RESOLUTION AWARDING BRIDGE REPLACEMENT CONTRACT- TIOGA CONSTRUCTION, INC.

WHEREAS, by Resolution 54 of 2016, the Montgomery County Legislature authorized the replacement of the Fort Hunter Road Bridge in Montgomery county; and
WHEREAS, an RFP was issued for the replacement of the Fort Hunter Road Bridge and responses were received;
WHEREAS, the Commissioner of Public Works has recommended that a contract be awarded to the lowest responsible, responsive bidder for such replacement.
RESOLVED, that the Montgomery County Legislature hereby awards a contract to Tioga Construction, Inc., of Herkimer, New York, for bridge replacement as follows:
Fort Hunter Road Bridge on County Route 145, B.I.N. 3309690 in the Town of Florida
FURTHER RESOLVED, that the County Executive, upon review and approval of the County Attorney, is hereby authorized and directed to sign a contract with Tioga Construction, Inc., of Herkimer, New York; and
FURTHER RESOLVED, the contract shall state that the contractor shall complete the project within one hundred and fifty (150) calendar days; and
FURTHER RESOLVED, that said contract shall provide for payment in an amount not to exceed $1,014,048.50.

I. Nature of Request:
To award a bridge replacement contract to the lowest responsible bidder.
II. Justification:
The bridge replacement was approved and funded in the 2016 Capital Project Plan.
III. Legislative Impact:
Pursuant to Article 3 of the Montgomery County Charter, the Montgomery County Executive has the authority to enter into contracts.
IV. Financial Impact:
Project was bonded in 2016 and the bid received was within the Engineer's estimate.

RESOLUTION AMENDING THE 2017 OPERATING BUDGET- ELIMINATING DIRECTOR OF AUTOMOTIVE POSITION AND PUBLIC WORKS STORES HELPER II POSITION AND ESTABLISHING SENIOR AUTOMOTIVE MECHANIC AND SENIOR PUBLIC WORKS STOREKEEPER POSITION (DEPARTMENT OF PUBLIC WORKS)

WHEREAS, the Department of Public Works currently has a vacant Director of Automotive position at a salary of $50,075 (Non-Bargaining Grade O); and
WHEREAS, the Department of Public Works currently has a position of Public Works Stores Helper II position at a salary of $36,378 (Bargaining Unit Grade F); and
WHEREAS, the Commissioner of Public Works has reviewed the required workload and determined that a Supervising Auto Mechanic (Bargaining unit- grade J) and a Senior Public Works Storekeeper (Bargaining Unit Grade H) would better fit the needs of the department; and
WHEREAS, this change would not financially impact the Department of Public Works, and would, in fact, save the department $4,483.00 in base salary.
RESOLVED, the Montgomery County Legislature hereby eliminates the Director of Automotive position and the Public Works Stores Helper II position, and
FURTHER RESOLVED, the Montgomery County Legislature establishes the position of Supervising Automotive Mechanic at a Grade Level J with a base salary of $41,097.00; and establishes a position of Senior Public Works Storekeeper at a Grade Level H with a salary of $40,873.
FURTHER RESOLVED, that the County Treasurer is hereby authorized to amend the 2017 Operating Budget as follows:

I. Nature of Request:
Department of Public Works currently has a vacancy for Director of Automotive, and, after a review of departmental needs, it has been determined that a Supervising Automotive Mechanic would be more beneficial to the Automotive Department in Public Works, and a Senior Public Works Storekeeper would better benefit the department.
II. Justification:
The Resolution changes the title from Director of Automotive (Non-Bargaining) to Supervising Automotive Mechanic (Bargaining), as well an upgrade for a position of Public Works Storehelper II (Grade F) to a Senior Public Works Storekeeper (Grade H).
III. Legislative Impact:
The Montgomery County Legislature has the power to eliminate and establish positions of employment and the power to make appropriations.
IV. Financial Impact:
There will be a cost savings in salary from the position of Director of Automotive being eliminated ($50,075.00) to the position being created of Supervising Automotive Mechanic ($41,097 base), and a salary of $36,378 from Public Works Store Helper II to a salary of $40,873 for Senior Public Works Storekeeper, which is a combined savings to the County of approximately $4,483 in base salary.

WHEREAS, an agreement and release has been negotiated with the New York Environmental Protection and Spill Compensation Fund regarding all past and future Navigation Law liability the County would incur if it acquired Tax Map Parcel Number 63.14-1-9.1 through foreclosure.
RESOLVED, that the Montgomery County Executive is authorized to enter into an Agreement and Release with the New York Environmental Protection and Spill Compensation Fund for an amount not to exceed $5,000.00.

AUTHORIZING THE MONTGOMERY COUNTY EXECUTIVE TO ENTER INTO AN AGREEMENT AND RELEASE WITH THE NEW YORK ENVIRONMENTAL PROTECTION AND SPILL COMPENSATION FUND
II. Justification:
The Agreement and Release will help the County avoid potential liability through foreclosure on Tax Map Parcel Number 63.14-1-9.1
III. Legislative Impact:
Pursuant to Article 3 of the Charter the Montgomery County Executive has the authority to enter into contracts.
IV. Financial Impact:
No appropriation is needed.

RESOLUTION AUTHORIZING THE COUNTY EXECUTIVE TO ENTER INTO AN INTERMUNICIPAL AGREEMENT FOR ASBESTOS WASTE DISPOSAL SERVICES WITH FULTON COUNTY (PUBLIC WORKS)

WHEREAS, it is necessary to set a course of action for asbestos waste disposal services for Montgomery County; and
WHEREAS, the Department of Public Works has worrked out an agreement with Fulton County for disposal of asbestos waste from Montgomery County-owned properties; and
WHEREAS, it has been determined that cooperative action with Fulton County will be of economic benefit to both municipalities.
RESOLVED, that the Montgomery County Legislature hereby authorizes the Montgomery County Executive,upon review and approval of the County Attorney, to enter into an inter-municipal agreement for asbestos waste disposal services with the County of Fulton, for a term ending on December 31, 2017 with one year renewals at the same terms.

I. Nature of Request:
Resolution authorizing the Montgomery County Executive to enter into an inter-municipal agreement with the County of Fulton for the purpose of asbestos waste disposal services for Montgomery County properties.
II. Justification:
Montgomery County owns properties that are in need of demoltion, and Montgomery County needs the means to dispose of asbestos waste.
III. Legislative Impact:
Pursuant to Article 3 of the Montgomery County Charter, the Montgomery County Executive has the authority to enter into contracts.
IV. Financial Impact:
The cost of asbestos waste disposal is the base fee of $75 per ton plus 15% for out of county ($86.25) which has no budget impact as these fees are to be covered within cost of demolition by the entity doing the demolition.
