RESOLUTION ADOPTING REVISED NON-BARGAINING POLICY FOR FULL-TIME/PART-TIME APPOINTED & DEPARTMENT HEADS

WHEREAS, the Mongomery County Legislature established a Non-Bargaining Personnel Policy by the adoption of Resolution 112 of 2015; and

WHEREAS, it has been recommended by the County Executive that additional revisions be made to the Non-Bargaining Personnel Policy; and

WHEREAS, the Non-Bargaining Personnel Policy for Full Time/ Part-Time Appointed & Department Heads with the  revisions has been distributed to all members of the Montgomery County Legislature for their review.

RESOLVED, that the Montgomery County Legislature hereby approves of and adopts the revised Non-Bargaining Personnel Policy and salary schedule for Non-Bargaining Personnel Policy for Full Time/Part-Time Appointed & Department Heads as attached hereto and made a part hereof.

Statement of Legislative and Financial Impact:

I. Nature of Request:

 The policy that is currently in place has expired and requires an update.


II. Justification:

The policy that is currently in place has expired.

Elected officials are being placed into the Non-bargaining policy until such time as there is a new local law or a new term of office, as adopted by the Elected Officials Policy 262 of 2016.

This policy also reflects changes to some department heads and administrative positions. Such as, the Corrections Administrator salary received an adjustment to correct the discrepancy in salary between the position and those in which the position is charged to supervise. As well as, the Hr Financial Specialist, Personnel Officer/Self Insurance Director and Economic Development Director positions, that also received adjustments to salary to be consistent with similar positions and responsibilities.


III. Legislative Impact:

Article 2, Section 2.04 of the Montgomery County Charter states that the Montgomery County Legislature shall be the legislative, appropriating and policy-determining body of the County. 


IV. Financial Impact:

The increase for the 2017 is $67,625. This is a one-time payment for the elected, department heads and non department heads that is not added to base and is not compounded over time. This payment is prorated based on years of service.

Upon adoption of this policy, employees shall receive an off schedule bonus, not added to the base salary as follows (payments to be made within 30 days of policy adoption.

Effective January 1, 2018, the base salary shall be increased by 1.5%

Effective January 1, 2019, the base salary shall be increased by 2%.

Effective January 1, 2020, the base salary shall be increased by 2%.

The increase in the proposed salaries as a result of the changes listed (Non Legislative) for 2017 are $41,913.00.

The increases over 2018-2020 due to the percentage increases proposed are $339.134.00. (These percentages are not inclusive of salary changes).

The Overall total cost increase for the duration of the policy is $581,830.00.

The non-bargaining policy will also begin to address increase to Health Insurance cost that the County has felt in recent years. The policy increase health insurance contributions for new hires to 20% from 15%. In addition, further cost savings will be had upon the ratification of other bargaining units. Non bargaining employees who receive health insurance benefits from Montgomery County will follow the health insurance plan design as modified and agreed upon in countywide negotiations.

WHEREAS, the Montgomery County Legislature has adopted a non-bargaining policy which defines a salary schedule for all non-bargaining employees employed by Montgomery County, and

RESOLVED, that Local Law 3 of 2017 hereby is adopted and is incorporated as follows: “A LOCAL LAW ESTABLISHING SALARY SCHEDULE OF VARIOUS COUNTY OFFICIALS ”

SECTION 2.

This Local Law is subject to a permissive referendum, and will be submitted to a vote of qualified electors of the County of Montgomery, if, within 45 days after the date of which it was so adopted, there is filed with the Clerk of the Montgomery County Legislature a petition protesting against this Local Law, signed and authenticated as required by Section 24 of Municipal Home Rule Law, by qualified electors of Montgomery County registered to vote therein at the last preceding general election, in number equal to at least ten per centum of the total number of votes cast for Governor at the last gubernatorial election held in said County; and

FURTHER RESOLVED, that the Clerk of the Legislature hereby is authorized and directed to file one certified copy thereof in the Office of the Secretary of State and to ensure that it is published in the County’s designated legal newspapers, as required by law.

FURTHER RESOLVED, this resolution is contingent upon the passage of Resolution 80 of 2017.

2017 - $59,976 (FICA $4,588)

Financial impact is the difference between 2016 and 2017 total compensation, inclusive of salary changes, increment, longevity and bonus.
