY COUNTY AGRICULTURE AND FARMLAND PROTECTION PLAN (ECONOMIC DEVELOPMENT AND PLANNING)

WHEREAS, agriculture in Montgomery County is a dominant driver of the local economy; and

WHEREAS, the success of local agricultural businesses is integral to the stability of Montgomery County’s employment base; and

WHEREAS, Montgomery County was awarded a New York State Department of Agriculture and Markets grant in order to update the over fifteen year old existing Agricultural and Farmland Protection Plan; and

WHEREAS, the formulation and update of the County Agricultural and Farmland Protection Plans is an important means of supporting agricultural businesses; and

WHEREAS, the duties of the Montgomery County Agriculture and Farmland Protection Board, established in accordance with Article 25-AA, Section 302, of the New York State Agriculture and Markets Law, include assessment and approval of County Agricultural and Farmland Protection Plans; and

WHEREAS, the Montgomery County Agriculture and Farmland Protection Board has reviewed the draft County Agricultural and Farmland Protection Plan and has referred the plan to the County Legislature.

RESOLVED, the County Legislature hereby schedules a public hearing on the updated Montgomery County Agricultural and Farmland Protection Plan for December 19, 2017 at 6:55 pm in the Legislature Chambers 64 Broadway, Fonda, NY 12068; and

FURTHER RESOLVED, the Clerk of the County Legislature hereby is directed to cause legal notice of said Public Hearing to be published according to law.

I. Nature of Request:

Resolution sets a public hearing date for the update of the Montgomery County Agricultural and Farmland Protection Plan.


II. Justification:

Public Hearing is required before the updated Agricultural and Farmland Protection Plan can be adopted by the County Legislature.


III. Legislative Impact:

Article 25-AA, Section 302 of NYS Ag and Markets Law details the process for adoption of the updated Montgomery County Ag and Farmland Protection Plan.


IV. Financial Impact:

Cost of publication of the public hearing.

RESOLUTION AUTHORIZING APPLICATION FOR “I LOVE NEW YORK” TOURISM PROMOTION MATCHING GRANT FUNDS (ECONOMIC DEVELOPMENT/PLANNING & TOURISM)

RESOLVED, the Montgomery County Legislature hereby authorizes the Fulton Montgomery Regional Chamber of Commerce and Industry (the County’s Tourism Promotion Agency) to submit an “I Love New York” Tourism Matching Funds Application, in an amount of $51,100 (projected local match of $25,500) for the County’s 2018 tourism and promotion programs.

FURTHER RESOLVED, the Montgomery County Legislature hereby authorizes the County Executive, following review and approval by the County Attorney to sign the application and any associated grant documents related to carrying out this resolution.

RESOLUTION IN SUPPORT OF APPLICATIONS THROUGH THE 2017 RESTORE NY COMMUNITIES INITIATIVE MUNICIPAL GRANT PROGRAM-EXIT 29 REDEVELOPMENT PROJECT (ECONOMIC DEVELOPMENT AND PLANNING)

WHEREAS, the Village Canajoharie and Montgomery County has an interest in revitalizing urban areas and stabilizing neighborhoods; and

WHEREAS, Montgomery County recognizes that the renewal of the these downtown areas throughout the County will strengthen the local economy and increase quality of life for residents; and

WHEREAS, the Village of Canajoharie desires to apply to the New York State Empire State Development Corporation, Restore NY Communities Initiative Municipal Grant Program to redevelop the former Beech Nut Nutrition Plant (Exit 29 Redevelopment Project) in the Village; and

WHEREAS, Montgomery County is owner of said site; and

WHEREAS, the Village of Canajoharie intends to file an application for $1 million and a special application request for $5 million dollars for the project; and

WHEREAS, the funding is a 10% minimum equity match grant program; and

WHEREAS, the administration of any grant will be completed by the Department of Economic Development and Planning.

RESOLVED, that Montgomery County, acting as governing body and owner of aforementioned site hereby supports the efforts of the Village of Canajoharie’s two application submissions for the 2017 Restore NY Communities Initiative Municipal Grant Program; and

FURTHER RESOLVED, that Montgomery County will provide the 10% equity match for the grant(s) that is required per grant regulations, in addition to the $500 application fee that is required per each grant.

Statement of Legislative and Financial Impact:

I. Nature of Request:

Resolution in support of  the New York State Empire State Development Corporation, Restore NY Communities Initiative Municipal Grant Program.


II. Justification:

The Restore NY Grant will provide regional benefits to the County in relation to the Exit 29 Redevelopment Project in the Village of Canajoharie.


III. Legislative Impact:

Pursuant to Article 2 of the Montgomery County Charter the Montgomery County Legislature is the legislative body of Montgomery County. Further pursuant to Article 2 of the Montgomery County Charter the Montgomery County Legislature has the authority to make appropriations.


IV. Financial Impact:

Should grant funds be awarded a cash and in kind match of 10% of the project cost will need to be allocated.

RESOLUTION FOR PROPERTY OWNER REQUEST TO BE INCLUDED WITHIN MONTGOMERY COUNTY CERTIFIED AGRICULTURAL DISTRICT 2 AND AGRICULTURAL DISTRICT 3 (ECONOMIC DEVELOPMENT AND PLANNING)

WHEREAS, Section 303-b of the New York State Agriculture and Markets Law established a mechanism on an annual basis for parcels of land comprised of predominately viable agricultural land to be included within the state’s agricultural Districts, and

WHEREAS, Section 303-b of the New York State Agriculture and Markets Law sets forth the requirement that the Legislative Body in every county in New York State with existing Agricultural Districts must designate an annual 30-day period during which landowners may apply for inclusion of their agriculturally viable land in the Agricultural Districts; and

WHEREAS, Montgomery County Legislative Resolution No. 135 of 2004 established an annual thirty-day period extending from September 1 to September 30 during which landowners may submit such requests to the Legislature to include their properties in the Agricultural Districts; and

WHEREAS, during the one-month period extending from September 1, 2017 to September 30, 2017, the Montgomery County Farmland Protection Board received two such applications on behalf of the Montgomery County Legislature; and

WHEREAS, subsequently the Agricultural and Farmland Protection Board submitted its report with recommendation as to that request to the Legislature; and

WHEREAS, after proper Notice of Public Hearing, the Montgomery County Legislature held a public hearing on November 28, 2017, with respect to the above and heard all those wishing to address the matter at said public hearing; and

WHEREAS, New York State Agriculture and Markets Law Section 303-b requires the Montgomery County Legislature, following such public hearing to adopt or reject the proposed request for inclusion of land within an existing Agricultural District; and

WHEREAS, the report and recommendations of the Agricultural Farmland Protection Board are on file with the Clerk of the Montgomery County Legislature; and

WHEREAS, the Legislature has considered the matter including the report and recommendation of the Agricultural Farmland Protection Board at the public hearing, now, therefore, be it

RESOLVED, that the Montgomery County Legislature hereby adopts the recommendations of the Agricultural and Farmland Protection Board and adopts the request of the landowner to include their land within an existing certified Agricultural District as set forth below:

Statement of Legislative and Financial Impact:

I. Nature of Request:

Resolution authorizes inclusion of parcels into Agricultural Districts #2 and #3.


II. Justification:

There has been a request from  a landowner to include their 27.1 acre parcel of land within the boundaries of Agricultural District No. 3, and a request from a landowner to include their 118 acre parcel of land within the boundaries of Agricultural District No. 2


III. Legislative Impact:

Section 303-b of the New York State Agriculture and Markets Law established a mechanism on an annual basis for parcels of land comprised of predominately viable agricultural land to be included within the state’s agricultural Districts and Montgomery County Legislative Resolution No. 135 of 2004 established an annual thirty-day period extending from September 1 to September 30 during which landowners may submit such requests to the Legislature to include their properties in the Agricultural Districts.


IV. Financial Impact:

Could result in an agricultural tax exemption for both properties if they if they produce over the threshold established by Ag & Markets which is $10k annually.

This is an administrative matter with no financial impact.

WHEREAS, The Commissioner of Social Services has received notification of funding allocated for the New York Connects grant in conjunction with the Office for the Aging for the period October 1, 2016 – September 30, 2017.

WHEREAS, Social Services will receive $5,510.79 in additional funding from the Office for the Aging to cover the cost of operating the New York Connects Program, and

FURTHER RESOLVED, that the County Treasurer is hereby authorized and directed to amend the 2017 Operating budget as follows:

Statement of Legislative and Financial Impact:

I. Nature of Request:

AMENDING 2017 OPERATING BUDGET – NY CONNECTS GRANT

The Department has incurred costs of $5,510.79 for various items that are being reimbursed by Office of the Aging / NY Connects grant monies.


II. Justification:

These expenses are incurred as routine in operating the NY Connects program and training of staff.


III. Legislative Impact:

Pursuant to Article 2 of the Charter, the Montgomery County Legislature has the power to make appropriations and the County Executive has the authority to sign contracts.


IV. Financial Impact:

Had these expenses not been covered by the NY Connects grant, they would have been funded at a rate of 50% Federal and 50% State.

RESOLUTION TO AMEND 2017 BUDGET AND ESTABLISH PART-TIME FRAUD INVESTIGATORS (SOCIAL SERVICES)

WHEREAS, the Department of Social Services currently contracts for Part-Time Fraud Investigators, and through a State Audit, was informed that these contractors must be County Employees; and

WHEREAS, the funds that are currently held for the three (3) Fraud Investigator contracts would be re-appropriated to cover the cost of the salary for the Part-Time Fraud Investigators; and

WHEREAS, the Commissioner of Social Services recommends the appointment of the current contracted Fraud Investigators which is supported and recommended by the audit recently done by the State.

RESOLVED, the Montgomery County Legislature establishes the Part-Time Fraud Investigator positions at a rate of $17 an hour.

FURTHER RESOLVED, the Montgomery County Legislature hereby authorizes and directs, upon review and approval of the County Attorney, that the County Treasurer is hereby authorized and directed to amend the 2017 Operating Budget as follows (effective December 1, 2017):

Statement of Legislative and Financial Impact:

I. Nature of Request:

The Department is requesting that the $2,516.00 of funds set aside from the Contractual line A.18-4-6010-00-4438 be used to change the status of and fund 3 Part Time Fraud Investigators which covers the cost for the remaining 1 month of the 2017 budget. Going forward, these positions will need to be Part Time County Employees as instructed by the State.


II. Justification:

A PT Fraud Investigator works in conjunction with the Fraud Unit to recover monies that were fraudulently paid out to clients.


III. Legislative Impact:

Pursuant to Article 2 of the Charter, the Montgomery County Legislature has the power to make appropriations and the County Executive has the authority to sign contracts.


IV. Financial Impact:

The position will be funded 55% Federal dollars ($1,383.80), 21% State dollars ($528.36) and 24% Local dollars ($603.84). At this time there is no way to break down the exact cost going forward as the contractors work various hours. There will be no change into the status of how these expenditures are claimed.

RESOLUTION AUTHORIZING COUNTY EXECUTIVE TO SIGN AGREEMENT - EASTERN MEDICAL SUPPORT, LLC. (SHERIFF)

WHEREAS, a Request for Proposals (RFP) was issued for the provision of medical services for inmates at the Montgomery County Jail from January 1, 2018 until December 31, 2018; and 

WHEREAS, Eastern Medical Support, LLC was the only respondant to this RFP; and

WHEREAS, the Sheriff has recommended an agreement with Eastern Medical Support, LLC for provision of medical services for inmates at the Montgomery County Jail; and 

WHEREAS, the bid submitted by Eastern Medical Services, LLC was for $216,000.00 per year with $200.00 an hour for time over 14 hours a week beginning January 1, 2018 through December 31, 2018.

RESOLVED, that the Montgomery County Legislature hereby authorizes and directs the County Executive, to sign an agreement with Eastern Medical Support, LLC for provision of medical services at the Montgomery County Jail, following review and approval by the County Attorney at an amount of $216,000.00 per year with $200.00 an hour for time over 14 hours a week per year beginning January 1, 2018 through December 31, 2018 .

Matrix/Araya, is the current pharmacy benefit manager for Montgomery County, who provides, manages and administers prescription drug programs including the maintenance of a nationwide network of pharmacy, claims administration, prescription drug management and rebate services.


III. Legislative Impact:

Pursuant to section 2.04 (b) of the charter the Montgomery County Executive has the authority to sign contracts.


IV. Financial Impact:

Montgomery County will not see an increase in the Matrix/Araya administration fees for the 2018 plan year.

I. Nature of Request:

AUTHORIZING THE COUNTY EXECUTIVE TO SIGN RENEWAL AGREEMENT - EMPIRE BLUE CROSS

 (active employees and retirees under age 65, self insured population)


II. Justification:

Empire Blue Cross provides Montgomery County with the Administration of the County's PPO/EPO Health Insurance Plan.


III. Legislative Impact:

Pursuant to section 3 of the charter the Montgomery County Executive has the authority to sign contracts.


IV. Financial Impact:

Montgomery County will not see an increase in the EPO/PPO administration fees for the 2018 plan year however, certain fees have increased. Specifically, Empire will begin to charge Montgomery County an integration fee to communicate with our Stop loss carrier. This is in the amount of $900.00 a month. In addition, benefits such as Condition Care Core Program has increased from $0.88 pmpm to $.091pmpm as well as Healthy Lifestyle increased from $0.30 pmpm to $.031 pmpm.

The County will continue efforts, as was done for the Retiree over age 65 population, to seek affordable Health Insurance options without sacrificing benefits our Employees receive.

WHEREAS, when all contracts were originally awarded for the Allen House Project, there was a balance of $99,298.46 in the total funding available for the Project; and 

WHEREAS, FMCC desires to have additional paving, sodding and other site work completed in and around the Allen House.

NOW, THEREFORE BE IT RESOLVED, that the County Executive is hereby authorized and directed to execute Change Order No. 1 with Bishop Beaudry that would add $25,000 to Bishop Beaudry’s Contingency Allowance to allow for the additional work FMCC desires to have completed; and

FURTHER RESOLVED, that the approval of this Change Order would result in the following revised contract with Bishop Beaudry:

RESOLUTION AMENDING THE 2017 OPERATING BUDGET - HISTORIC MARKER GRANT (HISTORY & ARCHIVES)

WHEREAS, the County Historian/RMO applied for and received a grant in the amount of $1,094 from the William G. Pomeroy Foundation for the purchase of an historic marker to identify the Old Courthouse as having been listed on the National Register of Historic Places.

RESOLVED, that the County Treasurer hereby is authorized and directed to amend the 2017 Operating Budget, as follows:

 

INCREASE REVENUES:

I. Nature of Request:

The Old Courthouse was listed on the National Register of Historic Places in 1982 as part of the Montgomery County Buildings nomination. 


II. Justification:

The William G. Pomeroy Foundation grants awards for historic markers to those sites that have been listed on the National Register of Historic Places.


III. Legislative Impact:

Pursuant to Article 2 of the Charter the Montgomery County Legislature has the authority to make appropriations.


IV. Financial Impact:

No financial impact.

RESOLUTION AUTHORIZING COUNTY TREASURER TO DISBURSE MORTGAGE TAX MONEY

WHEREAS, Montgomery County collects a Mortgage Tax which pursuant to local law must be distributed to local municipalities of the County; and

WHEREAS, the County Treasurer disburses the Mortage Tax funds bi-annually.

RESOLVED, that the Montgomery County Legislature hereby authorizes the County Treasurer to disburse Mortgage Tax money for the period April 1, 2017 through September 30, 2017, and

FURTHER RESOLVED, that said Treasurer is directed to take all necessary steps, under proper accounting procedure, to adjust the books of his office, effective immediately.

WHEREAS, pursuant to the Audit Guidelines, Section 13.2 (2), requires after examination and review of the claims by the audit committee, and there being no objection to any of the claims by any committee or Board member, shall move that the claims as audited are approved and presented to the Board for approval of payment; and

WHEREAS, the Audit Committee has audited claims for the period of October 27, 2017 through November 28, 2017 and recommends the payment of the claims as attached hereto in the "Abstract of Audited Claims".

RESOLVED, after examination and review of the claims by the Audit Committee, the claims are audited and attached hereto, are hereby approved for payment by the Montgomery County Legislature.

WHEREAS, the Sheriff's Office has no use for the equipment, said equipment being:

(1) 1995 Chevy. P/U truck

(3) copiers 

Several printers

(1) Fax machine

Several siren control heads

(1) Construction site trailer

(1) Water trailer

Various computer wiring supplies

THEREFORE, the Montgomery County Legislature hereby approves the sale of the following equipment to the highest bidder at auction:

 

(1) 1995 Chevy pick up truck

(3) copiers 

Several printers

(1) Fax machine

Several siren control heads

RESOLUTION AUTHORIZING THE COUNTY EXECUTIVE TO SIGN A CONTRACT WITH JMZ ARCHITECTS TO PREPARE DESIGN PLANS AND BID SPECIFICATIONS FOR THE FMCC CLASSROOM BUILDING RENOVATION PROJECT: PHASE I

WHEREAS, Fulton and Montgomery Counties have included the FMCC Classroom Building Phase I Project into their proposed 2018 Budgets, and 

WHEREAS, Phases II and III would be completed in 2019 and 2020, and 

WHEREAS, funding for this proposed Phase I project would come from:

SUNY  50% $500,000
FULTON COUNTY 25% $250,000
MONTGOMERY COUNTY 25% $250,000

and 

WHEREAS, JMZ has submitted a fee proposal to prepare the design plans and bid specifications for the FMCC Classroom Building Renovation Phase I Project, 

NOW THEREFORE BE IT RESOLVED, that County Executive is hereby authorized and directed to sign an Agreement with JMZ Architects in the amount of $156,290 to: 

  1. Prepare design plans for the FMCC Classroom Building Renovation: Phase I and II Project.
  2. Provide Construction Administration Services for Phase I.

and be it further

RESOLVED, that copies of this Resolution be forwarded to the Fulton County Board of Supervisors, FMCC and County Attorney.
